Stuart vs. Duncan -- O.S. 192; N.S. 68 -- Deed 6th June, 1774, by Samuel Ayres and Rachel, his wife, late Rachel Morrison, and Joseph Higginbotham Morrison, oldest son and heir-at-law of Rachel by her first husband, Wm. Morrison, deceased, of Parish and County of Amherst to John Dillard of same place. Before his marriage, Samuel by writing dated 14th November, 1772, executed marriage contract, conveys 250 acres on Beaver Creek in Amherst, part of 2,700 acres patented to Wm. Cabell, Jr. Recorded in Amherst, 4th July 1774. Will of Samuel Ayres of Amherst. Devisee, William Ayres, son of Thomas Ayres, deceased, and Mary, his wife, of Essex County, 30 sh. to keep him from being heir to Samuel. Wife, Rachel; legatees, Eve Lackey, Joseph Higginbotham Morrison, Ezra Morrison, Tizza Davis, John Lackey, son of Eve Lackey. Dated 10th February, 1784. Recorded in Amherst, 3d May 1784. Answer by William Duncan, son of John Duncan, deceased. Answer by Charles Duncan. Orator is Thomas Stuart and Terza, his wife, late Davis, and formerly Terza Morrison, John Lackey, only son and heir of Eve Lackey, deceassed, formerly Eve Morrison, and Ezra Morrison. Terza, Eve and Ezra were heirs of William Morrison, deceased, by late Rachel Ayres, formerly Rachel Morrison; Rachel died in winter of 1808-9 intestate. Samuel and Rachel entered into a marriage contract by which Samuel agreed to convey all his estate to heirs of himself and Rachel, and if they have none, then to the children of Morrison and Rachel. Samuel and Rachel had no children. Orators claim all Samuel's property in spite of Samuel's will. One tract Samuel deeded to Dillard, which came by transfers to John Duncan, who died intestate and is now held by Sarah or Sally Duncan, his widow. William and George Duncan, Elizabeth Goode (formerly Elizabeth Duncan) and Campbell Goode, her husband; Claiborne and Charles Duncan; Nancy Camden (formerly Duncan), wife of Washington Camden; Lavinia Sale (late Duncan), wife of William Sale; Wiatt, Elizabeth, Wortley, Polly, John, Spicey and Patsy Duncan, who are the children and heirs of John Duncan (last seven being infants).

Pg.413: 23 June 1800, Messrs William and Joseph Duncan, pedlars, came into court and produced a license obtained by them from Amherst Co. court at Feb. term last, permitting them to retail goods, wares and merchandise agreeably to Act of Assembly, which at their request is entered of record.

Applied 6 Sept. 1819, age 67, in Greene Co. TN; enlisted Jan. or Feb. 1776 in Amherst Co. VA under Capt. Cabell/Cahill, Col. Buckner, for 2 years; transferred under Col. M?. Donohoe of Augusta Co., Capt./Col. Joseph Crocket; transferred Col. Russel ..., Col. Ball, Capt. Wm. White; age 68 on 23 Oct. 1820, has wife living and has had 17 children, 8 now living with him and principally small.

Pg.226: Albemarle Association Buffaloe Church. Mr. William Duncan, a preacher of useful gifts, is a member of this church and has been ordained to the ministry. (Buffaloe church stood in the vicinity of Amherst courthouse.) Footnote: William Duncan served various churches in the Albemarle Assn. as pastor until 1830, when he removed to Calaway Co. MO. He subsequently located in Boone Co. [MO], where he acted as a domestic missionary. He died in 1846.

We are fortunate in finding a sketch of the life of this very useful man, written by his son, Dr. W.H. Duncan. The MO Baptist Historical Society, as the custodian of all obtainable records of Baptist history in MO, has furnished the material for this sketch.
Rev. William Duncan was born in Amherst Co., VA, 22 Feb. 1776. His father, Rev. John Duncan, was a Baptist preacher and contributed largely to the overthrow of the union of church and state in America. When about twenty years of age, William was truly converted and united with the local Baptist Church. Very soon thereafter he entered upon his life work as a minister of the gospel. ... He became pastor of Ebenezer, Mount Moriah and Pedlar Churches in Amherst Co., and of Rock Fish, once Jonesborough in Nelson Co. [VA]. Some of these churches he served continuously for 37 years. He was married to Miss Sally Henly while quite a young man. This union was blessed with eight children, two sons and six daughters. The children had sought homes in the then new state of MO. That the parents might be still in close contact with their children, the father, in 1830, resigned the pastorate of the churches ... and moved to Callaway Co. MO. After eight years of service in Callaway Co., he moved to Howard Co. [MO] and secured a home two miles south of Fayette, the county seat. During the time of his residence in Howard Co., he served five churches at various times. ... In October, 1846, he was present at the meeting of the Mount Pleasant Association at Ebenezer Church in Randolph Co. [MO]. While preaching to a large congregation, he was attached by a congestive chill; he was able to ride to his home some twenty miles distant, but was then placed on his dying bed, where he died about 48 hours later. He had been pastor of the church in Huntsville, Randolph Co., for eight years.

Pg.365: Wyatt Godfrey Duncan ... The founder of the Duncan family in America was Wyatt Duncan, a native of Scotland and for many years a planter in Virginia, but eventually a pioneer of Missouri, where he died in Callaway county at a great age. Among his children was a son, Judge John I. Duncan, who was born in Virginia April 15, 1807, grew to manhood at the old homestead, married Margaret Toler and after his marriage settled in the western part of the Old Dominion. About 1833 he took his family to Missouri and settled upon raw land in Callaway county [MO]. ... His death occurred January 18, 1876, when he was almost sixty-nine years of age. His wife was born in Virginia and died August 18, 1849, in Missouri. Her father, Godfrey Toler, came to the United States during young manhood and settled in Virginia, where he engaged in farming. After many years he settled among the pioneer farmers of [Vigo Co.] Indiana. Later he went to Barry Co. MO, and there he passed away November 4, 1843, at an advanced age.
There were twelve children in the family of Judge Duncan. Five of the number are still living. The eldest of the family, Wyatt Godfrey, was born in Amherst Co. VA, October 1, 1828, and was taken to Missouri at five years of age, .... started with a brother, William, to California, April 24, 1850. ....

More than one hundred years have passed since Wyatt Duncan crossed the ocean from his native Scotland and settled in Virginia, where he took up the life of a planter in the midst of an environment of activity and enterprise characteristic of the Old Dominion in that era. After a long period of usefulness in that section of the country he eventually removed to MO, where he died in Callaway county [MO] at an advanced age. Next in line of descent was John I. (father of Wyatt Godfrey), who was born in VA April 15, 1807, and grew to manhood on the home plantation. After his marriage he settled in the western part of VA, but about 1833 proceeded still further west and identified himself with the pioneers of Callaway Co. MO. .... His death occurred January 18, 1876, when he was almost sixty-nine years of age.
On the maternal side Wyatt G. Duncan traces his lineage to Godfrey Toler, .... His daughter, Margaret, was born in VA, accompanied the family to IN, thence went to MO, and there died August 18, 1849. .... Among the children born of her marriage to Judge John I. Pg.376-377: B.F. DUNCAN, an extensive rancher of the Capay Valley, was born February 2, 1840, in Vigo County, Indiana, and the son of John I. and Margaret (Toler) Duncan, natives of Virginia. The senior Duncan followed agricultural pursuits all his life. At one time he was judge of this district. In 1842 he removed to Missouri, where he remained until his death, which occurred when he was seventy-four years old; his wife also died in that State, in 1849. Mr. B.F. Duncan, our subject, was raised on the farm in Missouri. At the age of 21 years he enlisted in Company G., Captain Curry, Eighth Regiment, Colonel Mitchell, Parson's Brigade, Cavalry, and was six months in the service. He was mustered out at Shreveport, Louisiana, after a service of three years and three months. Was wounded four times, twice in one engagement. ... After the war he remained in Missouri until 1870, when he came to California and settled near Cottonwood, Yolo County, on land which he purchased. He remained there until 1878, when he sold out and purchased his present place two miles west of Capay, in the celebrated Capay Valley. This ranch consists of 737 acres of choice bottom land, on which Mr. Duncan carries on a general farming business, and is preparing to establish himself in the fruit industry next year (1891). He is a very practical man and enterprising. He has two brothers in this county, whose sketches will be found elsewhere in this volume. (MAD: nothing said about a wife) (MAD: see Barry Co. Pg.619-620: W.G. DUNCAN, a farmer near Capay, Yolo County, was born October 1, 1828, in Amherst County, Virginia, the son of John I. and Margaret (Toler) Duncan, natives also of that State, who moved to the northern part of Missouri when their son was a small boy. Remaining with his parents until 1850, the subject of this sketch, in company with his brother, William H., came overland to California, with Dr. Lane, who supplied the penniless boys with the necessaries of the journey, in consideration of half their earnings for a year. They followed mining at Mud Springs for three months, but with little profit, and Dr. Lane agreed to release them with three months' work for him, which proposition was accepted and the work done. The brothers then followed mining again, until the spring of 1853, when they took up a tract of land two and a half miles from their present place. In 1869 they disposed of that farm to Mr. Woodard. During the previous year they had bought the place where they now reside, a mile from Capay, where they now have 7,300 acres, besides eighty acres near Woodland. Mr. Duncan was married in Woodland, March 13, 1879, to Miss Mary Franklin, a native of California, and they have one child, who was born in 1883 and is named Elvira G.

Pg.375: John B. Duncan, of Duncan & Howard, grocers etc. Richmond Twp. Samuel J. Duncan, the father of John B., was a native of Amherst Co. VA; he came to MO at an early date and settled in Howard Co. [MO], he was here married to Miss Elizabeth Price, of this county, and here he lived until his death in 1868; for many years a merchant in Fayette; brought up his son John B. who afterwards became his father's partner. His wife (unnamed), the mother of John B., died in 1852. John B. Duncan was born August 4, 1850, and reared and educated in this county; after long business experience in different stores, including those of Boone, Duncan & Smith, Duncan & Aterbery, Duncan & Son of which he was the junior partner, W.H. Smith, and others, in 1868 he engaged in the grocery business on his own account, two years afterwards the firm became Duncan & Co. ... (Nothing about a wife.)

Pg.233: Elder John B. Duncan born in Amherst Co. VA Oct. 5, 1796, baptized by William Davis in the James River June, 1815, ordained 1821, Presbytery: Wm. Duncan, Fleming Duncan, V.M. Mason, John Davis. He was a representative in the VA Legislature 1828-9; practiced law for 17 years; served as pastor at Grace, Society Hill, Hermon, Paris, Clarksville. He married Nov. 12, 1819, Mildred Coleman. He died 20 Aug. 1879 at the home of his nephew, Capt. O.R. Henley near Ripley (Lauderdale Co. TN) at age 83. He was preacher of the gospel for 63 years. At one time a citizen of MO, he accompanied Doniphans' expedition to Santa Fe, returning through Mexico. His body is laid to rest in the family burying ground of Mrs. Ann Conner near the remains of his much loved co-worker, The Rev. C.C. Conner, D.D. Ripley, TN.

Since then the record of his marriages has been very large, but that part of it from 1835 to 1865 is made up from his memory and amounts to as many as two hundred and forty couples for that period. In 1865 he began keeping a record, and since then ... Mr. Wall married Sarah Alexander Sale, daughter of William and Lavina (Duncan) Sale, in Union County, November 15, 1837. Mrs. Wall's father, a farmer of Union County, was born in Caroline County, Virginia, March 31, 1771, married in Virginia April 18, 1800; came to Union 1828; died here January 12, 1861, having served in the War of 1812 as Captain. Mrs. Wall's mother was born in Amherst County, Va., April 30, 1780, and died in Union County March 24, 1858. Her paternal grandparents were Thomas and Clara (Sanders) Sale. Mrs. Wall was born in Nelson County, Va., December 30, 1816; died in Union June 25, 1880, the mother of ten children, viz: Louis A., Wm. B., and Peter, all of whom were in the Confederate army; Mary L., Mobley, Sarah Virginia, Davenport, Frances E., Howell and Juliet C. ...

Pg.52: Dr. Cabell was long a member of the vestry, a church-warden, etc., the Rev. Robert Rose and himself were good friends, and he is frequently mentioned in Rose's Diary, which is now preserved by the Virginia Historical Society. He frequently preached at and stayed at "Capt Cabal's." "Jan'y 23rd 1748/9 stayed at Capt. Cabal's reading the Literal Scheme and viewing his low grounds -- Saw Martin Duncan's wife making sugar." [MAD: Robert Rose's survey of land was in Goochland County, Virginia]
Dr. Cabell brought Martin Duncan a 16-gallon still from England in 1741, but I suppose this still was for making something stronger than sugar.
Pg.149-151: Convention on May 10, 1776, ... assistance to North Carolina ... The quota of Amherst County [Virginia], one company of fifty men, was enlisted in the service on May 25; Nicholas Cabell, captain; ... extracts from Col. William Cabell's diary ... The references to Capt. Nicholas Cabell in his brother's (Col. Will's) diary are nearly all of a business character. ... "Jan'y 30th, 1778. Paid Nicholas Cabell £400 in presence of Young Landrum and Daniel Dunakin -- also paid him £4 4s. which Daniel Dunakin paid James Bell, the fuller, for fulling 16-3/4 yards of cloth."
