    Indenture from Pinkney N. Gilbert and Martha M. Gilbert to Marcus R. Gable, dated 16 November 1885

    The State of Alabama
    Shelby County

    This indenture made and entered into this the 16th day of November A.D. 1885, between Pinkney N. Gilbert and wife of Shelby County Alabama, parties of the first part, and Marcus R. Gable of Shelby County, party of the second part.

    Witnesseth, that the said parties of the first part, for and in consideration of the sum of fifty dollars to them in hand paid by the said party of the second part, the receipt whereof is hereby acknowledged, the said parties of the first part has bargained and sold, and do by these presents grant, bargain sell and convey unto the said party of the second part, the following described real estate, lying in the county of Shelby State of Alabama, to wit: The South West fourth of South West quarter and South half of South West fourth of South West quarter of Section Thirty four (34) of Township Nineteen (19) S. Range one (1) West.

    To have and to hold to the said party of the second part, and to his heirs and assigns forever. And said Pinkney N. Gilbert and wife Martha M. Gilbert of the first part covenant with the said Marcus R. Gable of the second part, that we are lawfully seized in fee simple of said premises; that they are free from all encumbrances, and that we have a good right to sell and convey the same; that we will and our heirs, executors and administrators shall warrant and defend the same to said Marcus R. Gable of the second part, and his heirs and assigns forever against the lawful claims of all person.

    In testimony whereof we have hereunto set our hands and seals, the day and year above written.

    I Nathaniel Thomas a N. P. & E.O. J. P. for said county, hereby certify that Pinkney N. Gilbert & Martha M. Gilbert whose names are signed to the foregoing conveyance, and who is known to me, acknowledged before me on this day, that being informed of the contents of the conveyance, they executed the same voluntarily on the day of the same bears date. Witness my hand, this 16th day of November 1885.

    I Nathaniel Thomas a N. P. & Ex Off Justice of the Peace for Shelby County and State aforesaid do hereby certify that on the 16th day of November 1885, came before me the within named Martha M. Gilbert known, or made known, to me to be the wife of the within named Pinkney N. Gilbert who, being by me examined separate and apart from her husband touching and signature to the within conveyance acknowledged that she signed the same of her own free will and accord, and without fear constraints in threats on the part of her husband.

    In witness whereof I hereunto set my hand this, 16th day of November 1885.
