THE WILL OF ELIZABETH (DAVIS) BARTLETT

Will Book 26, p. 309.

In the name of God Amen, I Elizabeth BARTLETT of the County of Frederic, State of Virginia being of sound mind and disposing memory do make & ordain the following as my last will and testament, to wit:

1st. I hereby direct my executor hereinafter named to pay all my funeral expenses and all my just debts.

2nd. The sum of five hundred dollars willed to me by my dec�d brother Stephen DAVIS I devise & bequeath as follows: I devise & bequeath unto my son Joseph C. BARTLETT who now resides in the County of Clark & State of Virginia, three hundred dollars, in trust to be laid out in the purchase of lands for the sole use & benefit of my daughter, Mary Ann BROWN, the wife of Joseph A. BROWN who now resides in the State of Missouri. It is my wish & desire that such lands shall be selected as will best please my aforesaid daughter Mary Ann BROWN and at her death said lands with all the improvements &c shall descend in equal proportions to each of her children.

3rd. I devise & bequeath unto my granddaughters Lucy Marshall BROWN, Martha Washington BROWN, Julia Davis BROWN, & Mary Catherine BROWN, who is now the wife of Thomas W. NEWMAN, all of them the daughters of James S. BROWN, dec�d and residing in the State of Missouri the sum of two hundred dollars to be equally divided between them.

4th. I devise & bequeath unto my grandson John Henry BARTLETT, the son of Henry BARTLETT dec�d all the residue of my estate.

5th. I constitute & appoint my son Joseph C. BARTLETT executor of this my last will & testament hereby revoking all former wills & testaments made by me since 1853. Witness my hand & seal this the 14th day of April 1855.

as her last will & testament in the presence of the subscribers,
who, in her presence, at her request & in the presence of each
other have subscribed our names as witnesses thereto.

At a court held for Frederick County the 5th day of October 1857 this last will and testament of Elizabeth BARTLETT dec�d was proved by the oaths of Amos PAYNE, H. B. PILZER & S. D. TIMBERLAKE witnesses thereto and ordered to be recorded and on motion of Joseph C. BARTLETT the executor therein named who made oath according to law, certificate is granted him for obtaining a probate thereof in due form on his giving security. Whereupon he together with Stephen D. TIMBERLAKE his security entered into & acknowledged bond in the penalty of one thousand dollars conditioned as the law directs.
