Callahan Auditor Letter from the Treasury Department No. 36422 Treasury Department Third Auditor's Office Dec 13 1851 _Joseph Richardson_, a private in Capt Gould Tylor's Co New York Militia Served from 23rd Dec 1813. His Widow Abigail richardson, Signs the receipt roll to 30 Dec 1813. The rolls state that he was killed. the Co were in Service from 23rd Dec 1813 (indef) to 6th January 1814, the expiration of the Service. Jo. S. Callaher Aud Reexamined Dec 13 1851 Deposition of Eli Stedman Livingston County fs. Eli Stedman came before me one of the Justice of the Peace for and in said county and being duly sworn deposed and saith that he was a volunteer in the last war with Great Britton in the year 1813 and was an acting Ensign in Capt Gould Tyler's Company and of Col Samuel Blakesley's Reagent and further saith That he knew Joseph Richerson and That he was a volunteer in The aforesaid Redgment[crossed out] Company and Reagment and was knowing To the aforesaid Richerson being killed in the battle of Blackrock in the aforesaid year on the 31 day of December of that year Sworn before me this 27 day of Sept 1851 Eli Stedman Ashael Norton 2nd Justice of the Peace Certificate of the Deposition of Eli Stedman at the county clerk's office Deposition of Robert Adams State of New York Monroe County, fs. Robert Adams of the town of Livonia being duly sworn says that he was well acquainted with Joseph Richardson formerly of Livonia aforemind[?] nuae[?] aiciused[?] in his lifetime. That he knows that the said Joseph Richardson was a volunteer in Capt. Gould Tyler's Company of volunteers in the war of the United States with Great Britain of 1812. That said Richardson volunteered and went into service about the middle of December 1813 - That deponent was a lieutenant in Capt James Brooks company of detached militia at the same time That ^written a few day rift _the [unclear] monroy_ after the Battle at Black Rock which of deponent remembered count[?] was in the 31st day of December 1813 - deponent with others were either scrub[?] orn [unclear] volunteers to go when the battle gunn at lind[?] fence[?] - that deponent and some with him formd among other the body of said Joseph richardson that said Richard- son was found dead on the said [unclear][last three words crossed out] day after[crossed out] said battle with a bullet hole Uiwarjh[?] his body + his head scalped - that he appeared to have been killed by being shot through his body near his heart - that his body was formd [?] on said battle grmmd[?] [unclear word] the Rock and Porters store house - That deponent very readily recognized the body of said Joseph richardson who had our peculiar foot and short leg so that everywhere he walked he took a page 2 walking wm[?] lis[?] lasi [?] - that Julius Krimsky was in the same company with said Joseph Richardson and was found dead near him and were both serving[?] in the same ground[?] - that deponent has recently received a bunnit[?] for his services in the said war and deponant further says that he help pick up and sing[?] the said Richardson in Lindsly[?] - and says that he is well acquainted with Abigail Richardson the widow of said Joseph Richardson and knows that the said Joseph + Abigail lived and whubitin[?] together as husband and wife from the time deponent first became acquanited with them which was some eight or ten years before the death of said Joseph Richardson up to the time of said Richardson's going into said service of the United States - deponent further says that be unla[?] them with him went warr[?] the same Battle grown just as the last boat of the enemy were escaping over back to Canada - that this was the time he found said Joseph Richardson dead as aforesaid. Said deponent und[?] then with him under the first[?] - that brint[?] upon said Battle ground after said Battle - subscriber and sworn his 1st day of October 1851 Robert Adams Before me Derton G. Shuart Justice of the Peace in aforesaid County I certify that the words Derton G Shuart J. P. Letter from DG Shuarts to unknown, perhaps Treasury Office Honeoye Falls NY October 3 51 Sir I received yours of 20 ult in Mrs Richardson application. Enclosed I [seem?] the affidavits of Mr. Stedman & Robert Adams. If these will not answer Affidavit of Abigail Richardson State of New York Monroe County fs. On this fourth day of December A. D. one thousand eight hundred and fifty personally appeared before me a Justice of the Peace within and for the county and state aforesaid Abigail Richardson aged seventy six years a resident of the town of Mendon in the State of New York who being duly sworn according to law declares that she is the widow of Joseph Richardson deceased who was a private in the company command -ed by Captain Gould Tyler in The Regiment of Infantry commanded by Col Blakesly in the War with Great Britain declared by the United States on the Eighteenth day of June 1812- that she does not know the number of the Regiment- That her said husband vol unteered at Livonia then in Ontario now Livingston County state of New York in the forepart of December AD 1813 for a term unknown to her, and continued in actual service in said war for the Term of three weeks or thereabouts- That her said husband was in the Battle of Black Rock and was killed in said battle on or about the 31st day of December 1813 while engaged in said battle in the service in said war -- She further states that she was married to the said Joseph Richardson in Leyden in the State of Massachusetts in the month of February AD 1896(sic) [should be 1796] by a Baptist minister whose name she does not now recollect- That there is no public or private record of said marriage to her knowledge on belief in existence or that can be procured- That her name before her said marriage was Abigail Fisk. That her said husband was killed as above stated and that she is still a widow never having been married since his death- She makes this declaration for the purpose of obtain ing the Bounty Land to which she may be entitled under the "act granting bounty Land to certain officers and soldiers who have been engaged in the military service of the United States" proposed[?] September 28 1850 Abigail Richardson Sworn to and subscribed before me the day and year above written Denton G. Shurart Justice of the Peace Deposition of Rufus Richardson State of New York Monroe County fs. On this fourth day of December 1850 personally appeared before me a Justice of the Peace within and for the county and state aforesaid Rufus Richardson aged forty seven years a resident of Mendon in the county of Monroe [unclear] State aforemen who being duly sworn according to law deposeth + saith that he has heard [unclear] the forgoing declaration of Abigail Richardson and believes the same to be true. That he is the son of the said Joseph + Abigail Richardson. That the said Abigail has resided in the family of this deponent for the time of twenty one years and upwards. That she has never been married since the death of said Joseph Richardson and is now a widow- Rufus Richardson [cutoff]subscribed before me the say above written [cutoff]ember 1850, Denton G. Shurart, Justice of the Peace Deposition of Erastus Lewis [cutoff]w York Monroe County fs. On this fourth day of December 1850 personally appeared before me a Justice of the Peace within and for the county aforesaid Erastus Lewis aged sixty-four years a resident of Livonia in the county of Livingston and State of New York who being by me duly sworn according to law deposeth and saith that he was well acquainted with Joseph Richard =son in his life time who was the late husband of Abigail Richardson who has made the annexed[?] declaration- that the deponent lived a near neighbour to the said Joseph Richards in Livonia aforesaid at the time the said Joseph Richardson volunteered in the United States service- That the said Joseph Richardson now deceased was a private with the deponent in the company commanded by Capt Gould Tyler in the Regiment of Infantry commanded by Col Blakely in the war with Great Britain declared by the United States on the 18 day of June 1812. The number of the Regiment this deponent does not now recollect. That the said Joseph Richardson with this deponent volunteered at Livonia then Ontario now Livingston County and state aforesaid in the forepart of December 1813- That the said Joseph Richardson con tinued in the actual service in said [remt?] until the battle at Black Rock on or about the 31st day of December 1813 in which battle the said Joseph Richardson was killed that deponent was in the same company and saw his body after he was killed- that deponent was in the same battle as the said Joseph Richardson [page 2] That this deponent know[?] to the time of the said Joseph richardson volunteering as aforesaid[?] and for about ten years next preceding lived a near neighbor to said Joseph Richardson and the said Abigail Richardson his wife That the said Joseph Richardson and Abigail his wife during the time last aforesaid and up to [unclear] including the time said Joseph Richardson volunteered, lived together as husband and wife and were so respected[?] to be and had some eight children. That deponent has been well acquainted with the said Abigail Richardson since her said husbands death, that she has remained his widow and is now the widow of said Joseph Richardson deceased and now resides with her son one of the aforesaid children (Rufus Richardson) at Mendon in the county of Monroe- That deponent has been intimately acquainted with said Abigail Richardson since the death of her said husband Joseph Richardson. That she is now called and known as the widow of Joseph Richardson deceased and deponent has never heard it said or [uite?] [maten?] that she had been married to any person since the death of said Joseph Richard son and he confidently states and believes she never has been married since the death of said Joseph Richardson- Erastus Lewis Sworn to and subscribed before me the day and year above written.
