Special proceedings to make real estate assets to the Hon, the clerk of the superior Court. The petition of John f. Pridgen of New Hanover County, aforesaid, administrator of John W.l Pridgen respectfully showeth to your Honor that he was duly appointed administrator of the said John W. Pridgen at March Term 1867 of the Court of Pleas and Quarters sessions of each county that from the best information and knowledge which he has been able to obtain the outstanding debts against the estate amount- ? about one thousand dollars and that he is of the opinion that the charges of administration will amount to about Four hundred dollars and that the value of the personal estate is about nine hundred dollars, and that he has applied the same already in part payment of the debts of the estate.
Your petitioner further showeth that the intestate, at the time of his death was seized in fee simple of the following trade of land situated in said county. The first tract containing four hundred acres and known as the White Oak tract and being the same that was conveyed by deed from J.M. Pridgen in the said intestate dated March 11 1859 this tract he prays your Honor may be sold in nine different lots as your petitioner is of the opinion that by so doing it will bring a better price, and , he prays that it may be left to his discretion as to what size the said lots shall be sold. The second tract containg by estimation ninety nine acres and being the same that was conveyed by deed from John A. Flinn to the said intestator bearing date April 16th 1858. The third tract containing sixty acres and being the same that was conveyed by deed from Arthur Bordeaux, MM Bordeaux and MW Bordeaux to the said intestate bearing date January 31st 1866. The fourth tract, containing fifty acres and being the same that was by deed conveyed by J.B. Gillespie to the said intestate and dated August 23rd 1864. The Fifth tract containing by estimation one hundred and fifty acres and it being the same that was conveyed by deed by Edward S. Hall, Sheriff of New Hanover County to the said intestate and vearing date December 15th 1857. the same tract laying and being in said county beginning at a Pine then runs So 23 degrees west-8 chains, 10 links to a pine. Thence No 83 degrees west , 9 chains to a stake, thence no 22 degrees west 5 1/2 chains to a pine stump thence no. 45 degrees east 2 chains, 26 links to a (Line is unreadable and cut off)) and bearing date December 15th 1857. The sixth tract laying and being in said County begining at a Pine then runs So 23 degrees west-8 chains, 10 links to a pine. Thence No 89 degrees west 9 chains to a stake, thence No 22 degrees west 5 1/2 chains to a pine stump thence No. 45 degrees East 2 chains 26 links to a stake thence to the beginning the same bein conveyed by deed from John M. Pridgen dated March 19th 1859 to John W. Pridgen. The seventh tract lying and being in said county and being a grant from John W. Ellis Governor of state and dated the 26th day of May and in the year of our Lord one thousand eight hundred and fifty nine and for a more particular description of said land reference may be had to the said grant in the hands of the said administrator. Said tract contains twenty six acres that unpon his death the said lands described to the said defendants or his heirs at Law. Your petitioners furth shows that a sale of said land is nescessary in order to pay the debts of said deceased and charges of administrator. To the end therefore that the said land may be sold by your petitioners under a decree of this court- or such terms as may be desisted and that the proceeds of such sale may constitute assets in his hands for the payment of said Debts and charges. And our petitioner demands judgment or the nature of the consequences.
