(636) Gloucester RO Ref 1749/131 In the Name of God Amen I John Oatridge of the town of Berkeley in the County of Gloucester Gentleman being of sound disposing Mind and Memory Blessed be God Minding my latter End and the Uncertainty of the Time thereof Do Make this my last Will and Testament in manner and form following that is to say First I give and Bequeath unto my Brother Simon Oatridge All that my Close of Pasture ground called or known by the name of the Wallott Containing by Estimation One Acre be it more or less And all that other Close of Pasture ground called the Hawlying near Homehill Green Containing by Estimation Five Acres be it more of less And One Acre by Estimation be it more or less of Arable Land lying in a field called Cliff Field together with all Rights Hereditaments and Appurtenances whatsoevr to the said Close and Lands or any part thereof ??? belonging or in any ??? appertaining Which said Close and Lands are situate lying and being in Cowley in the said County of Gloucester and were Devised to me by the Right Honourable James Earl of Berkeley (together with other Lands by his Indenture or Leave under his Hand and Seal bearing the date the ninth day of September 1729 for a Term of Four score and Nineteen Years Determinable on own life and the lives of William Harding and Miles Oatridge the Younger son of my Brother Miles) To hold to the said Simon Oatridge his Executors Administrators and Assignees for and during all the residue and remainder which at my decease shall be to come and unexpired of the said Term determinable as aforesaid He and they Paying therefore the Yearly Rent of Thirty Shillings ??? and made payable for the same in and by the said Indenture of Lease at such Date and Time and in such manner and form as the same therein made payable and likewise Paying from time to time as often as it shall happen One half part of the Money mentioned in the said Leases to be paid for a Herriott And Doing and Performing One half part or contributing from time to time one half of the ??? of the other Duties Charges and Services mentioned and expressed in the said Indenture of Lease on the Tenants or ???? part to be ??? and performed. Item I Give and Bequeath unto William Restall my Nephew All and Singular the Messuage Close Lands Tenements and Hereditaments with their and every of their Rights ??? and Appurtenances specified and contained in one Indenture of Lease made to me by the Right Honourable Augustine Earl of Berkeley bearing date on or about the Twenty Third day of January One thousand seven hundred and Forty One (Except for the several parts of Arable Land mentioned in the said Lease to be lying in a Common Field called Moor Mead Field the half Acre of Arable Land in Upper West Field the Two ??? in the Lower West Field the piece of Land called the Well Springs in Beanhoff Field the Two pieces of Arable or Pasture ground called Sandrye and the Close of Arable Land called P??purland Tyneing all Situate in Coaley aforesaid with their Appurtenances Which said Messuage and premises hereby Given to the said William Restall are now in the tenure and occupation of Richard Shelton and John Weight as Undertenants thereof and are held and enjoyed by me together with the said other Lands under and by ??? of the said last mentioned Save for the remainder of a Term of Ninent Nine years thereby granted thereof Determinate on my Life and the Lives of the said William Restall and Elizabeth Oatridge Daughter of my Said Brother Miles To Hold Except as before Excepted unto the said William Restall his Executors Administrators and Assigns from and immediately after my Decease for and during all the residue and remainder which shall be then to come and unexpired of the said Term of Ninety Nine Years Determinate as aforesaid He and they Paying therefore the Yearly Rent of Thirty SHillings part of the Yearly Rent of Fifty Shillings covered and made payable in and by the said Lease and likewise Paying and Performing from time to time his and their part according to the Proportion aforesaid of the Herriott or Money to be paid in Lieu thereof and all the other Duties Charges and Services contained in the said last mentioned Indenture of Leave on the ??? or ?? part to be paid done and performed And do hereby Direct and annex this further Condition to the respective Estates hereby given to the said Simon Oatridge my Brother and William Restall That each of them or each of their respective .... Indenture of Leave on the Tenants of ??? part to be paid done and performed according to the respective Proportions mentioned and designed by this my Will. Also I Give and Bequeath unto the said William Restall Two Silver Spoons my Second best Bed and Bolster with the Bedstead Curtains and Vallence Pillow and Pillow Case Quilt Two Blankets and a pair of Sheets; likewise Give him the Sum of One hundred pounds in Money at the Expiration of his Apprenticeship. Also I Give and Devise unto Mary Child my Servant provided she be in my Service at the time of my Decease One Annuity or Yearly Rent charge of Six pounds of Lawful Money of Great Britain to be Spring? Going? and Payable Out of those several Closes of Pasture ground called the Soyse? and ???? or lately in Six Closes Containing together by Estimation fifteen Acres be they more or less And also out of All That Close of Pasture grounds called Shepard's Close Containing by Estimation Seven Acres be it more or less all Situate and being in Coaley aforesaid with their and every of their Appurtenance Which said Closes and Lands I lately purchased of the said Right Honourable Augustine Earl of Berkeley for a Term of Ninety Nine Years Determinable on my own Life and the Lives of William Johnson of Barnwood in the said County of Gloucester Esquire and the said Mary Child. The said Annuity or Yearly Rent charge to be had received and taken by the said Mary Child and he Assigns by equal half yearly payments during the Term of her Natural Life without any Deduction or Abatement for Taxes or other matter or cause whatsoever The first Payment thereof to begin and be made on that day Six Months on which my Death shall happen And in case the said Annuity or Yearly Rent charge or any part thereof shall be behind or unpaid by the space of Twenty Days next over or after either of the Days on which the same ought to be paid as aforesaid That then and so often and from time to time it shall and may be lawful to and for the said Mary Child and her Assigns into and upon the said Closes and premises out of which the same is ???? or any part thereof to Enter and Distrain for the same And the Disposal and Disposals then and there found to Take carry away Impound Sell and Manage and Dispose of for Satisfaction of the said Annuity or Yearly Rent charge and Arrears thereof and all Costs and Charges incident thereunto or in cause of Disposal for Rent Arrears is used and ????? And I likewise Give unto her the said Mary Child in case she shall be in my Service at the time of my Decease the Bed she now lyes on with the Bedstead Curtains and Vallence the Bolster Pillow and Pillow Case a Ring Two Blankets and a pair of Sheets Also by Virtue of the ??? or Authority to me given and granted by the said Right Honourable Augustus Earl of Berkeley in and by a certain Copy of Court Roll of the Manor of Coaley aforesaid bearing date on or about the Second Day of May One Thousand Seven Hundred and Thirty Nine I do hereby give and Devise unto the said Miles Oatridge my Brother All and singular the Messuages Closes Lands Tenements and Hereditaments whatesover comprised and mentioned in the said Copy of Court Roll with their and every of their Appurtenances To hold unto my said brother Miles his Executors Administrators and Assignees from and immediately after my Decease for and during the Term of four score Years then for the next ensuing fully to be compleat and ended If he and my said other Brother Simon Oatridge or either of them shall so long Live or the ???? of the Widows of either of them shall according to the Custom of the said Manor of Coaley so long Continue Subject nevertheless to the Rent Herriott Customs Duties and Services on the Tenants part to be therefore paid done and performed. Also I Give And Bequeath unto the said Elizabeth Oatridge Daughter of my said Brother Miles Two Silver Spoons and One Hundred pounds in Money to be paid in Six Months after my Decease Also I Give Devise and Bequeath unto Martha another Daughter of my said Brother Miles Two Silver Spoons And further Give her the Sum of One hundred pounds at her Age of One and Twenty Years And in case she happen to Dye before she arrive at that Age I (signed) Jno Oatridge (end of page 2) (page 3) Give the said Sum of One Hundred pounds to the said Elizabeth Oatridge her sister and the said William Restall equally to be divided between them Also I Give and Bequeath unto my Godson William Harding son of the late Mr John Harding of Cowley aforesaid my Silver Chalice or Tumbler And to my other Godson John son of Richard Williams of Slimbridge aforesaid Yeoman I Give the Sum of five pounds at the Age of One and Twenty Years Also I Give Devise and Bequeath the Sum of five pounds to be distributed and disposed of within One month after my Decease at the Discretion of my Executor herinafter named to amongst such poor Persons and families of the Parish of Cowley aforesiad as my said Executor shall think fit All the rest and residue of my Goods Chattels and Personal Estate whatsoever my Debts and Funeral Expenses being paid and discharged I Give and Bequeath unto my said Brother Miles Oatridge and Make him sole Executor of this my last Will and Testament In Witness whereof I have to this my last Will and Testament contained in Three Sheets of Paper to the first Two thereof Subscribed my Name and hereto set my Hand and Seal the Seventh day of June in the Sixteenth Year oif the reign of King George the Second and in the Year of our Lord One Thousand Seven Hundred and forty three (signed) Jno Oatridge Signed Sealed Published and Declared by the Testator as his last Will and Testament in the presence of us who subscribed our names as Witnesses hereunto in the Sight and presence of the said Testator Thos Nicholas James Nicholas Will Jones Codicil (on foot of third sheet) Whereas I have by my last Will and Testament above written Given unto my Servant Mary Child an Annuity of Six pounds during her Natural Life to be ??? out of the several Close and Lands therein mentioned Now I do hereby Increase the said Annuity to Eight pounds a Year during her Life which I charge upon the same Lands and direct to be paid on the same Condition and in the same manner to all Intents and Purposes as the said Annuity of Six pounds is charged upon and to be paid according to ?? the Meaning of my said above written Will And I do moreover hereby further Give and Bequeath unto my Nephw William Restall in my said will named All and singular my Wearing Apparrel of what Nature or sort soever it be and all such part of my Household furniture as consists of Brass or Pweter and another Bed with the Bedstead Curtains and Vallences Bolster Bed Cloaths and Appurtenances whatsover thereto belonging or in wise appertaining And likewise Give him my siad Nephew And the said Mary Child a Suit of Mourning each And devise that this my be Deemed and Taken as part of my said Will In Witness whereof I have hereunto Set my Hand and Seal the first day of January in the Year of Our Lord One Thousand Seven Hundred and forty four (signed) Jno Oatridge Signed Sealed and Published in the presence of Danl Daynard Simon Gillman Will Jones Further Codicil on a Separate Piece of Paper Whereas I have by my last Will and Testament within written by Virtue of a Licence or Authority to me Given and Granted by the right Honourable Augustine Earl of Berkeley in and by a certain Copy of Court Roll of the Manor of Cowley in the County of Gloucester bearing Date on or about the Second Day of May 1739 Given and Devised All the Messuages Lands Tenements and Hereditaments comprised therein to my Brother Miles Oatridge for the Term of fourscore years commencing at my Death ???? and my Brother Simon Oatridge or either of them shall so long Live or the free??? of either of their Widows shall so long continue Now I do by virtue of such Licence or Authority hereby Give and Devise A peice of Arable Land in Moor Mead field of Cowley aforesaid containing by Estimation Three Acres (be it more or less) adjoining to the Brook?? Leaze on the North east part and to the foot path there on the South west part (being part of the Land granted in and by the said Copy) with its Hereditaments and Appurtenances to my Nephew William Restall in my said Will named his Executors Administrators and Assignees from and immediately after my Decease for the Term of fourscore years thenceforth next ensuing fully to be compleat ???? If they my said Brothers Miles and Simon Oatridge or either of them shall so long live or the free??? of the Widows of either of them shall according to the Custom of the said Manor of Cowley so long continue freed and discharged from the Payment of any part of the Rent and Heriot as said or mentioned in the said Copy on which on the Tenant's or ??? part are or ought to be paid And if he or they should at any time be obliged to Pay any part of this said Rent or Heriots I Give him and them full Power to enter into any of the rest of the Lands compriused in the said Copy and distrain for what he shall have so paid and his Costs and Charges expended about the same and such Disposals from time to time to Manage and Dispose of as in cases of ????? for ?????? and in Arrers and shall be used and accustomed And the ????? and rest of the Closes Lands Tenements and Hereditaments comprised in the said Copy I confirm to my said Brother Miles in the manner the same are given to him by my said Will and I moreover Give to my said Nephew William Restall ????? what is given him by my said Will and the Codicil subscribed thereof my little black Mare my Silver Watch and my Silver Chalice or Tumbler which by my said Will as given to my Godson William Harding since deceased and Direct that the Legacy of One Hundred pounds given him my said Nephew by my said Will at the Expiration of hsi Apprenticeship shall now be paid him in Three Months next after my decease and that the other Bed with the Bedstead Curtains and Vallence Bolster Bed Cloaths and Appurtenances thereto belonging given to him by the said Codicil subscribed to my said Will shall be ???? as my Executor named in my said Will shall choose to give him And I hereby Give my Nephew Miles Oatridge son of my said brother Miles my Silver Tankard and confirm my said Will in all respects in which it is not altered by this and the said other Codicil And Desire that this may be taken and adjudged as part of my said Will and be of equal force with it It Witness whereof I have hereunto set my Hand and Seal the fourth day of July in the Year of our Lord One Thousand Seven Hundred and forty Eight (signed) Jno Oatridge Signed Sealed and Published in the presence of us: Rob Parkinson M G Pindar Will Jones Probate Statement: 22nd Day of July 1749 The within named Miles Oatridge Brother and Sole Executor was duly Sworn before me Thos Clar???
