WMCK1760 Albemarle Co. VA Probate Records of William CLARK (1760-1800) by Linda Sparks Starr JUN 1999 William, born 4 SEP 1760 (per Bible record), was the youngest child of Micajah Clark Sr. and Judith (Adams). He married Judith Woodson CHEADLE (1758-1789), daughter of Thomas, 4 JAN 1782 in Caroline Co. VA. They had four known children; daughter Lucy died prior NOV 1802 for is not mentioned in the will of her Uncle James Clark. William married secondly Elizabeth ALLEN -- dates and location for this marriage not known and no children for them are mentioned in the following records. According to Virginia McNaught, William d. 27 OCT 1800. His orphans are mentioned within the 1802 Campbell Co. will of his brother James [JASCLRK.txt]. As shown by deeds below, his sons were close to his brother Micajah Jr.'s widow and her seond husband, Jacob Oglesby. [See MICAJHJR.txt for particulars.] Transcriptions of the following Albemarle County, VA documents are true to the original copies provided by the courthouse. The clerk often added a final "e" to the surname. Although the "General Index to Wills" says this inventory appraisal is dated 1801, in my opinion the final date is 1807. The plat lines drawn on page 88 bled through to this page so it appears to be written over the plat lines.] That your Commissioners finding it difficult to divide & allot to Mrs. Catherine Clarke relict & widow of Jacob C. Clarke dec'd her dower of sd Jacob C. Clarkes landed estate recommended that James & Micajah Clark pay unto the sd Catherine as relict aforesaid an annual rent in lieu of her dower in land to which proposition all the parties acceded & your Commissioners were requested to fix on what sums that annual rent should be & your Commissioners [?] etrd fix it at the sum of twenty dollars [?] Pominiri to be paid by the said James & Micajah Clark to the sd Catherine Clarke on the 1st day of January in every year during the said life time of said Catherine. Clark estate in the same) between James & Micajah Clarke equally before which division & allotment was effected sd Micajah sold out his interest in the same viz in the five hundred & thirty acres known & designated in the within survey & plat by No. 2 & 3 to James Clarke for which sd Micajah executed his deed of Conveyance to sd James Clarke given under our hands this 20th October 1809. The following plat or division altho made on the 20 October 1809 was not closed & reported till the 20th October 1810. D. J. Minor D. J. Minor Geo: Gilmer James Huckstep [Page 88 is the survey plat of adjacent owners with survey degrees along all sides of the three plats marked No. 1, No. 2 and No. 3. I will attempt to describe the plats, but this will be confusing because I'm not always moving in the same direction as the survey markings which I've enclosed in parenthesis to hopefully lessen confusion.] Plat No. 1 is labeled "Widow's Dower 203 acres". A road runs through it and may mark the southern boundary which isn't specifically shown. Neither is the "mansion house" although a barn is clearly marked within Plat No. 2. Ben. Defor owns the tract to the east; the southwest boundary is a creek labeled only "Branch over the mountain." Harvey/Hurvey is most likely the neighbor to the West and Plat No. 2 -- owned by James Clark -- is to the north. Plat No.2 of 233 acres contains the only structure shown in the three plats. The NW corner is marked by hickory in "Fitches Corner in Hurveys line" and runs in southerly direction (S 37 1/2 E 254 poles) to a "dead pine in Hurvey's line" and then turns east (N 52 E 79 poles) to the pine marker which begins the boundary line between plats No. 1 and No. 2. The line for Plat No. 1 turns south while the line for Plat No. 2 continues (N 52 E 116 poles) to another pine. This one is very important for it is the division marker for the SE corner of Plat No. 2; the NE corner for Plat No. 1 and the SW corner marker for Plat No. 3, forming the border between Plat No. 2 and Plat No. 3. The eastern boundary for Plat No. 2 turns back northwestward here (N 48 W 272 poles) to a pine. The line then turns West (S 4 _ W 93 poles) to the beginning. Plat No. 3 of 297 acres is interesting. Return to the NW corner of Plat No. 2 -- Fitch is property owner to the North; going along his line to the east, (S 4 _ W 93 poles) one comes to a pine which forms the border between Plat No. 2 and No. 3. Fitch's boundary line then jogs NE (S 10 E 19 1/2 poles) forming the NW corner of Plat No. 3. At "Fitch's Corner red oak" the line turns eastward again (S 49 W 155 poles) to "Hickory corner to the sd Robinson." From here Plat No. 3 forms a panhandle shape -- running North by reading (S 38 E 87 poles) to "Red oak Corner to Robinson", then East (S 27 1/2 W 34 poles) to "Merewethers Corner Red oak on the Mountain." Here it turns back south forming the eastern boundary of Plat No. 3 (N 38 W 384 poles) ending at "Defor's & Meriwethers Corner white oak." The line then juts back northwesterly into the plat (S 83 E 46 poles) to a "pine stump". It then turns southwestward (N 30 1/2 E 102 poles) to the shared pine marker for all three plats. Clark dec'd of the other part witness That whereas the said Elizabeth as widow and relict of William Clark dec'd has become indebted to the sd James & Micajah and the said Catherine as widow aforesaid the sum of in ?meuriner and for following (Viz) That after the death of the said William, but before the division of his estate; there was the sum of fell to the said Jacob, James & Micajah Clark as representatives of William & Judith Clark dec'd. who said Judith was a legatee of Cheadle dec'd and whereas the said estate of William Clark dec'd being Somewhat involved the said Jacob C. Clark as guardian to the said James and Micajah and as one of the administrators of the said William deceased applied the money etc arising from the said Cheadles estate to the use and benefit of the said undivided estate of William Clark deceased upon condition to be again refunded upon a division of his said estate. And whereas since the Specifications aforesaid the said Jacob C. Clark has departed this life intestate leaving the above ?ucuied Catherine his widow; and a division of the said William Clark's estate having [? Niath this] day bargained & sold unto the said James, Micajah and Catherine Clark as aforesaid all her right and title to a certain tract or parcel of land situate lying and being in the county of ?Essex both via her own right and in Right of Dower as widow and relict of said William dec'd also all her rights and title to a certain tract or parcel of land sold to George Gilman by the said William Clark in his life time, lying on Mechunk Trunk being an undividied Mority which he held with Chiles Terrell; also all her right and title which she holds in a revertionary in a tract of land which William Clark dec'd, being the tract which Jacob Oglesby holds in rights of his wife during her life and which devolves to the legatees of the said William Clark dec'd at the death of Mildred Oglesby wife of the said Jacob; also all her rights and title to a quarter of and ?nero of Limestone purchased by the said William Clark in his life time of Richard H. Allen, the right and title to all and Singular the aforesaid property the said Elizabeth binds herself to defend clear of the claim or claims of all and every person claims by through or under her unto the said James and Micajah their heirs etc. forever and unto the said Catherine as widow & Relict of the said Jacob C. Clark dec'd during her life, in such proprotion as she would receive as her right of dower in said Jacob C. VA Deed Book 21, pages 100-101, Clark junr Deed to Fagg This Indenture made and entered into this 23rd day of October 1809 between Micajah Clark junr of the County of Albemarle of the one part and John Fagg of said County of the other part witnesseth that the said Clark for and in consideration of the sum of one dollar to him in hand paid hath this day bargained & sold unto the said Fagg all his right and title to a certain tract or parcel of land situate lying & being in the County of Albemarle adjoining Mr. Crenshaw & others it being a tract of land which Jacob Oglesby now holds in possession in right of his wife during her life & at her death to fall to the legatees of Mr. Clark dec'd for farther particulars as to specification of land recourse may be had to a deed entered into this 20th Inst from E. Clark to Jas, Micajah & Catherine Clarks now the true intent & meaning of this deed is that the said Clarke jr conveys to the said Fagg all the right & title which he holds in etc. to the sd land & premises the right and title to _wich_ he agrees to warrant & defend against the claim or claims of all and every person or persons whatsoever In testimony whereof the said Clark hath hereunto set his hand & affixed his seal the day and year aforesaid. VA Deed Book 21, pages 101-103: Oglesby Deed Lease to Fagg & Clark This Indenture made this 23rd day of Dec'r in the year eighteen hundred and seventeen between Mildred Oglesby of the County of Albemarle of the one part and John Fagg and James Clark of the same County of the other part Witnesseth that for and in consideration of the rents, covenants and agreement herein, after reserved and contained and which by and on the parts of the said John Fagg and James Clark their executors administrators and assign are to be paid done and performed she the said Mildred Oglesby hath leased demised granted and to farm let and by the presents doth lease demise grant and to farm let unto the John Fagg and James Clark their executors administrators and assigns all that tract or parcel of land lying and being in the County of Albemarle on the waters of mechunk creek adjoining the lands of James Huckstep senr Elizabeth Clark the said Mildred's reversion in a tract of land of her former husband Jacob Oglesby dec'd, John Rogers and Reubin Lindsay formly containing and 265 acres bounded as follows (Viz) beginning at a stump corner to Reubin Lindsay and running No 40 1/2 E 189 poles to persimmon tree thence S 35 E 46 po to a stump on a branch S 64 E 56 po road continuing down the branch S 81 1/2 E 23 P. S. 27 E 34 P. S. 29 E 89 P S 49 E 16 P from thence S 40 W 178 P road in all 198 poles to pointers corner to Reubin Lindsay from thence 50 W 214 P to the beginning also another tract or parcel of land lying and being in the aforesaid county of Albemarle adjoining the before mentioned tract Elizabeth Clark etc it being her dower in the tract of land belonging to the estate of her last husband Jacob Oglesby dec'd and which has been allotted to her by the commissioners appointed to divide the said estate to have & to hold the said two tracts or parcels of land unto the said John Fagg and James Clark their executors administrators and assigns forever the twenty fifth day of December next ensuing the date here of for and during her the said Mildred's natural life yealding and paying yearly therefor and every year during her the said Mildred's natural life unto the said Mildred Oglesby the yearly rent or sum of sixty dollars lawful money of Virginia on the twenty fifth day of December in each year the above John Fagg paying thirty five dollars and James Clark twenty-five dollars the first payment thereof to commence on the twenty fifth day of December eighteen hundred and eighteen provided always and upon condition nevertheless that if it shall happen that the said yearly rent hereby reserved or either of them or any part of them or other the occasional payments shall be behind and unpaid by the space of days next over or after either of the days of payment whereon the same ought to be paid as aforesaid being lawfully demanded [? these and inowlther of the said cases] it shall and may be lawful for the said Mildred Oglesby her heirs and assigns into the premises hereby leased or any part thereof in the name of the whole to reenter and the same to [? have again and possess con____ and agree her and _____ in form or estate any thing herein ______ contrary] notwithstanding and the said John Fagg and James Clark doth hereby for themselves their heirs executors etc. covenent and agree to and with the sd Mildred Oglesby her heirs or assigns that they the said Fagg and Clark their heirs executor etc shall will and truly pay unto the said Mildred Oglesby her heirs or assigns the said yearly rent of sixty dollars at the days times and place and in such manner as are herein before appointed for payments thereof according to the respective reservations thereof aforementioned and the true intent and meaning of these presents and lastly that it shall and may be lawful for the said John Fagg and James Clark their executors administrators and assigns paying the rent herein reserved and performing the covenants and agreements to herein before mentioned or contained and which one third parts and behalfs are or ought to be paid done and performed peacebly and quietly to have, hold occupy possess and enjoy the said premises hereby leased with the appurtenances during the natural life of the said Mildred Oglesby without any molestation or ?intemeption whatsoever of or by her the said Mildred Oglesby her heirs or assigns or of or by any person or persons lawfully or equitably claiming or to claim from by or under her them or any of theirs.
