Witnesseth that the Said Moses Potter for and in consideration of the Sum of one hundred and Thirty pounds Current money of Virginia to him the said Moses Potter in hand paid by the said Benjamin Potter the Receipt whereof the said Moses Potter doth acknowledge himself fully Satisfied Contented and Paid of Every Part and Parcel thereof doth grant and by these presents Confirm to the Said Benjamin Potter to his heirs and assigns forever one Certain tract or parcel of land in the County of Franklin Lying on the Branches of owens Creek Containing two hundred and forty five acres be the Same more or less and Bounded as followeth to wit. Witnesseth, that the said Benjamin Potter hath and doth for and in consideration of the sum of twenty six pounds seventeen shillings & 10 pence to him in hand paid by the said Benjamin Cook the Receipt whereof is hereby acknowledged, give, grant, bargain and Sell unto the said Benjamin Cook, and to his Heirs and assigns forever all that tract of Land lying in Franklin County on Mountain Creek containing two hundred acres, being the Reserve of the Land the said Benjamin Potter bought of John Cook after laying off a part to Jesse Prunty and bounded as follows, to wit, within the Lines of Reubin S. Brown, John Davis, Jesse Prunty, and William Rigney, with all and Singular the appurtenances thereunto belonging, or in any wise appertaining unto the said Benjamin Cook, and to his Heirs and assigns forever, from him the said Benjamin Potter, his Heirs, etc. and from all other persons whatsoever. Provided always and upon condition that if the said Benjamin Potter, his Heirs, Executors or Administrators shall well and truly pay or cause to be paid unto the said Benjamin Cook, his Heirs, Executors, Administrators or assigns the full and just Sum of Twenty six pounds seventeen shillings and 10 pence on the 25th day of December next ensuing with lawful Interest from this date, together with the Expense of Drawing and Recording this instrument and all incidental charges in finally Settling the same, then and in such case and at all times from thence forth, these Presents, and all the estate herein granted, and every Clause and Sentence herein contained, shall cease, extermine, and be utterly void, to all intents and purposes, any thing herein contained to the contrary notwithstanding.
