This Indenture made this 9th day of April 1860 Between Jefferson Jennings as Commissioner appointed by a decree of the Breckinridge Circuit Court to convey of the first part and Edward Pate of the County of Breckinridge of the Second part. Wheas (sic) at a circuit continued & held for the County aforesaid at the courthouse in Hardinsburg at the July Term 1856 in a certain suit in chancery then pending in said court wherein Samuel C. Pate Jr., George L. Pate, William Clark Pate, John A. Pate, Frank M. Pate, Edward G. Pate, James B. Pate, Ailey Walker & Charles Walker her husband, Charles S. Pate, Eliza Jane Pate & the children & heirs of Julia Phelan dec'd viz. Celest Phelon, Laura Phelen, Sarah Phelon & Richard Phelon the last four infants and Said by Samuel C. Pate their Statutory Guardian were complainants against Samuel C. Pate Jr., Jeremiah Pate, Edward Pate, Eleanor Hambleton & Edward Hambleton her husband, Charles Hambleton & Jane Hambleton, James A. Pate, William Pate, Mason C. Pate, Mary Kincheloe & Richard P. Kincheloe her husband Defendant both complainants & Defendants constituting the heirs at Law of Edward Pate Sr. dec'd & Poindextor Pate was also made a Deft. In said cause the court amongst these things deemed & ordered that Jefferson Jennings should be appointed a commissioner for & on behalf of the heirs of Edward Pate Sr. Dec to convey to the Deft. Edward Pate the tract of 402 acres of Land described in the conveyance bond given by the said Edward Pate Sr. dec'd to the said Edward Pate Jr. & the Survey for had in said land, but before this Deed was executed the Complainant Samuel C. Pate Jr. departed this life intestate, and at the October Term of said Court 1856 said cause was received and ordered to for__ in the names of the heirs of Samuel C. Pate Jr., viz. Clinton Pate, John D. Pate & Henry D. Pate heirs & Dudley Hambleton as admr by reference to the conveyance bond filed dated the 31st day of march 1849 the consideration money for the land was Eighteen Hundred Dollars which has been Settled by said Suit and by references to the survey of the Land fo__ad in said cause said Land lies on the Beech fork of Clover Creek & Bounded as follows: Beginning at a Red Oak now the division corner between this tract and the Land deeded to E. Comstock etc. (unreadable) S15 degrees E 175 poles to a Beech Thence S 75 degrees W 144 poles to a Sugar tree & ash Thence N60 W 242 pole to a white oak Walnut Beech & Dogwood. Thence N 30 degrees E 233 poles to a Beach, Thence up the creek north its several thereof to a Gum on the Bank of said creek Corner on the tract laid off for E. Comstock & wife Thence S 5 E 24 poles to 2 Beeches on the south of a ridge Thence N 66 degrees E 65 poles to the Beginning containing by survey 404 acres. In consideration of the promises here in stated & in discharge of said bond the Said J. Jennings as commissioner hereby for & on behalf of the other heirs of Edward Pate dec'd conveys & confirms to the said Edward Pate his heirs etc. forever the above described tract of Land and the said heirs by the said J. Jennings as commissioner agree to warrent & defend the ditto against all claims whatever as far as estate has descended to them from their ancestor Edward Pate Sr. dec'd but no further, with the appurtenances to the said Edward Pate his heirs, assigns forever. In witness whereof the said Jefferson Jennings as Commissioner of the court appointed to convey has here set his hand & seal the date first mentioned. J.
