Page 277 Monday, April 4th 1853, and 7th day of the Term State of Missouri Vs Manslaughter in the 3rd Degree Allen Wamach Comes now the attorny (sic) prosecuting the pleas of the state in this behalf, and the defendant in his own proper person, and by his attornies (sic) also comes, who being arraigned upon the above indictment for plea thereto saith he is not guilty, and for trial thereof he puts himself upon the County, and the attorny (sic) prosecuting doth the like, and thereupon a jury of the Country (sic) comes; to wit: James Tracy, A Hide, F. B. Miller, Anderson Daugherty, James Woode, William Black, Anderson Cox, Reubin Middleton, William Penick, William K. Richardson, Thomas Tootly [Lootly /ler], and George Nixon, in all twelve good and lawful men, resident of our County of Buchanan, who being elected, tried and sworn, the truth to speak upon the issue joined, after receiving the instructions of the Court do upon their oaths say: “We the jury find the defendant not guilty, as charged in the indictment. Reubin Middleton, Foreman.” It is therefore considered by the Court that said defendant as to the above indictment go hence without day, and recover against said plaintiff his cost.
