      A-170 (A-299): 7 Nov. 1853, T.A.F. Hermann Newbert to James S. Duncan, land on waters of Black Creek, corner of Easlin's and Lane big 5000 acre survey, said Lain's line, including G.W.A. Freytags improvement, including 54 acres, being part of tract sold by Julian F. Scott to J.S. Duncan who sold to me 16 Aug. 1851, "said piece of land I was owing to J.S. Duncan 35 dollars for get and give up hear bag (hereby?) to J.S. TN, $2000, land on Wolf Creek partly in Morgan Co. and partly in Scott Co., adj. south of where Able Peak lived, crossing Geanes Creek Road, corner Scott's entry #1725, including grants #26787 of 10 acres to James Bruten, #26851 of 100 acres to James Bruten, #27730 granted to J.F. Scott entered by Thomas Staples on 26 March 1828 of 100 acres on Woolf Creek and including part of grant #26810 for 5000 acres entered by W. Looper on 27 Jan. 1827, including all lands first described per grant #22342 founded on an entry #1797 made in Morgan Co. on 19 Nov. 1835, excluding any land of superior title owned by citizen of Woolf Creek, excluding part that I the said Scott made good title to, including "residence" of grant #22342, including house and farm on which James Bruten formerly lived, in all 4000 acres (MAD: sic) more or less on both sides Woolf Creek; wit.       A-212 (A-395): This day (no date), James S. Duncan to William J. Scott for $1, 400 acres (MAD: sic), part in 5th Dist. of Morgan Co. and part in 3rd Dist. of Scott Co., about 1/2 mile south of where Able Peak lived, crossing Goose Creek Road, crossing Wolf Creek, corner of Scott's entry #1725, said land entered by Julian F. Scott #1797 on 19 Nov. 1835, and by grant #22342 for 500 acres, excluding any of superior title and that J.F. Scott made title to other persons including house and farm where James Bruton formerly lived, containing by estimation "besides the excluding a few acres", 4000 acres more or less; mortgage; Duncan owes Julian F. Scott $2000 by notes of this date due this 27 Nov. 1854, bearing interest, in order to secure payments I am to pay $1000 in bank at Athens and also to pay $500 in Walden Academy of Morgan Co. and remainder $500 according to agreement between J.F. Scott and Jas. S. Duncan this date, held by me Wm. J. Scott, and said Julian F. Scott is to endorse for said Duncan the renewal of $1000 debt; reg. 28 Nov. 1854.

      MAD: Index does not always match. Deeds do not contain a day, only a month and year; sometimes only a year, sometimes completely undated. This WPA transcript is apparently word for word, in the same format as the original book. Many deeds had sketchy land boundaries, and often no locality for the grantor and grantee. Lewallen, the sheriff returned the writ that no personal property was found, only town lot in Huntsville as property of S. Lewallen and James Duncan where said S. Lewallen lived; Baly Butram then sheriff, Ewell Smith successor sheriff; town lot was sold to highest bidder Thomas Chambers on 3 Sept. 1857 for 5 cents; a writ was received by the sheriff on 5 Jan. 1858, the land was sold on 4 Oct. 1858 to the highest bidder Thomas Chambers for $100 who advanced his bid to $147.37 which was the amount of his judgement and costs; Chambers assigned his bid to said B.W.       C-171: Order to Sheriff, 27 April 1861, out of the goods, "chattars" lands of John Marcum to make $35 to satisfy a judgement and cost that Joshua Duncan obtained against him. (MAD: next document was sheriff's deed, no Duncan mentioned)
