Henry, Sheriff, to Joseph Duncan; that on 17 Oct. 1840 Jesse Kerr for use of David Kerr recovered judgement against William Rich for $36.21 and costs, and execution was issued 21 Oct. 1840, levied on 80 acres on 4 Mile Creek, lot #17, joining lands with Thompson Bryant, James Anderson, and others; to satisfy the debt, made order of sale in favor of Joseph Duncan; also on 29 Oct. 1840 Joseph Duncan recovered judgement against William Rich and Joseph Hampton for $120.95 and costs, levied on 3 tracts of land on 4 Mile Creek, (1) 150 acres where William Rich now lives adj. lines of Jesse Ellmure, J. Steeds and others; (2) 80 acres, lot #17, adj. lines with Thompson Bryant and Joseph Hampton; (3) 40 acres adj. lines with Thompson Bryant and Joseph Hampton; sold at public sale, highest bidder Joseph Duncan, $90 for the 80 acres, $75 for the 150 acres, and $16.38 for the 40 acres, total $133.32, for satisfaction of judgement and costs, and remainder $48.06 applied to satisfaction of judgement in favor of David Kerr on 3 April 1841; (1) 80 acre grant #2953 to William Rich on 15 Feb. 1836 in consideration of entry made in Hiwasee Dist. #2918 on 4 Feb. 1829 by Josiah Phillips as occupant enterer in R5E fractional Twp.1, lot #17; (2) 40 acres being east half of lot 13 transferred to William Rich by David Kerr on 26 March 1833, 80 acre grant by TN to David Kerr per entry #2919 on 4 Feb. 1827 by Landy Pain as occupant enterer assigned to David Kerr, the E 1/2 of lot where the dwelling house of said William Rich stood in 1833; (3) 160 acre entry #2506 made by Abijah Conger as general enterer on 3 March 1826, lot #26 for 160 acres in fract.
