      G-104: 30 July 1808, Richard Sadler, Sheriff, to Margret Duncan, both York Dist. SC; whereas William Tate was in possession of tract of land on Fishing Creek joining land of Jonathan Beatty, Thomas Duncan and others which he claimed as his wifes right of inheritance or dower, and whereas Michael Moore obtained a summary process against William Tate which decree was not executed, and was again served by a Fire Facia in Court of Common Pleas in York Dist., judgment issued, Oct. 1807; (apparently Michael Moore was owed costs "her debt"); land sold at public auction to Margaret Duncan for $3, the highest bidder.       York County Conveyance Book L, pg,102, #177. Recorded Sept 19, 1827. Know all men by these presents that I Mary Pettus of the State of South Carolina York District for the natural love and affection which I have to Rebecca W. Duncan Maddison County Kentucky and Maria Campbell South Carolina Lancaster District & for the further consideration of one dollar to me in hand paid before the Signing and Sealing of these Presents, I give and deliver unto my said two daughters for their own proper use and behoof One negro man named Frank about twenty five years of age--also one bay mare named Doll one gray mare named Kate and one bay mare named Pan which said Property I do hereby warrant and defend unto the above named Rebecca W. and Maria as their legal representatives agains the claim of of myself, Heirs, Executors and so forth and all of every person or persons whatsoever. In presence hereof I hereunto set my hand and seal. Signed Mary (her P mark) Pettus.

            By me, Samuel Givin, one of the justices appointed to keep the peace in and for the District of York. To any lawful officer of the District aforesaid; Wheras Complaint hath been made unto me upon the oath of Patrick Hagin Constable of the District aforesaid that on 24 Sept. 1808 in the execution of his office he was overtakin at the house of Benj. Yarbro by a certain John Duncan of the District Afsd, and the said Duncan did violently refuse a black mare the property of Patrick Duncan which said Constable had levied on. The said John Duncan did also beat and abuse the said Constable with his fist and sticks and stones and put his hand to his great pocket and swore he would take his knife and rip him open. The said Patrick Hagin doth further make oath that he the said John Duncan did intend to take his life and is affeard that he will do it against the peace and dignity of said State. These are in the name of the State to command you forthwith to apprehend the said John Duncan and bring him before me or the next justice of said District to answer the said complaint and be further delt with according to law; 25 Sept. 1808, /s/ Saml.             York Dist. SC, October term 1808 No. 100, State vs. John Duncan, Assault & Escue?, A True Bill. /s/ Wm. Hart, Foreman. State of SC, York District, to wit; at a Court of General Sessions ... of York Dist., on the 4th Monday in October 1808, the jurors of and for the district of York, that is, William Hart foreman, John Powell, John Buts?, James Henry, Joseph Neely, Thomas Clendman, Samuel Hutcheson, Henry Lee, John Neely, Herman Champion, Alexander Jacob Black, James Campbell, Henry Tepping?, William Champion, Mathew Wilson and James Dulan?, upon their solumn affirmations ... present, that on 24 Sept. 1808 in York Courthouse, one Patrick Hagen then being one of the Constables of the said District in due form of law did take in execution a certain black mare of the value of $20 of the goods and chattels of one Pady Duncan to satisfy a certain execution issued by William Clinton Esq. one of the Justices of the Peace of said District on behalf of one Robert Cooper against the said Pady Duncan and that the said Patrick Hagen the said black mare so taken in execution as aforesaid by virtue of the execution aforesaid then and there had and detained in his custody, and the jurors aforesaid on their oaths aforesaid so farther present that John Duncan late of the district & state afsd labourer afterwards to wit on 24 Sept. 1808 in said district, in and upon the said Patrick Hagen, one of the constables, did make an assault upon said Patrick Hagen (etc.).
      Assigned #81, State vs. Patrick Duncan, Assaulting a constable, guilty, Oct. 1808
            To any lawful officer. Personally came before me Patt. Higgins of the District aforesaid and made oath that on the 23d of June as he was executing his office as a Constable he was violently attacted by Pady Duncan of the State and District aforesaid with force and arms and had retaken a Bay Creator from him the said Higgins which the said Higgins had executed and still detains said cretor. The said Higgins do farther make oath that he the said Duncan did give him abuscive language and with force and arms laid hold of him the said Higgins and drin? him the said Higgins an injury in his left arm with the renting of his garments, against the peace and dignity of said State. These in the name of the State to command you to apprehend said Pady Duncan and bring him before me to answer said complaint and be further delt with according to law; 24 June 1808, /s/ Saml. Givin JP.
            Be in remembered that on 1 Oct. 1808, Patrick Dunchen of said District, Daniel Karn and Benjamin Karn of same, personally came before me John Brown, one of the Justices assined to keep the peace, and ack. themselves to owe the State of SC, that is to say, the said Patrick Duncken $100 and said Daniel Karr and Benjamin Karr each $50 separately, to be made and levied of their goods and chattels, lands and tenaments respectively to the use of the said State. If the said Patrick Dunkin shall make default in the condition under within (blank). The condition of this recognizance is such that if the above bounded Patrick Dunkin shall personally appear before the Justices at the next Court of Sessions on 4th Monday of October in 1808, then and there to answer to a bill of indictment to be preferred against him, the said Patrick Dunkin for resquing of property from Patrick Hagen a lawfull officer which he the said Hagen had executed and with doing bodily injury to him the said Haggin, and to do and receive what shall be enjoined by the court and not to depart the cont. without license and in the maintime the said Patrick Dunkin do keep the peace and be of good behavoire towards all the citizens thereof and espesally toward Patrick Haggen then this recognizance to be voide or else to remaine in full force. /s/ Patrick Duncan, David (D) Karr, Benjamin (C) Karr. Taken and acknowledged the day and year above written before me, John Brown, QU.
