PA; that the Supreme Executive Council of PA by patent 15 June 1789 enrolled in Patent Book No.15 pg.729&c granted to David Duncan a tract of land called "Plenty" in Washington "(now Greene)" Co. on North branch of Muddy Creek, adj. lands of Simon Town [alias John Simontown], William Cree and other lands of said D. Duncan, and said David Duncan, since deceased, by his will dated 30 Dec. 1791 recorded in Allegheny Co. in Book 1 pg.57 appointed Margaret Duncan, George Wallace, Edward Cook and Abraham Kirkpatrick the executors of the will and empowered any two of them to sell certain parts of his real and personal estate, of which the tract afsd is a part directed to be sold; now the said George Wallace and Abraham Kirkpatrick, two of the executors empower'd as afsd, for $1253 in specie paid by said Isaac Weaver Junr, sell the tract of land beginning at a stone adj. land of Nathan Keatsly, by land of William Cree and Jacob Hufty, by land of said Hefty and Thomas Simontown, by land of Joseph Gwyne, to the beginning, containing 179 acres, together with improvements, etc., warrant title. /s/ Geo. PA; whereas James Dunlap and Thomas Duncan, surviving admins. of David Duncan decd, lately in County Court of Common Pleas at Pittsburgh for Allegheny Co., at June term 1799, by judgment of the same court recovered against George Wallace, Abraham Kirkpatrick and Margaret Duncan, executors of David Duncan decd, as well as 184 pounds 14 sh. 2 pence of debt, as $28.68, which to the said James Dunlap and Thomas Duncan admin. were adjudged for their costs and charges, and afterwards by Writ of Fieri Facias issued out of the Court of Common Pleas 1 Jan. 1803 to Sheriff of Allegheny County to make out of the goods and chattels, lands and tenements of said David Duncan decd. in the hands of his executors, to cause and levy the debt and costs, before 4th Monday of March next, and by Writ of Testatum Fieri Facias 2 April 1803 to the Sheriff of Greene Co, he was commanded to make out of the ... and lands of said David Duncan decd. in the hands of his executors to levy the debt and costs ... by 4th Monday of June then next ... the Sheriff seized a tract of land of 300 acres more or less on the Monongahela line in Cumberland Twp., Greene Co. adj. lands of Thomas Roach, John Swan, John Rice and lands late of Thomas Scott Esq. with appurtenances, and by writ ... lands were not of a clear yearly value beyond all ?? within 7 years to satisfy the debt, the premises remained in his hands unsold for want of buyers. And afterwards by a second Writ of Venditioni Expenses issued 28 Dec. 1805 to the Sheriff of Greene Co., he should take lands and sell them before 4th Monday at March then next ... after public notice ... sold the same to George Wallace, Abraham Kirkpatrick & Margaret Duncan, Executors of David Duncan decd, for $1,422, they being the highest and best bidders; the term of the said Sheriff expired without having made a deed, the said Abraham Kirkpatrick, one of the surviving executors, the said George Wallace having since died, petitioned the judges to direct the present high sheriff to perfect title and make a deed to said Abraham Kirkpatrick, surviving executor, and Margaret Duncan, surviving executrix of said David Duncan, for said tract of land; Whereupon the court on 14 Aug. last ordered the present High Sheriff of Green Co. to make a deed to Abraham Kirkpatrick and Margaret Duncan; NOW Thomas Mitchell Esq., High Sheriff of Greene Co, for $1,422 paid by Abraham Kirkpatrick and Margaret Duncan, sell ... to said Abraham Kirkpatrick and Margaret Duncan, surviving executor and executrix of David Duncan decd, all the afsd tract of land on the Monongahela River in Greene Co. adj.       3-22/23: 11 Sept. 1813, Abraham Kirkpatrick and Margaret Duncan, surviving executor and executrix of the will of David Duncan late of Allegheny Co. PA deceased, to Thomas McGiffin of Washington Co. in commonwealth afsd, Esq., for $2,000 paid, sell to said Thomas McGiffin a tract of land on the Monongahela River in Greene Co., by land late of Thomas Scott Esq, on the bank of the "Mogahela" River, by land of John Swan, by land of Thomas Roach, containing 300 acres more or less, being the same tract which was granted by patent 15 June 1789 to David Duncan who is since deceased, and being the same tract of land which the Sheriff of Greene Co. upon legal process issued out of Court of Allegheny Co. took in execution and sold as the estate of said deceased, and by Deed Poll dated 7 Sept. 1813 granted and conveyed to said Abraham and Margaret, together with buildings, improvements, ... and appurtenances, warrant title. /s/ A.       4-759/761: Deed Poll, Samuel Harper, High Sheriff of Greene Co. to James Ross. Samuel Harper, Esq., High Sheriff of Co. of Greene, PA, send greeting; whereas Jeremiah Warder and assignees of Christian Werts Senior and Christian Worts Junior lately in County Court of Commonpleas at Greensburgh for Westmoreland Co. before Judges of same Court of January term 1790, by Judgment of the same Court, recovered against George Wallace and Abraham Kirkpatrick executors and Margaret Duncan executrix of David Duncan decd. the sum of 474 pounds 16 shillings and 4 pence lawfull money of PA of debt, as well as sum of 2 pounds 14 shillings and 3 pence which to said Jeremiah Warda and others plaintiffs were "addudged" for their damages which they sustained by occasion of the detention of that debt, and whereas by a Writ of Fieri Facias out of County Court of Commonpleas 23 March 1824 directed, commanded of the lands etc. of said David Duncan decd. in the hands of his afsd executors should be made for the debt and damages which the said Jeremiah Warder and others had recovered against the said George Wallace and others, Executors of said David, and should have the money on the third Monday of June then next ... seized a tract of land on Muddy Creek in Greene Co. in Cumberland Twp. adj. lands of Hugh Barclay, Isaac Weaver, and others containing 500 acres more or less with appurtenances, ... the rents and profits of the tract of land were not sufficient to satisfy the debt and damages within 7 years, the premises remained unsold for want of buyers, and afterwards by a Writ of Alias Testation Venditioni Exponas issued out of the County Court of Commonpleas on 28 June last and to me the said Sheriff directed, I was commanded to sell the land before 4th Monday of Sept. then next ... after public note of time and place of sale, on 26 Aug. exposed the lands to sale and sold to James Ross of Pittsburgh, Allegheny Co., yeoman, for $1200 money of PA, the highest bidder, now Samuel Harper, High Sheriff of Greene Co., for $1200 paid by said James Ross, sell the afsd tract of land containing 500 acres more or less with all buildings, improvements, ... and appurtenances, as fully and for such estate as the said David Duncan decd. had. 26 Aug. 1806, /s/ Saml.       7-628: (typed pages) Power of Attorney, William Duncan & Others to William Duncan. That whereas William Fletcher of Jefferson in Greene Co. PA died intestate leaving no wife nor lawful issue at the time of his death, he was possesed of real and personal property in said county after the payment of which all his legal debts all which property by the laws of PA belongs to his brothers and sisters and their legal heirs, information and proof thereof being made to the Orphans Court of Greene Co. The Court ordered a valuation and equal distribution of the same to his brothers and sisters and in case of the death of any of them, to their children if living. It was made satisfactory to the Court that William Fletcher had five brothers and sisters, viz, Ed'd Fl'r John Fletcher Jane McCulroy, Mary Duncan dec'd and Margaret Hall, now Mrs. Watson. Whereupon the Court ordered the real and personal estate remaining to be divided into five equal shares, one of which according to the laws of PA belongs to the legal living children of Mary Duncan dec'd. NOW we John Duncan, Wm. Duncan, Elizabeth Eakins one of the children of Mary Duncan dec'd and John Eakins her husband & Margaret Duncan near the City of Foranto U.C., all the lawful children of Mary Duncan decd, appoint Wm. Duncan our father our attorney ... to take possession of our division of the real estate of our Uncle Wm. Fletcher in the borough of Jefferson or elsewhere and to sell or rent ... and upon sale, to make a deed. We also impower him to receive from the Admin. our fifth part of the personal estate ... after all legal debts and costs are paid, and also to receive from the legal reps. of our Uncle John Fletcher and Jane McAlroy the equalizing ballances with interest coming to our fifth division of the real estate and receipts and to sign for same in his name as our attorney in fact. We also impower our said Attorney to appoint one or more Attorneys in his stead with full powers ... PA, that whereas William Duncan of York Twp. in home District and province of Uper Canada having been authorized by Power of Attorney to sell certain real estate for the heirs of Mary Duncan which they was entitled to received from the estate of the late William Fletcher decd. in the Borough of Jefferson, consisting in part of 3 lots in the East end of said Borough bounded by Green Street on the North, lands of John Cotterel on the East, Grog Alley on the South and Madien Alley on the West, and said William Duncan appointed his son John Duncan by letter of Attorney 16 April 1838 to sell the above lots of ground, being No.33, 35 and 37 in the original plan of the town, NOW the said John Duncan for $90 paid by John Fletcher, grant, bargain, release and confirm to said John Fletcher the above 3 lots of ground, with appurtenances, and also all the interest of the heirs of said Mary Duncan in law or equity, warrant title. /s/ John Duncan. PA, to sell and dispose and receive the same by law of said state of PA, NOW I the attorney appoint my son John Duncan my attorney to enter and take possession of the three eastern lots of said estate in the town of Jefferson, Greene Co. PA, in case the purchase is not paid, being $100 with interest, and to sell or rent or dispose of same for benefit and sole use of lawful heirs of Mary Duncan decd, and make deed to be given for same in his name as my lawful attorney. PA, for $250 paid, lease the right and privilege of boring and mining for oil, salt water and other minerals in a piece of ground in Dunkard Twp. containing about 5 acres, beg. at mouth of a run in Dunkard Creek, parallel with the old road, down the creek, being part of the John Ross farm, and also the right to put up the necessary buildings &c, and ingress and egress to and from the premises, and the privilege of coal for running the machinery &c for carrying on said business. Parties of second part agree to deliver to Ross 1/5 of all oil, salt, water or other minerals found in the premises to be delivered in the tank. To commence operation before 1 Dec. 1864, the lease for 20 years from date of this indenture. PA, of the one part, and the Mason Oil Co. by their superintendent John N. Mason of Allegheny Co. PA of the other part. WITNESSED that whereas by Article of Agreement dated Aug. 12, 1864, between Bowen Ross of Dunkard Twp, Greene Co. PA, of the one part and the said Duncan "Vandefrift" and Lucas of the other part, the said Ross did grant, lease and devise to said Duncan Vandegrift and Lucas for 20 years from said date a certain part or parcel of his the said Ross land in said township therein described with exclusive privilege to said Lessees of boring, digging for and extracting from said land any oil, salt, salt water or minerals together with the privilege of obtaining and using coal sufficient to work such.
