Order to Clara E. Duncan, John H. Duncan and Paulina Duncan to show cause on 1st day of May term 1867 re petition of Charles E. Duncan, gdn. of Alfred B. Duncan, to sell real estate, /s/ 5 April 1867. "Alfred Bacon Duncan" on another document. Land in Jefferson Co. MS adj. N by lands formerly owned by John H. Duncan, E by lands of John M. Whitney, S by lands of estate of Jno. R. Danden, W by lands of Samuel Hill, containing 146 acres.
         Petition of Chas. E. Duncan, 3 April 1867?, that his infant son Alfred Bacon is seized and possessed of some real estate descended to him by the death of his late sister Belle, petition for letters of guardianship. Answer of Clara E. Duncan, John H. Duncan Jr. and Paulina Duncan to the petition to sell land, that they are the nearest relatives of said Alfred Bacon Duncan ward; they agree to sale; /s/ Chas. E. Duncan, Clara Duncan, John H. Duncan, Paulina A.R. Duncan, July 1, 1867. Petition to sell that part of tract of land inherited by him and conveyed by deed of gift from Dr. John H. Duncan to his grandchild said Belle Duncan, which was conveyed to said J.H. Duncan by Hugh Montgomery trustee &c by deed 29 Dec. 1857. (neighbors given, not copied) Your petitioner, April 3, 1867, says his ward has no brothers or sisters, his nearest relatives are his mother Clara E. Duncan, his grandfather John H. Duncan and his grandmother Paulina Duncan (crossed out "Mabella"); they should appear in court about the sale.

      B-68: Will of Robert Duncan; petition by Mabella J. Wade, that some time in May 1862, Robert Duncan late of said Co. (Jefferson Co. MS) died leaving a will duly signed and wholly in his own handwriting, which petitioner now presents for probate; that the testator made no appointment of an executor in his will; petitioner further shows that Robert Duncan died owning real and personal estate consisting of a tract of land, slaves, and debts due him, estimated at about $15,000; petitioner wants to fulfill his wishes, and asks for letters of administration; she is the sister of the decedent; securities Charles E. Duncan; asks for appointment of Thomas C. West, David Harrison, John T. Davidson, E.H. Hicks and John M. Whitney as appraisers; 1 Sept. 1862. Handwriting proved on oath of Chas. E. Duncan and E.H. Hicks. 1 Sept. 1862.
            Robert Duncan make this my last will & testament, for fear that I may have committed some error in the management of the Chamberlain estate, I give, bequeath & devise all my estate real, personal and mixed, including all debts coming to me, to Pauline Chamberlain, Duncan Chamberlain and Thomas J. Chamberlain, infant children of Thomas J. Chamberlain deceased, and my sister now Mabella J. Wade. Intentionally I have never wronged or deprived them of one cent. The debts due me from my father and Charles E. Duncan I do not wish to be paid until my father John H. Duncan shall die, but the notes are to be renewed so that they shall not be barred by the statute of limitations. The debts which Randolph Duncan and John H. Duncan &c, now in Texas, owe me, I give to them in event of my death. Signed, sealed & published and declared to be my last will & testament this 3 June 1861. In witness whereof I have hereunto set my hand and affixed my seal this 5 June 1861. Robert Duncan.

      Charles E. Duncan, 1 Aug. 1865, and wife Clara E. Duncan, 10 Sept. 1865, of Jefferson Co. MS, they are natives of said state and have always resided therein, and are respectively of the ages of 38 and 22 years. Petitioner Charles E. has always been a plantor and has always been a states rights Democrat in his position and voted with his party in good faith. He has never held or sought office ... or served in the Confederate Army or held arms ... They had relatives and friends in the Confederate Army and in their anxiety and sympathy for them may have said or done something ... each owns property to their sole & separate use, they are unable to assess its value and cannot say whether it is or is not worth $20,000 but think it would not sell for that amount in cash.
