Bailey his deputy, to Joseph Duncan of Shelby Co., that on 3 Oct. 1842 the Circuit Court issued a Writ of Fire Facias in favor of John Ritchey against the estate of John Duncan for $700, the sheriff attached 55 acres of land deeded to John Duncan on Tick Creek by John Ritchey, and it was sold 12 Dec. 1842 to the highest bidder, Joseph Duncan, for $860, bonds given by W.W. Yowell, Elizabeth Yowell, Jefferson Hughes, Jemimah Hughes, Lewis Jones, Sarah Jones, Samuel B. Street, Westley D. Street, John D. Street, Emily Street, Joseph V?. Street, William S Street, Charles N. Street and Anthony G. Street, heirs and legal representatives of John Duncan decd, by Henry Radford Commissioner for that purpose appointed, to Joseph Duncan of Shelby Co. That in a suit in Chancery pending in the Shelby Circuit Court wherein John Richey is complainant and John Duncans heirs are defendants, at the March term 1847 of said Circuit Court, among other things, it was decreed that the heirs & legal representatives of John Duncan decd., before 30 March 1847, pay the complainant the sum of $307.20 with interest from 30 March 1844. On their failure to make payment, the defendants' equity in the land that was mortgaged by John Duncan to the complainant was barred and foreclosed and as much of the property be sold to pay the debt as was needed. That at the March term 1848, the court ordered "The Defendants the heirs of John Duncan having failed to pay the complainants the sums mentioned in the interlocutory decree herein according to the terms of said decree, It is now ordered and decreed that Henry Radford and George W. Johnston Commissioners or either of them do sell the one undivided sixth part of a tract of land on Tick Creek in Shelby County formerly the residence of Nimrod Duncan ..." land sold to highest bidder, Joseph Duncan became the purchaser for $409.81, it being the amount of the debt, interests and costs; the deed conveys an undivided one sixth part of a tract of land in Shelby Co. on Tick Creek on which Nimrod Duncan lived at the time of his death, being the portion of the tract which descended to John Duncan, son of said Nimrod Duncan decd, and to the defendants in said suit on the death of said John Duncan.
