      67-328: 13 Jan. 1847, John and Nancy O'Beirne, and Garnett Duncan and wife Caroline E., to Betsy Shipp; that Garnett and Betsy jointly own the house and land on 7th Street, Louisville, where O'Beirne and wife reside, part of lot 128; that Nancy, reserving life estate, wants to give to Caroline her (Nancy's) interest in estate of Ann E. Irwin decd; that Ann had requested, but not in writing, that part of her (Ann's) estate should be used for the benefit of Betsy and Caroline and Nancy; therefore, in order to permanently provide for Betsy and Nancy, they now set apart the brick house and their interest in the estate of Ann E. Irwin decd, and deed to Betsy the brick house and land on 7th Street and their interest in Ann's estate, except Nancy reserving her life interest in the lot of 26-1/4 feet on 7th Street to which she was entitled before the death of Ann E. Irwin. That Betsy and her heirs hold the estate in trust, paying Nancy $150 a year out of the profits, ... (and if the profits go up, part of the profits to be applied to the debts of Ann E. Irwin). Upon the death of either Betsy or Nancy, it goes to the other together with Caroline E. Duncan; upon the death of the remaining Betsy or Nancy or Caroline E., it goes to the survivor of the three for life. The remainder goes to Garnett Duncan.       76-367: 20 July 1849, James Triplett Duncan and wife Margaret of Floyd Co. IN, of 1st part; and Coleman Lewis Duncan and wife Asenath of Clark Co. IL of 2nd part; and Henry S. Duncan and Charles R. Duncan of 3rd part; Witnesseth, that J.T. Duncan of Floyd Co. IN has heretofore purchased from C.L. Duncan of Clark Co. IL, his one undivided fifth part of the tract of land in Jefferson Co. KY on the Bardstown Turnpike road and on both sides about ten miles from Louisville, 205 acres more or less, being the farm on which their father Charles Duncan lived at time of his death which by will was ordered sold and was purchased for benefit of the five devisees who were to have the proceeds. Further, that C.L. Duncan has never made a deed conveying said interest of 1/5 of the land to James T.; and that James T. for $2500 to be paid at $200 per year without interest until paid, has agreed to sell to Henry S. & Charles R. Duncan two undivided fifth parts of the land, to wit the one fifth he was entitled to under the will and the other fifth which he purchased from C.L. Duncan as said; that in consideration of these premises, the parties of the 1st and 2nd part sell etc. to the parties of the 3rd part, the two undivided fifth parts of the land. /s/ James L.       1-89: In obedience to an order of the County Court of Jefferson Co. appointing Robert Breckenridge, Alexander Pope, Edward Tylor? (dark) and James W. Thornberry or any three, to set apart and assign to Nancy O'Beirne wife of John O'Beirne, formerly Nancy Duncan, her part of the estate of Henry Duncan decd, her former husband, agreeable to his last will and testament and the law, and also to divide the ballance of the estate between Garnett Duncan, Ann E. Duncan, Mary S. Duncan and Henry Duncan and Coleman Duncan, children and heirs of the said Henry Duncan decd, and make a report to court, we Robert Breckenridge, Alexander Pope and Edward Tyler Jr., have discharged the duty in the following manner: In the first place we allotted to Nancy O'Beirne as her third part of the real estate of the said Henry Duncan decd, the following part of half-acre lot in Louisville known as #73, to wit, the whole front of said lot on Main Street and extending the same width 168 feet back with the improvements thereof. Secondly, we then divided the half acre lot in said town #79, as follows: to Garnett Duncan the eastwardly 21 feet front and extending the same width 210 feet back of said lot. To Coleman Duncan, the same quantity of said lot adj. the western line of said Garnett's part. To Ann E. Duncan the same quantity of said lot to adj. the western line of said Coleman. To Mary S. Duncan the same quantity to adj. the western line of said Ann E. Duncan. And to Henry Duncan the balance of said lot. And that they receive the rents and profits of the improvements now erected in said lot jointly as long as they shall remain thereon. Thirdly, we proceeded to divide lot in said town #128 as follows: to Garnett Duncan, 47 feet fron on the eastwardly side adj. 7th Cross Street of the northern end of said lot #128 and extending the same width eastwardly 125 feet. To Coleman Duncan the same quantity to adj. the southern line of said Garnett. To Ann E. Duncan the same to adj. southern line of said Coleman Duncan. We then divided the ballance of said lot into two parts and allotted the western part thereof, being 42 feet front on the north side of and adj. Market Street and extending the same width 70 feet back of said lot, to Henry Duncan, being the corner part of said lot, and the remainder of said lot we allotted to Mary S. Duncan, the remainder or 42 feet fron on the east side of said Cross Street and extending same width back 105 feet of the southern part ... lot #73, not divided, we think it best not to ... (too dark) until Mrs. O'Beirnes dower shall cease and determine from the ballance of said lot but that the same remains until that period the joint property of the heirs herein named. We then allotted to the said Nancy O'Beirne her dower in and to the following negroes produced to us by the said Nancy & Jno. O'Beirne: Nelson about 17 years old, Frank about 10 years old, Isaac about 8 years old, Willis about 18 years old, Sam? about 45 years old and Nurse? about 50 years old as follows: We allot to Nancy O'Beirne the two negroes named Sam and Frank; the remainder we find impractical to divide and therefor have not done anything further.
