      T-288: 1 Nov. 1861, Robert Brown, Stephen Fenwick and Absalem Duncan, commissioners, to Elijah Duncan; that Circuit Court in Henderson Co. on 10 July 1860, in the matter of Petition ex parte in Equity of William Duncan and others, heirs of John Duncan decd, appointed commissioners to make partition and allot lands of said John Duncan decd. among his heirs named in the decree, of whom Elijah C. Duncan is one; and to survey by 1st Monday of Sept. 1860; by Circuit Court 12 June 1861, they were allowed more time to survey, until 24 June 1861; the partition and allotment did set apart to Elijah C.       V-46: 28 Sept. 1866, Emily (X) Duncan, widow of Wm. Duncan decd late of Union Co. KY, to Elizabeth Ann Crawford wife of Andrew Crawford, Elias Duncan, Mary Dixon wife of Thomas Dixon, Martha Caroline Duncan, Margaret Jane Duncan, Thomas J. Duncan and Alice Duncan, children and heirs of said Wm. Duncan decd; that Emily and Wm. had on 26 Sept. 1863 signed an agreement by which she was upon his death to take the property which he had acquired a right to by their marriage and 1/2 of the then growing crop, and she was to relinquish all claim to dower or other interest in his estate, which agreement has by judgement of the Henderson Circuit court in the suit of said Emily Duncan against Bedford Duncan and otherwise been substantially carried out as against the administrator and heirs of said Wm.
