Parsons; that whereas at the September term 1871 of the Circuit Court of Williamson Co. IL, the following order and decree was made, to wit, In the Williamson Co. Circuit Court, September term AD 1871, John S. Parsons vs Rohamer Duncan, Mary Erwin, Sarah White, Thomas Duncan, Edward Duncan, John Duncan, and Azza Duncan; Bill to correct deed Tuesday the 12th day of September AD 1871. And now comes the complt by his solicitors and ... it was ordered that J.B?. Calvert be appointed Guardian ad litum for Edward Duncan, John Duncan, Thomas Duncan and Azza Duncan who are minors under the age of 21, and a rule on said Guardian ad litum and the adult defendants is hereby entered to answer sd. complainanats bill by nine O'clock of tomorrow morning Wednesday the 13th day of September A.D. 1871. And now comes the Guardian ad litum and files his answer herein neither denying nor confessing the facts in complainant's bill but praying that complainant be held to strict proof of the same. The adult defendants fails to comply with said rule and they being three times solemnly called came not nor any one for them but they make default. A judgment by default and a decree pro confessor? entered against them. And this cause coming on for final hearing and the court having carefully examined the evidence and all the exhibits on file and finds that on to-wit: The 26th day of February 1866 one Samuel Duncan was seized in fee of the following real estate, to wit, SW 1/4 NW 1/4 Sec.28 Twp.8S R.2E, 40 A, and for a valuable consideration conveyed the same by warranty deed to the complainant and by mistake the NW SW said Section T&R instead of the said SW 1/4 NW 1/4 Sec.28 T8S R.2E was described and that the said deed was recorded in the Recorders office of Williamson Co. and that on 13 October 1867 the said Samuel Duncan departed this life intestate leaving surviving him said Rohamer Duncan his widow and the other defendants herein as his only children and heirs at law. It is therefore ordered adjudged and decreed by the court that the administratrix of said Samuel Duncan deceased make, execute and deliver to said complainant a good and sufficient deed conveying all right, title and interest ... of said Duncan at his said death in and to the SW 1/4 NW 1/4 Sec.28 T8S R2E and that said deed containing said NW SW said Section, T&Range, is hereby rendered forever null and void.
