Levi Davis, Commissioner appointed, by virtue of a decree in chancery entered in the Circuit Court of the US for the District of IL at June term 1846 wherein the US were complainants and Elizabeth C. Duncan, Mary Louisa Duncan, Ann Elizabeth Duncan, Joseph Duncan, Julia Smith Duncan, Hannah Caldwell Duncan, James M. Duncan, William Brown, Daniel C. Pierson, and William Thomas were defendants; William Thomas was appointed a commissioner to sell the lands and tenements in said decree to pay the money due the complainants, and at the June term 1848 the said Levi Davis was by order of the court appointed a commissioner in the stead of the said William Thomas and was directed to proceed and sell the property which remained unsold, according to the terms thereof, NOW the said Levi Davis Commissioner did proceed to give public notice in the "Illinois State Register" and the "Illinois Journal," two public newspapers printed in City of Springfield, State of IL, and circulated in the counties in which the lands are situated for at least six weeks next proceeding 14 Oct. 1848 as required by terms of said decree; the public notice described the lands to be sold and when and where they would be sold, and terms of sale, and Levi Davis did on 14 Oct. 1848 at the door of the Courthouse in town of Jacksonville, Morgan Co. IL, at 10 oclock a.m. by public auction, exposed to public sale the parcel of land, with appurtenances, Lot No.2 in Block No.9 in Town of Beardstown in Cass Co. C-609/610: No.1842. Whereas at the October 1847 Circuit Court for Cass Co. IL in a case then pending, James Inches plaintiff and Mary Spence and others Respondants, the following decree was made ... this day came complainant by his solicitor and it appearing to the court that Allen Francis Administrator of James Spence deceased has been duly served with process herein more than 10 days before the 1st day of the present term of this court, and due notice was given by publication according to law to the said Mary Spence, Anderson Spence, Alice Spence, Helen M. Spence, Henrietta L. Smith, James D. Spence, Henrietta S. Duncan and James L. Duncan, and the said Mary Spence, Anderson Spence, Alice Spence, Helen M. Spence, Henrietta S. Smith, James D. Smith and Allen Francis being 3 times called, came not but made default, it is ordered the bill be taken pro confesr? as against them "the said last seven named defendants" and Henry B. McClure having been appointed guardian ad litem for the said Henrietta S. Duncan and James L. Duncan filed his answer and says he knows nothing of the allegations of said bill and on behalf of his said wards calls for proof of the same, and the allegations of said bill appearing to the county to be true, it is ordered by the court that Henry E. Dummer, Master in Chancery for County of Cass, executor to the said Complainants, [make] a deed conveying the NW 1/4 SW 1/4 Sec.22 Twp.18N Range 10W and the interest of the said defendants to the said complainants as soon as the complainant shall pay to Allen Francis administrator of said James Spence decd. $42 with interest from 11 March 1844 at 6% and the said Master in Chancery report his actings to the court, NOW in consideration of the payment of $42 with interest, Henry E. Dummer have sold to said James Inchez the NW 1/4 SW 1/4 Sec.22 Twp.18N Range 10W, and all the interest therein of which said James Spence died seized. 14 March 1848. /s/ Henry E. IL, the Court of Chancery made a decree in a cause pending between Mathew St.Clair Clark complainant and Mathew McCreary and others defendant, in a bill filed in Circuit Court of Cass Co. to foreclose a mortgage, the venue of the cause being changed to Sangamon Co. authorizing the commissioner to sell at auction Lot No.2 in Block 9 in Beardstown to satisfy the amount decreed due on the mortgage executed by Mathew McCreary to Mathew St.Clair Clark ... made sale ... after advertising, publishing a notice in public newspaper, real estate to be valued, on 18 Dec. 1841 public sale, Joseph Duncan the highest bidder at $235, and more than 15 months having expired since the sale and the lot not having been redeemed, the party of first part conveys to second part the lot of ground. /s/ Henry E. L-206/207: No.6543. Power of Attorney. That Benjamin Newman and Caroline his wife of Morgan Co. IL on 13 Oct. 1858 executed a deed to Jesse T. Newman and John B. Duncan and conveyed a large amount of real estate to be disposed of, and they were authorized to sell the lands on a credit of one, two, three and four years, and to pay over the proceeds of said sale to such creditors of said Benjamin Newman as are referred to or named in the deed, which deed is a deed of trust and doubts have sprung up in public mind as to validity of said deed ... whereby the sale of said lands has become almost impossible, NOW for the purpose of stripping the deed of trust of every objectionable feature and subjecting the real estate for the payment of debts of said Benjamin Newman, we, Benjamin Newman and Caroline his wife authorize Jesse T. Newman and John B. Duncan to sell all and any of the real estate in said deed of trust immediately for cash and to apply the proceeds of said cash sales as in the deed of trust, and revoke anything in the deed of trust which is inconsistent with terms of this instrument or with selling any of said lands immediately for cash. 12 Nov. 1859. /s/ Benjamin Newman, Caroline Newman.
