      A-11/14: 20 Oct. 1845, Peyton S. Bethell, Sheriff of Dallas Co., to Benjamin S. Duncan and Harris Flanagin of Clark Co. AR, that Samuel Brown, Samuel Robb and William Brown, partners under the firm and stile of Brown, Robb & Co., on 22 Oct. 1839 by judgment of the Circuit Court of Clark Co. recovered against Samuel A. Edmundson for their debt the sum of $9,121.50? ($3,121.50?) and for damages the sum of $468.25 with the sum of $13.39 for their cost, and the said Brown, Robb & Co. on 14 May 1845 sued out of the office of the Clerk of the Clark Circuit Court and execution delivered to the Sheriff of Dallas Co.... directing the Sheriff that out of the goods and chattels lands and tenaments of said Samuel A. Edmondson? to be made the said debt, damages and cost;
        And on 19 July 1845 the said Peyton S. Bethell Sheriff proceeded to levy the execution on the W 1/2 NW 1/4 Sec.8, the W 1/2 SW 1/4 Sec.8, the E 1/2 NW 1/4 Sec.17, and one undivided 1/5 part of the W 1/2 NW 1/4 Sec.17, and the undivided 1/5 part of W 1/4 of SW 1/4 Sec.8, all Twp.8S in Range 18W, and the undivided 1/5 part of fractional Sec.12 in Twp.8S Range 19W, East of the Washita River by going to the said land in the presence of a witness and declaring that he levied on the same.
        And on 19 July 1845 a venditioni exponas issued from the office of the Clerk of the Clark Circuit Court ... directing the Sheriff of Dallas Co. to sell at public sale, which came to the hands of the said Peyton S. Bethell on 25 July 1845, and on 16 Sept. 1845 the said Peyton S. Bethell advertised the land ... and would sell the land at the residence of Presley Watts in said county, it being the temporary seat of justice therein, on first day of October term of Dallas Circuit Court ... and on 20 Oct. 1845, the sheriff proceeded to sell the several tracts of land, and at the sale Benjamin S. Duncan and Harris Flanagan offered to pay $8 for E 1/2 of NW 1/4 of Sec.17 and undivided 1/5 part of W 1/2 of NW 1/4 of Sec.17, and undivided 1/5 part of W 1/2 of SW 1/4 of Sec.8, all Twp.8S Range 18W of 5th principal meridian, and undivided 1/5 part of fractional Sec.12 in Twp.8S in Range 19W of the 5th principal meridian and East of the Washita River, they being the highest bidder and having paid the sum so bid, the last mentioned tracts of land were then and there sold to Benjamin S. Duncan and Harris Flanagin. Now know ye, that I, Peyton S. Bethell as Sheriff ... in consideration of the premises as well as $1, sold to said Benjamin S. Duncan and Harris Flanagin, all those several tracts known as E 1/2 NW 1/4 Sec.17, one undivided 1/5 part of W 1/2 of NW 1/4 of Sec.17, and undivided 1/5 part of W 1/2 of SW 1/4 Sec.8, all Twp.8S Range 18W, and one undivided 1/5 part of fractional Sec.12 in Twp.8S in Range 19W of 5th principal meridian and east of the Washita River. ... warrant title. /s/ Peyton S. Bethell, Shff of Dallas County. Wit. Presley Watts, W.H. Sutton. Peyton S. Bethell appeared before Presley Watts, Clerk of Dallas Circuit Court, 21 Oct. 1845, recorded.
      A-15/17: 20 Oct. 1845, Peyton S. Bethell, Sheriff of Dallas Co., to Benjamin S. Duncan of Clark Co. AR, that William Fellows and Cornelius Fellows recovered before Thomas B. Malone an acting Justice of the Peace for Caddo Twp., Clark Co. AR, by judgment of said justice on 19 May 1838, judgement against George Gordon and Wyatt A. Gordon for $84.81 for their debt and $9.18 damages, and $5.72 costs, and on 28 Nov. 1838 an execution was issued to a constable of said Caddo Twp., who returned the execution saying he could not find any goods or chattels to pay the cost. And afterwards on 18 June 1839, the said William Fellows and Cornelius Fellows filed with the Clerk of the Clark Circuit Court a certified transcript of the judgment, and on 22 Sept. 1845 the Clerk of the Clark Co. Circuit Court directed the Sheriff of Dallas Co. to cause to be made the debt, damages and cost, which came to the hands of the sheriff on 24 Sept. 1845, and on the 26 Sept. 1845 the Sheriff levied execution on E 1/2 SW 1/4 Sec.15 Twp.7S Range 18W containing 80 acres by going on the land in the presence of Henry Strang and declaring that I levied on the same, and on 26 Sept. 1845 the Sheriff advertised the same to be sold on first day of Oct. term of Dallas Circuit Court at residence of Presley Watts, the temporary seat of justice of said county, and on 20 Oct. 1845 the Sheriff offered for sale ... (the land) and Benjamin S. Duncan among other bidders offered $1 and no person bidding or offering more than $1, he being the highest and last bidder, the land was sold to said Benjamin S. Duncan. Now know that I, Peyton S. Bethell, Sheriff of Dallas Co., ... have sold to said Benjamin S. Duncan the E 1/2 SW 1/4 Sec.15 Twp.7S Range 18W, warrant title. /s/ Peyton S. Bethell, Shff of Dallas Co.       A-105/113: 19 Jan. 1847, from Edward M. Harriss as Sheriff of Dallas Co. to Benjamin S. Duncan and Harris Flanagin of Clark Co. AR, the following tracts of land, to wit, fractional SW 1/4 Sec.1, W 1/2 NW 1/4 Sec.1, fractional Sec.2 E of Washita River, all in Twp.8S Range 19W; the SE 1/4 Sec.35 Twp.7S Range 18W; the first of which tracts contains 42 acres and 84/100, the second contained 80 acres, the third containing 353 acres, the fourth containing 160 acres, all in Dallas Co. AR, the first, second and third were patented to Malcolm Gilchrist and were entered and listed for taxation in his name in Clark Co., it being previous to the creation of Dallas Co. in 1841, ... and the fourth was patented to Andrew R. Givan and was entered and listed for taxation in his name in 1841 in Clark Co. ...; and neither the owner nor any other person having paid the state and county taxes which amounted to $4.25 on the first, and $2.77-1/2 on the second, and $11.22 on the third, and $2.77 on the fourth for the year 1841 within the time prescribed by law, and there being no personal property belonging to said Malcolm Gilchrist and Andrew R. Govan ... therefore Willis S. Smith? the then Sheriff of Clark Co. proceeded to sell at auction on Monday 1 Dec. 1841 the tracts of land after publication in the Arkansas Times and Advocate a newspaper published at Little Rock, AR, ... whereupon Benjamin S. Duncan and Harris Flanagin bid and offered to pay the taxes etc. for each of the tracts, ... the tracts were stricken off to the said Benjamin S. Duncan and Harris Flanagin, (paid the money); certificates of purchase given;
        and the following tracts: W 1/2 NW 1/4 Sec.20 Twp.9S Range 17W; W 1/2 Sec.25, NE 1/4 Sec.25, NW 1/4 Sec.36, E 1/2 NW 1/4 Sec.22, the last four being in Twp.7S Range 16W; S frac. 1/2 Sec.20 E of Washita River, NW frac. 1/4 Sec.20 E Washita River, W 1/2 NE 1/4 Sec.20, NW frac. 1/4 Sec.29 E of Washita River, SW 1/4 Sec.29, SE frac. 1/4 Sec.30 E of Washita River, NE 1/4 Sec.29, W 1/4 SE 1/4 Sec.29, each of eight last tracts being in Twp.10S in Range 17W;
          The fifth, ninth, twelvth and twentieth tracts as numbered in this deed each containing 80 acres and the sixth containing 320 acres and the seventh, eighth, fourteenth and sixteenth containing each 160 acres and the tenth containing 212 acres and 69 hundredths and the eleventh containing 128 acres and 45 hundreds and thirteenth of said tracts containing 151 acres and 47 hundredths and the fifteenth containing 125 acres and 5 hundredths.           and the fifth of the tracts "(as mentioned in this deed of conveyance)" was patented to William H. Graham and was entered and listed for taxation in 1842 for the years 1841 and 42 in his name in Clark Co. (the county of Dallas not having been created) ... and the sixth, seventh, eighth and ninth of said tracts were patented to J.M.S. Bodley and entered for taxation in the name of A.B. Reading (who at that time owned said lands) for 1842 in Clark Co. and the tenth, eleventh, twelvth, thirteenth, fourteenth, fifteenth, sixteenth and seventeenth of said tracts were patented to McCoy W. Campbell and entered and listed for taxation in his name in Clark Co. for 1842, and ... taxes not paid, ... $10.18 due on sixth tract, and $7.60 on fifth, and $5.23 on seventh and eighth each, and $2.75 on the ninth, eleventh, thirteenth, fourteenth, fifteenth and sixteenth of the tracts each, and $5.50 on costs? and $1.51 on the twelvth and seventeenth for years for which they were taxed in 1842, there being no personal property belonging to said William H. Graham, A.B. Reading and McCoy W. Campbell, wherefore Willis S. Smith? the then Sheriff of Clark Co. advertised ... sold on 7 Nov. 1842 at public auction, Benjamin S. Duncan, Harris Flanagin and Benjamin L. Brittin bid and offered to pay the taxes ..., receipt of several sums ack. in certificates of purchase given by said Willis S. Smith (Sunth?) the then Sheriff to said Benjamin S. Duncan, Harris Flanagin and Benjamin L. Brittin, and from endorsement on the certificates, Benjamin L. Brittain on 4 Nov. 1843 transferred his interest to each of the tracts to Benjamin S. Duncan and Harris Flanagin;
        and the following tracts: W 1/2 NE 1/4 Sec.3 Twp.9S Range 18W, the E 1/2 NE 1/4 Sec.3 Twp.7S Range 15W, S 1/2 Sec.33 and E 1/2 NE 1/4 Sec.33 in Twp.7S in Range 18W; the E 1/2 NW 1/4 Sec.28, the NW 1/4 Sec.3, the NE 1/4 Sec.9, the last three tracts are in Twp.8S Range 18W; the eighteenth, nineteenth, twenty first and twenty second (as mentioned throughout this deed) contain 80 acres each and the twentieth contains 320 acres and the twenty third and twenty fourth contain 160 acres each, all in Dallas Co. AR; and the eighteenth was patented to James Jones and Thomas Jones and was entered and listed for taxation in their names in Clark Co. (the county of Dallas not then having been created) in 1843 for the years 1838, 1839, 1840, 1841, 1842 and 1843, and the nineteenth tract was patented to Thomas Muskey? (Huskey?) and entered for taxation in the name of E. Pugh Davis (the then owner of said land) in Clark Co. in 1843, and the twentieth, twenty first, twenty second, twenty third and twenty fourth tract were patented to Andrew R. Govan and entered and listed for taxation in name of E. Pugh Davis as trustee for Somerville Land Company in Clark Co. in 1843, ... (taxes not paid) $7.39 on eighteenth, $2.05 on nineteenth and twenty second each, $7.56 on twentieth and twenty first together, and $3.45 on twenty third and twenty fourth each ... (pg.110) (taxes not paid) no personal property belonging to said Thomas Jones, James Jones, E. Pugh Davis or the Somersville Land Company, Willis S. Smith the then Sheriff advertised for sale ... sold 6 Nov. 1843 at public auction, whereupon Benjamin S. Duncan and Harris Flanagin offered to pay the taxes ... certificates of purchase.
        And whereas the following tracts of land: SW 1/4 Sec.29, E 1/2 Sec.29, both in Twp.9S Range 15W, the first 160 acres, the last 320 acres, both in Dallas Co. AR patented to Andrew R. Govan, entered for taxation 1844 in name of Mary A. Pugh "(the then owner of said lands) in Clark Co. (Dallas Co. not having been created), taxes and penalty and cost amounted on the first tract of $3.18-1/2 and on last, $5.66, taxed in 1844, no personal property belonging to said Mary A. Pugh, Sheriff sold at public auction 4 Nov. 1844, taxes not paid, sold by James H. Crow the then Sheriff of Clark Co. AR, published in Washington Telegraph published at Washington in State of AR, Benjamin S. Duncan and Harris Flanagin bid and offered to pay the taxes, penalty and cost ... certificates of purchase given;
        Since the date of the last sale hereinbefore mentioned, that portion of Clark Co. including the several tracts of land hereinbefore described has been stricken from Clark Co. and created into Dallas Co., and 12 months time redemption time has expired, and Benjamin S. Duncan and Harris Flanagin produced to E.M. Harris, Sheriff of Dallas Co., the certificates granted by Willis S. Smith and James H. Crow formerly Sheriffs of Clark Co. for the several tracts of land, and requiring a deed; Now know that I Edward M. Harris, Sheriff of Dallas Co. AR, for $1 and consideration of the premises, have sold to parties of second part the above 26 tracts of land and conveying all the claim of said Malcolm Gilchrist, Andrew R. Govan, William H. Graham, A.B. Reading, McCoy W. Campbell, James Jones and Thomas Jones, E. Pugh Davis, the Somerville Land Co., and Mary A. Pugh. /s/ E.M. Harriss, Sheriff, Dallas Co. Edward M. Harriss Sheriff of Dallas Co. appeared 21 Jan. 1847 before Allison Ramsey, JP, Dallas Co. Certification March 3, 1847, by Presley Watts, Clerk of Circuit Court, Dallas Co. AR, filed for record 21 Jan. 1847, recorded in Record of Deeds &c Book A, pages 105, 106, 107, 108, 109, 110, 111, 112, and 113.

      A-120/123: 27 Feb. 1845, Benj. S. Duncan, Sheriff of Clarke Co. AR, and Assessor and Collector of the taxes thereon and successor of Willis S. Smith, to Ridby Jones of Dallas Co. AR, that the following tracts of land, fractional Sec.9 containing 88 acres and fractional Sec.4 containing 320 acres in Twp.9S Range 18W and W 1/2 SE 1/4 Sec.10 Twp.8S Range 18W containing 80 acres lying now in Dallas Co. but formerly in Clark Co., were among other lands entered, listed and assessed for taxation in the name of E. Pugh Davis as trustee for the Somerville? land company, and neither the owners of the lands nor any other person for them having paid the state and county taxes assessed by law, amounting to $1.20 on the first tract and $4.50 on the second and $1.12-1/2 on the last mentioned tract for the year 1843 within the time prescribed, and there being no other property to levy,
        Therefore Willis S. Smith, the then Sheriff of Clark Co., advertised and gave notice he would sell at auction on 6 Nov. 1843 at the courthouse door in Arkadelphia, Clark Co., the said land or as much as needed for the taxes for 1843, which was published in the Arkansas Times and Advocate published at Little Rock, ... Whereupon Benjamin S. Duncan and Harris Flanagin bid and offered to pay the taxes, penalty, (etc.), and no other person bidding or offering to pay for a less quantity, the same was ... sold ... $2.15 for the first tract, $6.16 for the second, and $2.05 for the last; and from endorsement on the certificates for the land, Ben S. Duncan and Harris Flanagin on 1 Feb. 1845 transferred their title to Ridley Jones, and the time of 12 months to redeem the land having expired, ... Ridley Jones requesting a deed, ... I, Ben S. Duncan, by virtue of authority vested by law and $2.50 for first tract, and $6.16 for second, and $2.05 for third and last, paid to Willis S. Smith the then Sheriff of Clark Co. AR, have sold to Ridley Jones the above tracts of land, will defend title. /s/ Ben S. Duncan, Shff, Clark Co. AR. Wit. Littleton Waldrum, H. Flanagin. He appeared 28 Feb. 1846 before Jno. J. G. Calloway, J.P. Recorded 18 March 1847. (Next Deed recorded A-123 was 17 March 1847, from Edward M. Harriss, Sheriff of Dallas Co. AR, to Ridley Jones of Dallas Co. AR, for tracts of land, not copied.)
      A-181/183: That E.M. Harris Sheriff of Dallas Co. AR as Sheriff on 19 Jan. 1847 made a deed of certain tracts and parcels of land to Benj. S. Duncan and Harriss Flanigin in virtue of their purchasing said lands at sale of lands for nonpayment of taxes &c, the deed was recorded in the Office of the Probate Court in Book A pg.105 to "119" inclusive, and among the lands is a tract described as NW 1/4 Sec.3 Twp.9S Range 18W, the W 1/2 of said 1/4 being inserted in said deed and by same conveyed to afsd Duncan & Flannigin was therein inserted through mistake and error, said Duncan & Flannigin setting up no claim or ownership to same, wherefore this deed of quit claim made this 21 Sept. 1847 between said Benj.       Pg.154: Clark Co. Ithey Nash, editor and proprietor of the Gudon Advocate, a Democratic paper, was born in Anson Co. NC, in 1846, the second of five children, four of whom are still living, born to the union of Jesse J. and Dorothy (Duncan) Nash, natives of NC. The family moved from NC to MS in 1856, locating in Monroe Co., where the mother died in 1856. The father is still living in Monroe Co. at the age of 72 years. ... AR, in 1877 to Clark Co. ... In 1868 he married Miss Annie E. Grissom, a daughter of John M. Grissom, of Itawamba Co. MS, and by this union is the father of 5 children, viz, Ithey Yerger, Lelus McCaulas, Zela Yerger, and Lee Duncan Hubbard and Ledonia Grissom Yerger, twins.       Pg.167: Clark Co. AR. Willis S. Smith, MD, one of most prominent old settlers of AR, born Todd Co. KY near Elkton (then Logan Co.) Aug. 10, 1810, 5th of 12 children, 9 sons & 3 daus, born to Millington and Barbara (Barton) Smith, natives of Edgecombe Co. NC. They were married in Stewart Co. TN and in 1808 moved from TN to Western KY ... Russellville. In 1810, same year subject was born, parents moved back to Stewart Co. where Fort Donelson now is, and in 1817 removed to Johnson Co. IL where he and wife both died, he in 1836 in 76th year, she in 1832 age 52; both Baptist Church. His father, Willis Smith, was Rev. Soldier and killed at Bunker Hill, the son of George Smith native of Ireland who came to America, located in Edgecombe Co. NC where he died. Maternal ancestors of subject were also natives of Ireland. (MAD: nothing more said about Barton family; Barbara was a dau. of James Barton and Mary Duncan; James Barton's will is listed in 1804 in Logan Co. KY; from article about Cardwell B.R.       Pg.168: Clark Co. AR. Judge Isaac W. Smith, Whelen Springs, AR ... born Johnson Co. IL, Jan. 13, 1818, son of Millington and Barbara (Barton) Smith, natives of Edgecombe Co. NC, both dying in IL, he in 1835 in 65th year, she in 1833 in 54th year. Millington Smith was son of Willis Smith, also farmer, and soldier in Rev. War killed in a battle with the Tories in NC, the son of George Smith, native of Ireland. Millington Smith to Stewart Co. TN when a boy with his mother, there grew up and married, in 1817 to IL, 13 children (MAD: named but not copied here).
