THE WILL OF JAMES BARTLETT
Dated June 1, 1822

I James BARTLETT of the County of Henry and State of Kentucky do make this my last Will and Testament this first day of June One thousand eight hundred and twenty two.

First. I have given to Samuel IRELAND who married my daughter Nancy Foster BARTLETT one negro girl Charity one negro boy Tom, and one hundred acres of land, one brown mare, one cow 6 head of sheep, & one bed and furniture.

Second. I have given to John L. FOREE during his life time and his wifes, one tract of land whereon he now lives, one negro girl Hannah one sorrel mare one bed and furniture, one cow and calf, 6 head of sheep, all of which is to return, to be equally divided among my other lawful heirs, provided Polly H. FOREE his wife never has issue or children, should she ever have children or a child to live, then in that case said property is given forever.

Thirdly. I give to William HAYS who married my daughter Susannah BARTLETT one lott (sic) in the Town of New Castle, one negro girl named Esther one mare, one cow and calf one bed and furniture.

Fourthly. I have given to Thomas P. COATES who married my daughter Lucinda BARTLETT, I have given to said COATES one negro girl named Sarah one horse and bed and furniture one cow and calf 6 head of sheep one hundred acres of land.

Fifthly. I have given to David Lawson LUCKETT who married my daughter Huldah BARTLETT during his life time, but not taken to be taken out of his possession, as it is given for the benefit of his wife and children one negro girl Rosa who is since dead, one other negro girl America, one mare, one hundred acres of land one bed and furiture, one cow and calf 6 head of sheep.

Sixthly. I have given to Joseph THOMASSON1 who married my daughter Patsy BARTLETT seventy seven and one half acres of land one negro woman Abba, one horse, one cow and calf six head of sheep one bed and furniture all of the above property given to my children is nearly of and equal value at this, but as to the worth it is hard to come at, as prices vary so much, but at this time I think it worth two thousand five hundred Dollars.

Furthermore, I wish all my unmarried children to have as much as those before given to and in order to acertain (sic) the amount I wish three persons chosen to settle that equal proportion and after those which is now unmarried has their equal parts I wish my loving wife to have all the rest of my estate, real and personal during her life, and after her death I wish it equally divided among my children with the exceptions following given under my hand.

Seventhly. I give to my son James Madison BARTLETT the tract of land whereon I now live, after the death of my loving wife, to go at the same price as the real estate, given to the rest of my children as named above. Given from under my hand

Now as my Daughter Susannah HAYS is dead - I do not intend that her surviving husband William HAYS shall have any more of my estate than he has got and I wish that given to his children, who he had by my daughter. But I do give to John BARTLETT HAYS my Grandson and to Susannah BARTLETT HAYS my Grandaughter to be divided equally between them as much as any of my own children of what is left after those who is not married has as much as the married now have and if either of my Grandchildren John or Susannah should die, leaving no lawful begotten heirs the fruit of their body, then the surviving one shall be entitled to the others proportion, and should both die without issue, that part of my estate which is now intended for them shall be equally divided between my lawful heirs given from under my hand.

Ninethly. I wish all my debts paid and I do appoint Samuel IRELAND my Executor of this my Only and last Will and do impower (sic) my said Exor to sell my Town Lotts (sic) and make deeds for the same [struck through] any lotts of land, to which I am bound to do by any contract I have heretofore made. I would have appointed my dear loving Wife Exix,2 but I know she did not wish it, and it would be puting (sic) trouble upon her, which I do not wish, and one can do the business better than more. Given under my hand the date above Written.

There will be found with this a little stiched (sic) Book which I wish taken as part of my last Will.
