The following Will and Estate Settlement were transcribed by me from LDS Microfilm #0831169 and shared with the Bartlett-L genealogy group on Nov. 23, 1997. Part of my message and notes, in brackets [ ] and in quotes, are also included below. Sandra G. Taylor

"That this is the right William BARTLETT (wife Mary CRANE) is evidenced by the following (deed abstract from Crozier's book of Spotsylvania Co. Records):

Deed Book J, 1774-1782 (Spotsylvania Co., VA)
Augt. 21, 1775. Wm. Bartlett, Jr., and Mary, his wife, of Berkeley Co., VA to Harry Bartlett of same place. 50 pounds curr. 100 a. in Berkeley Par., Spts. Co., devised the sd. Wm. Bartlett by his father, Wm. Bartlett, as will more fully appear by a deed dated Sept 30, 1757, from the sd. Bartlett, Senr. to the sd. Bartlett, junr., etc. Peter Stubblefield, W. Dawson, O. Towles, Larkin Chew. Decr. 21, 1775. [Proves William Bartlett, Jr. and Mary Crane were living in Berkeley Co., VA in 1775. NOTES: William Bartlett, Sr.'s Will was recorded the same day as this deed.]" [sgt]

IN THE NAME OF GOD AMEN I William BARTLETT of the County of Berkeley and Colony of Virginia being of perfect mind and memory thanks be to almighty God for the same do make and ordain this my last Will and Testament and as to what worldly Estate it hath pleased God to bestow on me I give and bequeath as follows Imprimis my will and desire is that the warrants for lands in partnership with M.[?] James M[c]CORMICK and bought of Captain Gabriel THROCKMORTON when properly obtained be equally divided between my four sons Harry[,] John[,] James and Frederick and in case either of my sons should die before they arrive to the age of Twenty one years or without lawful issue that then his or their part be equally divided amongst such as are then living. I likewise give and bequeath to each of my sons Harry John James and Frederick a young mare colt when they arrive to the age of eighteen years to them and their heirs forever.
ITEM I lend unto my loving wife Mary all the rest of my Estate be it of what kind soever [sic] towards paying my just debts and her maintenance and the maintenance of my children during her widowhood or until my youngest child comes of age then the same to be appraised and my wife to receive one third part of the value and the remainder to be equally divided amongst all my children then living and the heirs of such as be dead to them and their heirs forever.
ITEM It is my will and desire that the lease land whereon I now live be not divided together with the part of my Estate that I lend my wife but that my said wife to have the privilege of the said land during her natural life and at her death the same to be sold and the money arising to be equally divided between my two daughters Elizabeth and Nancy to them and their heirs forever.
LASTLY I do hereby constitute and appoint my wife Executrix[,] John CRANE[,] James CRANE[,] my brother Harry BARTLETT and James M[c]CORMICK my whole and sole Executors of this my last Will and Testament revoking all other wills by me heretofore made. IN TESTIMONY whereof I have hereunto subscribed my name and affixed my seal this 4th day of April 1777.

At a Court held for Berkeley County the 18th day of November 1777 this last Will and Testament of William BARTLETT deceased was presented in Court by John CRANE, James CRANE and James M[c]CORMICK the Executors therein named who made oath thereto according to law and the same being proved by the oaths of William THROCKMORTON and Albion THROCKMORTON two of the witnesses thereto and ordered to be recorded and on the motion of the said Executors who entered into Bond with Andrew M[c]CORMICK and Benjamin RANKIN their securities in the penalty of two Thousand pounds conditioned for their true and faithful administration of the said Estate certificate is granted them for obtaining a probate thereof in due form.

An Inventory of the Estate of William BARTLETT, deceased, in Berkeley County:

[A photocopy of this inventory was obtained but not transcribed in its entirety here. It contained the usual household items, i.e., beds and furniture, tables, chests, chairs, powder horn, case with razors and shaving strap, books, pair hillyards?, grid iron, pewter dishes, plates, spoons, tea kettle, hair brushes, saddle bags, loom irons, bellmetal? Skillet, iron pots, hooks, dutch oven, old cards, knives & forks with a box, box iron, flat iron, iron candlestick, looking glass, wine glass, iron ladle, shovel, grubbing hoe, garden hoe, iron wedge, , branding iron, more old hoes, two bells, narrow axe, old iron, plastering trowel, etc., etc. Also included: 1 old white mare and yearling colt, 1 young bay mare, 1 gray filly, 1 old gray mare, 1 sow, 3 pigs, 1 stack hay, 1 "ditto" wheat, a parcel shoemakers tools, jointer & windle bit. Blacks named: 1 Negro woman named Jenny and child named George; 1 Negro girl named Kate; Negro woman named Betty. Total Value: �374.11.6....sgt]

The Legatees of William BARTLETT deceased having made a division of the said Estate are desirous of having it recorded in the County Court of Berkeley the Division stands as followeth N.D.___

Mrs. Mary BARTLETT having been satisfied as to her part which consists of a Negroe Woman named Cate, one Horse, one Feather Bed, Plantation, Utensils and House Hold Furniture Except two Feather beds.

Henry BARTLETT..One Negroe boy named Essuk[?], one Negroe Girl named Eve, one Feather Bed.

John BARTLETT..One Negroe Fellow Named Rick and to pay Henry BARTLETT Ten pounds cash.

Elizabeth BARTLETT..One Negroe Fellow named George and the said Elizabeth to pay Henry DITTO, one of the Legatees, ten Pounds in cash.

Henry Ditto and Ann1 } Three Negroe Children Viz. Jepsy James Jane and Ten Pounds Cash and one
His wife[,] Legatees   }  Feather Bed

James BARTLETT..Two Negroes Named Fanny and Lucey and Ten Pounds cash.

This day came George COTTONHAUS before me a Justice of the peace for said County and made oath that the above division of the Estate William BARTLETT Deceased was in his Presence Executed by and with the of the [sic] Legatees on the Second day of January 1796 and that the Parties appeared satisfied[.] Sworn to this 11th day of April 1796. [Signed] Samuel WELLS J.S.P.

STATE OF KENTUCKY

Jefferson County Sct. I Stephen ORMSBY Clerk of the Court of said County do certify that Samuel WELLS Esquire before whom the within Division appears to have been Proved and whose name is subscribed to the within affidavit or Certificate, was at the time of subscribing the same one of the Justices of the Peace in and for the County aforesaid, and that to all acts by him done while acting in his official character, due Faith and Credence are, and ought to be given. In Testimony Whereof I have hereunto set my hand and affixed the Seal of the County aforesaid this Ninth Day of September 1796 and in the 5th year of our Commonwealth.

At a Court continued and held for Berkeley County the 25th day of October 1796 This Division of the Estate of William BARTLETT deceased was Produced in Court, duly authenticated from the State of Kentucky and ordered to be recorded by the Court.
