Montgomery County

Know all men by these presents that I john Jordan of the County and state afores'd for & in consideration of the sum of one dollar to in hand paid the rec't whereof is hereby acknowledged and for other considerations me hereunto moving have bargained sold and delivered unto Lockey Jordan of the county and State afs'd the following property, viz. one negro man named Gillis about forty years of age, five head of horses, twenty three head of Cattle, thirteen do (ditto) of sheep, thirty do of hogs, six beds and furniture, one dozen chairs, one set of Blacksmiths Tools, one wagon and Gear, all my farming Utensils, all my household & kitchen furniture and one clock which sd property to said Lockey Jordan his Exr's and Adam. is to have and to hold in trust, nevertheless for the securing the payment of the following debts which I the sd Jordan an due and owing to the following person for the following amounts. The first a bed of two hundred and twenty dollars or thereabout due by note to the administrators of Col. John Crump, the second a debt due Duncan McRae by note of thirty eight dollars or thereabout, the third a debt due to Jordan & Sugg for two hundred & thirty dollars or thereabout by note, the fourth a debt of sixty nine dollars due Reuben Allen by note, the fifth a debt of Twelve dollars due Pleasant Simmons and another debt of five dollars due John B. Martin by note which debts above enumerated are all the debts which I owe as principal, if there are any other debts which I have not enumerated above, which I may owe as principal & not as security I desire to secure the payment of them also, and whenever those persons to whom I am indebted as afores'd shall demand the payment of tier respective debts the said Lockey Jordan is hereby required & engages and covenants if it should become necessary to do so to sell the property herein before specified upon such terms as he shall deem advisable and the proceeds of sd sale to apply from time to time as my creditors should require, to the payment of the debts afores'd until the whole amt of my Just debts that I how as principal are satisfied & paid off, if the property herein before Specified should amount to a sum sufficient to pay the same, & the balance if any to pay over to me the sd John Jordan my heirs Exors. & adms. in case I the said John Jordan pay off the sd debts whenever demanded & the sd Lockey Jordan should not be called on to do so, then these presents are null and void. In Testimony whereof we hereunto set our hands and seals this the 14th day of Decem. 1838

State of No Carolina, On this 9th day of March 1839 personally appearedbefore me Richmond Pearson one of the Judges of the Superior Courts of Gnaw & Court of Equity in & for said State John B. Martin who being duly sworn declares that he saw John Jordan and Lockey Jordan sign, seal & deliver the within deed of Trust for the purposes therein mentioned. Let the same be registered.
In testimony whereof I have hereunto set my hand the day & year aforesaid.
