State of North Carolina Montgomery County

In the name of God Amen. I Robert Green of the county of Montgomery and State of North Carolina being in good health and in the exercise of all my mental faculties and being admonished by the accumulation of declining years to make an equitable distribution of every-thing committed to my stewartship by a good providence to those having the best right to succeed me do hereby make and publish this my last will and testament in manner following hereby.

In as much as I have already given more to each of my four oldest daughters Betsy Harris, Oliff Green, Fady McLeod and Nancy Shamwell than I can hope to be able to give each of my younger children it is my will that they never receive any-more of my worldly estate.

It is my will that my beloved wife Polly Green have two negro servants Abram and Hannah, one choice horse, one feather bed and furniture, a sufficiency of cattle, sheep, hogs, provisions and lands in my name and Townsend fork tracts for the use of her family during her lifetime in lieu of her dower and years provisions.

I hereby give my son James F. Green one half of my Townsend-fork tract of land on which he now lives. The other half of said tract to my son Christopher C. Green, and the tract on which I now live and my thickety tract to my son Hartwell A.J. Green subject however to the reservations made for my wife during her life-time.

It is my will that all my negroes be valued by three discreet and disinterested freeholders of said county and as equally divided as possible among Rebecca Munroe, James F. Green, Christopher C. Green, Sally DeBerry, Charity Pool, Nicey Harris, Mary Green, Hartwell A.J. Green and Martha Green, all to be distributed by lot except Sam which I will to James F. Green and Mary to Rebecca Munroe now in their possession at their true valuation.

I will that all the balance of my property be sold on a reasonable credit to the highest bidder the proceeds added to my cash on hand and papers due from other persons at my death and out of the amount all my just debts paid and the balance divided equally among my last named nine youngest children.

At the death of my wife Polly Green it is my will that the negroes and other property left her during her life-time be sold or rightly valued and the amount equally divided among my said nine youngest children.

I hereby appoint and constitute my son James F. Green my true and lawful executor to carry out all the provisions of this my last will and testament revoking and making void all wills made by me heretofore.

In witness whereof I have herewith set my hand and seal on the fifth day of May in the year of our Lord one thousand eight hundred and forty three.

Montgomery County Court July Session 1848 Then the foregoing will was brought into open court and the handwritings of Britton Chappell and Edward McCallum the witnesses thereto was proven by the oath of Martin Rush as also the handwriting of Robert Green the testator by oath of the said Martin Rush and it appearing to the satisfaction of the court that the said Robert Green was of sound and disposing mind and memory at the date of the execution of said last will and testament. It was ordered by the court that the same be recorded.
