To Deed And Nancy A. Hopkins, wife of said H. G. Hopkins

John M. Sanders In consideration of nine hundred and sixty dollars to

-------------------------------------- them paid the receipt whereof is hereby acknowledged do hereby revise release and forever quit claims to the said John M. Sanders his heirs and asigns forever. The following described land part of Survey No. 9942 situate in the county of Union and State of Ohio.

Beginning on the East bank of Rushcreek witness two wilows on the west side of said creek. Thence S 75 degrees W 64 poles to a stake on the East side of the road. Thence S. 68 W 48 poles to a sugar & buckeye sapling thence S. 28 W 15 poles to two beeches thence S 78 degrees W to the original survey line, thence N 12 W with said line 100 poles to two buckeyes thence N71 degrees E to Abraham Kightlinger’s NW corner on the East bank of Rush creek, thence up said creek on the E Bank and with the meanderings thereof to the place of beginning containing one hundred acres of land more or less.

Also eighty five acres in same survey bounded and described as follows. Beginning at a beech tree John Prices NW corner, thence N. 78degrees E 169 poles to an elm and water beech on the E bank of Ruch creek thence down said creek with the meanderings thereof to the place of beginning of the above described piece of land; thence S 75degrees W 64 poles to a stake on the East side of Road., thece S 68 degrees W 48 poles to a shugar (sic) tree and buckeye thence N 27 W 15 poles to two beeches thence S 78 W to the original survey line, thence S 12 degrees E 80 poles to the place of beginning.

Also about thirty seven acres of land situate in Marion and Union counties and bounded and described as follows: bounded on West by the gravel road land owned by J. M. Andrews, Lafayette Harraman and Jonathan Bell, north by Charles White on the east by Leon (Lem?) And Harvey Price, being a three cornered peice (sic).

And all the estate, title and interest of the said H. G. Hopkins and Nancy A. Hopkins either in law or Equity, of, in and to the said premises: together with all the privileges and appurtenances to the same belonging and all the rents, issues and profits thereof; to have and to hold the same to the only proper use of the said John M. Sanders his heirs and asigns forever and the said H. G. Hopkins and Nancy A. Hopkins for theirand their heirs do hereby covenant with John M. Sanders his heirs and asigns that the said premises are free and clear from all incumbrances by, from, through, or under the said grantors and that they will forever warrant and defend the same, with the appurtenances unto the said John M. Sanders his heirs and signs against the lawful claims of all persons claiming by, from, through, or under the granntors heirs.

In witness whereof the said H. G. Hopkins and Nancy A. Hopkins his wife who hereby releases her right and expectancy of dower in the said premises have hereunto set their hands and seals this 27th day of August in the year of our Lord one thousand eight hundred and seventy three.

The state of Kentucky, county of Bourbon, ss.

Be it remembered that on the 27th day of August in the year of our Lord one thousand eight hundred and seventy three before me, the subscriber James M. Hughes Notary Public in and for said county & state personally came H. G. Hopkins & Nancy A. Hopkins his wife the grantors in the foregoing deed, and acknowledged the signing and sealing thereof to be their voluntary act and deed, for the uses and purposes therein mentioned. And the said Nancy A. Hopkins wife of the said H. G. Hopkins being examined by me separate and apart from her said husband, and the contents of said deed being by me made known and explained to her, as the statute directs, declared that she did voluntarily sign, seal and acknowledge the same and that she still satisfied therewith, as her act and deed for the uses and purposes therein mentioned.

In testimony whereof I have hereunto subscribed my name and affixed my official seal, on the day and year aforesaid.

To Jesse Bell of Bowling Green township of said county. You are hereby appointed to appraise on oath the estate and effects of Peter Hopkins late of Marion county, deceased, which may be in said county. When you have perfored that service you will deliver the order and your doings in pursuance thereof to S. R. Sanders, AD. Of said deceased that he may copy and return the same to the Probate court of the county aforesaid. Given under my hand this 25th day of Aug. 1866.

You having been appointed by the Probate Court of said county to take an Inventory and Ppraisal of the personal goods and chattels, whereof Peter Hopkins late of the township of Bowlingreen (sic)died siezed.

Witness; George Gray, Jusge of the Probate Court at Marion, this 20th day of June A. D. One thousand eight hundred and sixty six.

State of Ohio, Marion Co., ss.

S. R. Sanders, Adm. Of the estate of Peter Hopkins deceased, makes solemn oath that he has used due diligence to collect the assets and pay the debts of said Estate, but that ‘there are debts yet unpaid amounting to $625 and perhaps over that sum and that to pay said indebtedness it will be necessary to sell real estate’ that there is but $0000 in my hands applicable to the payment of the debts of the deceased.

Said S. R. Sanders moves the Court for further time of one year "from the 20th day of Dec. 1867" (this written in pen) to "sell real" estate.(this written in pen)

This day personally appeared before me without (premise?prejudice? Can’t read)William Hopkins and entered his appearance here in and requested me to render a judgment against him in favor of the plaintiff for the sum of ninety five dollars and thirty two cents. It is therefore considered by me on said 17th day of May 1858 that said plaintiff recover of said defendant in this action said sum of ninety five dollars and thirty two cents and his costs here in levied at thirty cents.

Sanders on the second day of July 1859 at 1 o’clock p.m. on said day which was returned in due time indorsed served by leaving a copy with the defendant. Service 15 cts. Mileage, 2 miles, 15

(B) Sanders came forward and waived process & entered his appearance herein & confessed a judgment in favor of the plaintiff for the amount of the Transcript aforesaid & the cost herein made which with the interest added amounts to one hundred and five dollars & ninety five cents.

And upon said confession it is considered by me that the Plaintiff obtain a judgment of the Defendant for the afore said sum & the costs of this suit taxed at eighty five cents as follows:

 Document 8.

In Probate Court, Marion County, Ohio, April 12th, 1872

In the matter of final account of Samuel R. Sanders administrator deceased, of Peter Hopkins deceased by John M. Sanders administrator of said Samuel R. Sanders deceased.

This day this matter came on to be heard, and it appearing to the court that notice of the filing of said account has been published for three consecutive weeks prior to this day, in a newspaper printed and of general circulation in this county, and no exceptions, having been filed to said account, and the court having examined the same and the vouchers therewith filed, finds that some of the vouchers are insufficient in law, and should not be allowed: It is therefore ordered by the court, that said administrator furnish sufficient vouchers, by the 24th day of May, 1872 to which time this cause is continued.

And afterwards, to wit; on said 24th day of May 1872 this matter came on to be further heard, and it appearing to the court that said administrator has complied with the above order, and that sufficient vouchers have been furnished; said account is therefore found correct and is allowed by the court. And the court further finds that the whole amount of assets that came to said administrators hands amount to only Fifty five dollrs and wighty six cents; that he has paid out upon claims against said estate and costs of administration the sum of Five hundred and sixty four dollars($564.00) that there is due from the Estate of Peter Hopkins deceased, to the Estate of said Samuel R. Sanders deceased the sume of Five Hundred Eight and 14/100 dollars ($508.14).
