Land Transaction Between
Manly Brown and Thomas McDaniel

Fleming County, KY 1808

This Indenture made this Sixth day October 1806 Between Manly Brown of he County Fleming and state of Kentucky of the one part and Thomas McDaneld of the County of Borbon and state afforesaid of the other part Witnesseth that In and for Consideration of the sum of two hundred & 35 pounds Current money In hand paid to him the Receipt whereof he doth Hereby acknowledge he the sd Manly Brown hath Granted Bargained Sold alined (?) and confirmed unto the said Mcdanel all that tract or parcel of land situated lying and lying [sic] In the county of Fleming found (?) on the waters of Locust Containing one Hundred & forty achers [sic] Be the same more or less Beginning at the sout [sic] west corner at No ss (?) at a Mulbery & Sugar-tree & Running East 200 poles to Hickry & Beach then south 160 pols to a shugar tree thense West 200 pols to a poppawa (? papaw) saplin thence North 160 pols to the Beginning it is at all times to be under stod tahat [sic] is in this Boundry on the south side of Locus Creek & also for the Creek to be the line and also 3 ¼ of an acher to be reducted out for the youse of the Meting House to have and to Hold with all appertananses there to belonging to the said McDanell his heirs or segn (?) shall warrant and Defend the claim and all other clames to the said Mackdaniel his heirs and asigns for ever given under my hand and seal this 6th Day of October 1806.

I George W. Botts Deputy clerk of the court aforesaid (being authorised by Law to receive and admit to record in said office Deeds and other Writings) do certify that the foregoing Indenture of Bargain and sale from Manly Brown to Thomas McDaneld was this day produced before me Acknowledged by the said Manly Brown a party there to and is together with this certificate duly recorded in said office. Given under my hand the 6th day of October 1806.

NOTES:
"At the May term of Fleming Court, 1799, John Hunt and Manley brown were appointed to mark out the bounds for a warehouse in the town of Gath for the inspection of flour and hemp. They finally made their report in July, 1799, stating they had laid off lots 12 and 13 (half-acre lots) for the warehouses--beginning on the bank of the creek. thence down the same 10 rods, then off at right angles 16 rods, for quantity.

"The last mention we can find of Gath in the court records is in July 1811, when John Hunt, Peter Mauzey, and Gunnell Saunders were appointed new trustees."

QUESTIONS:
Was this land that Thomas McDaniel purchased part of the Gath project?

Did Manly Brown "mark out the bounds" of McDaniel's land? Was this the meaning of "alined" above?
