This indenture made the first day of March and in the year of our Lord God one thousand seven hundred and sixty seven between Matthew Small of the county of Amherst of the one part and John Small of the aforsaid county of Amherst of the other part in witnesseth that the said Matthew Small for an in consideration of the sum of 24 pounds current money of Virginia to him in hand paid before the sealing and delivery of these presents the receipt whereof he doth hereby acknowledge and their with to be fully satisfied & paid hath bargened sold aligned enforced and confirm unto this said John Small his heirs & assigns forever one certain tract or parcel of land containing fifty acres formerly laid off from a tract granted to Wm Montgomery and by him sold to John Small and laid off for Matthew Small the said land lying & being in the county of Amherst on a branch of Rockfish and bounded as follows (to witt) beginning at pointers on the top of the mountain and.........snip

This indenture made the seventh day of march in the eighth year of the reign of our sovereign Lord George the third by the grace of God of Great Britain, France and Ireland King defender of the Faith and in the year of our lord Christ MDCCLVIII BETWEEN John Small of the county and Parish of Amherst and John Lyon of the same parish and county of the other part wittnesseth the said John Small for & in consideration of the sum of Fifty three pounds current money of Virginia to hi in hand paid by the said John Lyon and the aforesaid the sealing & delivering of these presents the receipt whereof to the said John Small doth hereby acknowledge to have granted assigned _and confirms unto the said John Lyon two tracks or parcels of land joining together, one being part of a tract formerly bought of Col Chiswell and a part of a tract which was granted to the said Small containing one hundred twenty seven acres land of the said Lyon by Col James Higginbotham his heirs. The other containing Fifty acres being the same whiuch foemerly belonged to matthew Small and whereon William Lyon now lives. The first mentioned tract containing one hundred and twenty seven acres bounded as followith. Beginning at pointers in John Smalls old survey line turning thense new lines north thirty degrees west one hundred poles crossing two branches to a spanidh oak north thirty degrees east at sixty poles to the old survey line eighty four poles to a red oak and north sixty one degrees east one hundred & twenty six poles to pointers in the line of his new survey thense on them south nine degrees south one hundred poles crossing two branches to pointers south eighteen degrees west fifty poles to pointers south sixty nine degrees west fifty two poles to a black oar corner in the old surbey and with the old survey line south forty three degrees west eithty poles to the first station and the other containing fifty acred bounded as followith, beginning at two chestnuts on John Smalls line and with it north forty nine degrees east one hundred fifty seven poles to a red oak in John Chiswells line and with his line south thirty eight degrees east fifty one poles to a red oak thense new lines south forty nine degrees west on hundred & seventy six poles to pointers on the top of a mountain north twenty nine degrees west fifty one poles to the first station with all woods & ways waters and water courses dwellings easments pastures apprentences and the --- the said John Small - to the said land promises or any part thereof to have hold acc- and enjoy the said tracks or parcels of land and promisses and all men singular the premesis hereby granted and sould with their and every of their appertenances unto the said John Lyon his heir and assigns forever the said John Small for himself and his herir the said tracks and parcels of land promises with their apprentenances unto the said John Lyon his heir and assignes against him the said John Smal had his herir the said john Small and his heir shall and will forever warrant and defend the same premesis fron the trouble molestation or invistationm of any person or persons whatsoever as shall lay an just claim or title thereunto as witness my hand and seal the date first above mentionedseals and delivers in presents of us

Justices of Amherst County now siting in the Sum of
L100.0.0 To the payment whereof will & truly to be made
to the said Justices and their Succesfors we bind ourselves &
Each of us our & Each of our Heirs Execuitors & Amdministrators
jointly & Severally firmly by these presents Sealed with our
seals this fifth Day of August in the year of our Lord one
Thousand Seven hundred & Seventy one & in the Eleventh year
of the Reign of our Soveregn Lord George the Second

The Condition of this obligation is such that if the above
bound Ester Small Edward Stephenson & John Pucket
Administrators of all the good Chattles & Credits of James Small
Dec� do make or cause to be made a true & perfect Inventory of all
& Singular the good Chattles & Credits of the said Deceased which
have or shall come to the hand Pofefsion or Knowledge of them the said
Ester Small Edward Stephinson & John Pucket or unto the
hands or Pofsefsion of any other Person or Persons for themselves &
the same so made do Exhibit or cause to be Exhibited into the
County Court of Amherst at such time as they shall be thereunto
required by the said Court and the same goods Chattles & Credits & all
other the goods Chattles and Credits of the said Deceased at the time
of his Death which at any time after shall come to the hand
or pofsefsion of the said Ester Small or into the hand or Pofsefsion

Of any other Person or Persons for her do well & truly administrator
according to law & further do make a just & true account of her
Acting & doings therein when thereto required by this Court & all the
rest & residue of the said goods Chattles & Credits which shall be found
remaining upon the said Admin Account the same being first Examined
& allowed by the Justices of the Court for the time being shall deliver & pay
unto such Person or Persons respectively as this[?] Justices by their order or
Judgement shall direct pursuant to the laws in that Case made & provided
of if it shall hereafter appear that my last will & Testament was made
by the Dec if the Executor or Executors therein named do Exhibit the same
into the said Court making request to have it allowed & appraised accordingly
if the said Ester Small being thereunto required [?] & Deliver
her letters of Administration App[lic?]ation of Such Testament being
had & made in the said Court then this Obligation to be Void & of non
Effect or Else to remain in full force & virtue

33 On motion of Wm Ross who is bound to Alexander Barnett to learn the trade of tailor, it is ordered that Robert Barnet, James Barnet and Thomas Powell Jr. be summoned.

Ester Small plaintiff, vs Lawrence Small, adm of James Small, [Note: This could be a clerk error, Ester Small was adm. Of James Small] by consent of parties all matters in difference between them is referred to the determination of James Nevel, Cornelius Thomas, Francis Meriwether, Alex. Reid Jr. and Alex Reid Sr. gent. And also in all other suits of the said Ester now defending in this court, and their awards to be made the judgement of the court.

64 Ester Small (who as well on behalf of our Soverign Lord the King as for herself in this behalf prosecuter plaintiff) vs Mary Small and John Henderson. Def. In Debt. Case dismissed by award of the arbitrators.

64 William Small pl vs Ester Small, adm of James Small dec'd. A debt was referred, this day returned an award for the plaintiff for specially and costs, crediting 2 pounds. Therefore judgement is granted the pl. agains[t] the said def. For 10 pounds, the debt in the declaration mentioned and costs to be discharged by the payment of three pounds with legal interest thereon from 13th day of Jan [un]til paid and costs. (Margin note clerk fee 252 pounds tobacco, Sheriffs fee 30 pds tobacco.

64 Lawrence Small pl. vs Ester Small def. In Ejectment for one messuage tract or parcel of land containing two hundred acres a dwelling house, and several out houses with their appurtenances, situate, lying and being in the county of Amherst. The parties having mutually submitted the matter in dispute between them to the determination of Francis Meriwether, Alexander Reid and Alexander Reid Junr. Those gentlemen this day returned for the plaintiff agreeable to his declaration therefore is considered of the court that the plaintiff recover against the said defendant his term yet to come and unexpired of and in messuage, tract or parcel of land and premises with the appertenances expended, and the said defendant may be taken [Margin note; clerks fee 132 pds tobacco, sheriffs 30 pds tobacco]
[pNote: Laurence Small evicted Ester Small, widow of James Small, she apparently living on the 200 acres Laurence purchased from John Chiswell]
