The short answer is Yes. I don't know how  probate/estate law of each
Southern State
which could differ from State to State and from time to time. But, I do
know, that in searching for land records for old Berry Family
plantations in the Springfield Georgia,
Effingham County Courthouse records--I found many recordings of Bills of
Sale and recordings of my 5g grandfather's slave purchases. And it
dawned on me that these people-
these human beings were personal property and recorded as were real
estate/land transactions. Of course, under law, they were
"Personalty"--personal property and therefore could be bequeathed by
Will and/or passed on to heirs(of their owners) by operation of
Intestacy.
