Hi all,
In searching for Zeigler/Segler military records I ran into this Petition to the
SC Senate requesting that Shaw Creek, Edgefield Co., SC, be declaired a public
highway. It has the signatures of three Seglers and many others that I hope
will be of interest to you. When and If I ever get my scanner up and running I
will make a copy for those who want one.

ND - 3025 - 01
     NOTICE
It's hereby given that application will be made
to the Legislature at its next session for a
charter to declare Shaw's Creek a public high-
way as far up as to the first Shoals
           Aug 30 [18]33

To the Senate and House of Representatives of
the General Assembly of South Carolina.
The petition of the undersigned inhabitants
of this state residing upon Shaw Creek and its vicinity
Sheweth to your Honorable Body:
That the aforesaid Shaw Creek has its source as
Edgefield District near Edgefield Court House
and runs through a considerable part of the Dis-
tricts of Edgefield and Barnwell to its junction
with South Edisto river near the Pine Log Bridge.
That the county through which the said creek
flows abounds in large and valuable number of
pine and other timber suitable for lumber: that
there are now ten mills upon the said creek besides
other mill seats which would be occupied and engaged
in cutting lumber for market and other persons not
having mill seats but owning tracts oftimber land con-
venient to the creek would engage in carrying xxxxxxxx
timber to market, if the onerous restriction where the
navigation of the stream was removed: that certain
persons now owning mills on said Creek claiming
the legal right-to- obstruct the navigation of the
stream in any manor they may choose to do so
take advantage of their supposed rights to extort xxxx
an oppresive toll from the mill owners above them
in every case when such mill owners desire to pass
with their lumber to market: If these persons who have
mills have a right to demand toll from all who wish
to pass, they have an equal right to prevent all passing
and if to obstruct a stream by dam for milling
purposes given the right to prevent all above from passing:
Your petitioners submit to your Honorable Body, that the
right-to-obstruct by barriers or other means may be claim-
ed and exercised by all persons owning land upon
the stream, so as to extract tribute or toll from, or
wholly prevent the use of or to and exclude from
market all persons above then.
We your petitioners therefore feeling the claim
and extraction of certain mill owners on said
stream to be highly xxxx and unjust humbly
pray your Honorable Body to grant them relief
by declaring Shaw Creek a public highway, from
its mouth to the first shoal at or near
Rhodes Mill or such a way as to your Honorable
Body may seem meet and proper.
And your Petitioners will ever pray be:
