ESTATE OF THOMAS J. HICKSON

South Carolina Sumter District: In the name of God Amen.  I Thomas J. Hickson of the State and District aforesaid being feeble in health and of sound and disposing mind and memory do make and publish this my last Will and Testament.  I will and dispose that my body be interned in a decent and christian like manner

Item 1st    I will and bequeath to my beloved wife Elizabeth Hickson all my estate both real and personal for her use and benefit during her natural lifetime in widowhood and at her death or marriage for my said estate to be equally divided amongst my five children viz: Mary Elizabeth, Wm, Lewis Thomas, Henry, and Alexander to share and share alike.  But in the event of the death of my said children before attaining to the age of twenty-one years, leaving no heirs then their portins of my said estae to be equally divided amongst my said surviving children.  But if either of my said children shall marry or attain to the age of twenty-one year then they are to receive their portion of my said estate.

Item 2nd    I request that my executors which are to be herein after named shall keep up my plantation and manage my holdings to the best of their judgement and app______ into the proceeds thereof to the use and benefit of my wife and children as above named.  
And third and lastly I do hereby appoint my esteemed friends Iames Lowry and Cyrus a. Rupert my executors to this my last will and Testament

Codicil  I will and bequeath to my afflicted son Thomas as his proportion of my said estate my Negro woman Fan. and her three children viz: Jummy, Amelia, and Washington and their future increase and in the event of his death they the said Negros to return to my estate and be equally divided amongst my said remaining children as above named.

TO WILLIAM LEWIS ORDINARY FOR SUMTER DISTRICT
The Petition of Elizabeth Hickson and James Lowry sheweth that Thomas J. Hickson departed this life on the 11th day of September 1846 intestate leaving a personal estate worth about four thousand dollars in Sumter District aforesaid and no person having as yet made application for administration on the said Estate, nor (in the opinion of your petitioner) will any such application be made.
In Order therefore, that the property belonging to said Estate may be taken care of and administered, converted and disposed of according to your Petitioner prays that the administration of all singular the Goods and Chattles, Rights, and Credits of the said Thomas J. Hickson deceased, my be granted to them and your Petitioner will ever pray, &c.
