An excellent response which demonstrates well the point we were discussing.  You
explained how sometimes public domain material can be used as the basis for a
new work of authorship.  My thinking is that what you describe does constitute a
copyrightable work based on public domain material.  I also think anyone who has
access to the original 1880's material could use it freely regardless of your
new copyrightable work.  But, they could not include your new annotations,
editing, arrangements, etc., without permission.

shared!
