Fauquier County, Virginia Will Book 28, page 399. Will of Berkeley Ward, dated 1 November 1840; proved 28 May 1860. I, Berkeley Ward of the County of Fauquier do hereby make and ordain this to be my last will and Testament I give and bequeath to my dear wife Harriet Ward all my estate both real & personal during her natural life with full power and authority to sell and dispose of any part of the same either real or personal at any time that she may think will be for the advantage and benefit of my children. At the death of my dear wife my will is that my Estate may be equally divided among all my dear children who may be living at their mother's death and the representatives of such as may be decd at that time and I authorize and empower my said wife to settle in any way which she may think proper the property of any of my children on them in such a way as will secure it to them and their children. In witness whereof I have hereunto set my hand & seal this first day of November 1840. B. Ward I hereby appoint my wife Harriet Ward and my Brothers-in-law Andrew Fitzhugh & David Fitzhugh Executrix and Exers of this my will with a request that they may be permitted to qualify without giving security. B. Ward Fauquier County Court May 28th 1860 This paper writing purporting to be the last will and testament of Berkely Ward deceased was this day produced to the court and William H. Payne and Jno. S. Byrne were sworn and severally deposed that they were well acquainted with the testators hand writing and verily believe the said writing and the signature thereto to be wholly written by the testators own hand whereupon said paper writing is ordered to be recorded as and for the true last will and testament of the said Berkely Ward deceased. Andrew Fitzhugh one of the executors named in said will having departed this life and David Fitzhugh the other executor named Therein by his note in writing addressed to the court renounced the burden of the Execution thereof. Harriet Ward the Executrix named therein thereupon qualified and gave bond without security - the testator having requested by his will that none should be required of her. Teste Wm. A. Jennings C.C.
