First Generation
1. John McCarley was born in 1754 in Poss. York County, PA and died on 17 May 1814 in Gallia County, Ohio.
General Notes:John McCarley came to Gallia County, Ohio in 1806, probably from York County, Pennsylvania, via West Virginia. He took patent deed to the west half of section 13, Racoon Township in Febuary 1806, later adding the northeast quarter section 23, Racoon Township John died May 17, 1814 at age 60. Among his chattels were three Bibles, and a pot-still.
John, his son William with wife Rachel Totten and his grandson John have been accepted as First Families of Gallia County, Ohio by the Gallia County Genealogical Society. Certificate in the possession of Ruth Hall.

In the Name of God, Amen
I, John McCarly, of the County of Gallia and State of Ohio, considering the uncertainty of this mortal life and being of sound mind and memory, Blessed be Almighty God for the same, do make and publish this my Last will and Testament in manner and form following that is today. Further, after all my just debts and funeral expenses be paid. Further, I give and bequeath to my three Daughters, Elizabeth, Margaret and Zebiah fifty pounds each including that which they have heretofore received and also I give and bequeath unto my eldest son, William, all the Lands belonging to me on the South Side of Dryrun up on Indian Creek quarter section also twenty acres adjoining the same off Dryrun quarter section. Also all the Land that belongs to me on the East of Racccoon Creek below the mouth of Dryrun. to him, the said William, his heirs and assigns for ever.
Also, I give and bequeath unto my son, John, my mills and Dutch Fan and all the Lands that belong to me on the East side of Raccoon Creek above the mouth of the aforesaid Dryrun with one acre remind, the west end of the mill dam by him, the said John, paying four hundred dollars in annual payments, one hundred dollars per year which money to go towards paying up my three daughters their legacies. This I give to the said John, his heirs and assigns forever.
The remainder of my estate, real and personal, I wish to be equally divided between my two youngest sons, Samuel and Moses, to them, their heirs and assigns for ever. If either of my two sons mentioned, youngest sons, should decease without leaving lawful heirs, his part to return to the surviving one.
Also, I hereby appoint John McCarley, Joseph W. Rose and John Cherington executors of this my Last Will and Testament, hereby revoking all former wills by me made.
In witness whereof, I have hereunto set my Hand and seal this twenty sixth day of September, One thousand Eight Hundred and Fourteen.

The State of Ohio Gallia County * Be it remembered that at a court of common Pleas within and for the said county of
Gallia held at the court house in the town of Gallipolis on the twentieth day of June in the year of our Lord one thousand
eight hundred and fifty one before the Honorable William V Peck President Judge and Moses R. Matthews, Franklin Carel
and Robert Carter associate Judge
This day the last will and testament of Moses McCarley late of this county deceased was brought before the court and was
proved by the oaths of A. W. Warner and Oran McCarley the two subscribing witness thereto, whose examinations were
ordered to writing, and is appearing to the court that the said Moses McCarley at the time of executing said will was of full
age and of sound mind and memory and not under any restraint, it is ordered that this said will and the proof so * to writing
be recorded. And thereupon on motion of Sarah McCarley. the executrix in said will named. it is ordered that letters
testamentary * one to her, who then upon gave bond to the acceptance of * court with Wm. Wauach H. H. Jones and D
Porter her * in penalty of one thousand dollars, conditioned according to law. * that J L Newsom, William Ridgeway and
Jos. Nelson after being duly sworn appraise the personal estate of said deceased. Which said last will and testament and the
proof so reduced to writing.
In the name of God, Amen. I Moses McCarley of the Township of Raccoon Gallia County Ohio. Being of sound mind and
memory but of feeble health and considering the short and uncertainty of this mortal life do make and publish this my last will
and testament in manner and form following. That is to say that after all my just debts are fully paid and the expenses of my
funeral together with the expenses of surveying my estate are satisfied. I give and bequeath to my beloved and affections
wife Sarah McCarley all my personal and real estate of every kind and names of which I am * for her use and benefit during
the term of her natural life. With the following exceptions, That if my wife Sarah McCarley shall live until my two sons
Samuel E. B. McCarley and Hiram L. McCarley shall each become of the age of twenty-one years. Then and in that case it
is my will that upon their arrival at the age of twenty-one years respectively they shall have fifty acres of land each. said fifty
acres of land to be selected in such manner as can be agreed upon by them and their Mother at such time as they shall each
become of the age of twenty-one years.
And further it is my will that my daughters Mary Jane Gouch, Martha N. Warner and Elizabeth Wolfe shall each receive of
my estate the sum of three hundred dollars to be paid in the following manner That is my wife Sarah McCarley shall be able
to pay out of my personal estate the last named sums without inconvience on her part. She shall do so but if the last named
sums or any part thereof shall remain unpaid at the death of my wife Sarah McCarley the part so remaining unpaid shall be
paid by my two sons Samuel E. B. and Hiram L. in equal proportions. I give and bequeath to my youngest daughters
Sophronia and Adaline McCarley the sum of three hundred and sixty dollars to be paid in the same way as is provided for
the payment of the several sums named in my last bequest to my three elder daughters.
And I further give and bequeath to my to sons Samuel E. B. McCarley and Hiram L. McCarley the farm on which I now
reside containing two hundred and thirty-two acres more or less to be divided equally between them and to come into their
* at the death of my wife Sarah McCarley. As before mentioned it is my will that my two sons Samuel E.B. McCarley shall
each receive fifty acres of land in the event of their becoming of the age of twenty-one years before the death of my wife
Sarah McCarley but they shall not have the power to sell or in way dispose of the same during the life time of my wife Sarah
McCarley.
And lastly I do hereby appoint Sarah McCarley my wife the sole executrix of this my last will and testament.

General Notes:John McCarley was a resident of Jackson County and Nancy Boggs was a resident of Perry Township Gallia County at the time of their marriage on April 28, 1833. They were married by James Williams JP. Witnesses were Thomas Hannon and Sally Hunter. John McCarley is buried in the McCarley cemetary in Walnut Township,Gallia County,Ohio. The cemetary is located in Section 8 on the north side of Hollow Rd. abt 1/2 mile from State Route 141. It is up a farm lane and badly neglected but James Myers and Joe Stewert did their best. Mr. Stewert once owned the farm. He said at that time there were 20 or so graves marked there. In 1980 they read what was there and found:McCarley, John died 25 Dec. 1884 Age 73yr 2m 8d.
