   Will and testament in the name of God Amen.  I Daniel Gartman of said state  and county being of advanced age and knowing that it is appointed for all men to die and being perfectly sound in mind do this eleventh day of May in the year of our lord one thousand eight hundred and forty two dispose of my earthly affairs in manner & form following. And I do hereby make and declare this to be my last will and testament.

  (Item first) I desire and direct that all my just debts be paid without delay by my executors, hereinafter named as I am unwilling my creditors should be delayed of their rights especially as there is no necessity for delay.

 (item second) I give and devise to my beloved wife Sarah Gartman a Negro boy by the name of Bob for & during her natural life & after her death the said Negro boy to go to & become the property of my daughter Katherine, now the wife of Elija Pickren & her children by her present or any future husband free from the deposition of her present or any future husband provided nevertheless that the said Negro boy Bob shall remain & be kept in the county of Telfair & if he should be removed from said county at any time by the discretion or consent of my wife, Sarah Gartman or by the discretion of any future husband which she may hereafter have then the aforesaid Negro to go to & become immediately on any attempt to remove

said boy to my daughter, Katharine Pickren now the wife of Elija Pickren  and her heirs. I also give to my wife, Sarah Gartman all that part of my stock of cattle and sheep kept at John Douglass in said county of Telfair.

(Item third) I give to my daughter Elizabeth Brickell now the wife of Henry Brickell a lot of land in the seventh (7th) district of the third (3) section in the county of Cherokee, known by the number two hundred and ten (210) containing one hundred and sixty acres with all the rights, members_?,  & appertances to said lot of land in any wise appurtaining as belonging free from all charges or limitations whatever to her own proper use benefit & behalf forever with full ???  to dispose of the same at any time before or at her death as she may think proper also give to said daughter Elizabeth in the same unreserved manner fifty dollars in money_(or?)____ cows and calves just as she may chose which I consider to be her full share of my estate? together with what she has already received, To wit: in the year 1834 one bed and furniture (feather mattress  I saw somewhere before)one mare and colt fifty head
of stock cattle, two hundred and eighty dollars in cash.

(Item  fourth) I give and devise to my wife Sarah Gartman for and during her natural life a lot of land # 376 in the first distr  of originally Appling, now Telfair Co also  improved land in the south corner of former Appling co. containing about fifteen acres and after her death the said property to go to and become the property of my son Benjamin Gartman(583) with all the rights

members? and appertances to said lot of land in any wise appertaining or belonging. I also devise to my wife
Sarah my negro man London and his wife Silva without reserve or limitation to dispose of them as she may think proper.

(item fifth) I give and divise to my son Benjamin Gartman a Negro man Dave and his wife Molly, a Negro man by the name of Jack and a Negro girl Isabel also all of my stock of cattle and sheep which are kept at Wiley Hargraves in said county also the following parcels Of land to wit: Lot # 38_ , three hundred and eighty one and four hundred (400) all lying in the first (1st) district of originally Appling, now Telfair Co. with all the rights, members(?) and appertances to said lots of land in any wise belonging free from all charges(?) or limitations whatever without  any reserve or limitation, to his own proper use, benefit and behalf forever.

(Item sixth)
I devise and bequeath to my daughter Katherine Pickren, wife of Elija Pickren and her children by her present or any future husband free from the disposition of her present or any future husband, my Negro girl M______. I also give to my said daughter Katherine Pickren all that part of my stock of cattle and sheep which are kept on my plantation which I now reside.

(item seventh) All the balance of my estate whether real or personal I enjoin on my executors to equally divide between my wife Sarah Gartman, my daughter Katherine Pickren, wife of Elija Pickren share and share alike.

(Item eighth) I do hereby make constitute and appoint Stephan Hubbard, Joseph Hubbard, and Cornelius Ashley all of the county of Telfair and state aforesaid my Executors to this my last will and to see that it be carried into effect according to the true intent and meaning thereof in witness I have hereunto set my hand and affixed my seal the day and year above written.
