Lott of the New Lotts, in the township of Flatbush in Kings County in the State of New York, Farmer, of the one part, and Hendrick J. Lott and Stephen Lott, Executors of the last will and testament of Christopher Lott late of the New Lotts aforesaid deceased, of the other part. Witnesseth that whereas the said Johannes J. Lott and the said Christopher Lott deceased in the life time of the said Christopher Lott, were seized in fee simple, and held as tenants in common in equal shares all that certain mepuage(?) dwelling-house, barn, farm and plantation tract or parcel of land situate lying and being in the New Lotts in the township of Flatbush aforesaid, bounded as follows, Southerly by the highway that leads from Flatbush to Jamaica along the south side of the New Lotts, Westerly by land of Nicholas Williamson Northerly by the road or highway that leads from Flatbush to Jamaica along the north side of the New Lotts and Easterly by land of Isaac J. Snediker deceased. Containing about one hundred and fifty acres be the same more or less. Also several tracts or lots of woodland, and of fresh and salt meadows held in common in equal shares as aforesaid, And whereas the said Christopher Lott, deceased, did in and by his last will and testament bearing the date the twenty-sixth day of July in the year of our Lord one thousand eight hundred and two, nominate and appoint his brothers, Johannes J. Lott and Hendrick J. Lott and his cousin Stephen Lott of the New Lotts aforesaid, Executors of the same and in the same last will and testament did provide that whereas his real estate was yet in common and undivided between him and his said brother Johannes he did therefore authorize and impower his other two Executors, or the survivor of them to divide the same or cause the same to be divided between his estate and his said brother Johannes and to give a release or other proper instrument in writing, unto his brother, Johannes, for the said Johannes's equal share thereof and also to take and receive from his said brother Johannes a release or other proper instrument in writing for his, the said Christopher Lott's equal share thereof in behalf of his estate which in and by the said last will and testament may more fully and at large appear. And whereas the said parties have agreed that the said farm, woodland and meadows and premises shall be divided and that each party shall hold and enjoy their respective shares thereof in severalty, it is therefore covenanted, granted and agreed, by and between the said parties, that a partition of the same shall be and is hereby made, and determined in manner following, First, that the said Johannes J. Lott, his heirs and assigns shall and may from henceforth have, hold, occupy, possess and enjoy in severalty all that certain mepuage dwelling-house, barn, tract or parcel of land situate lying and being in the New Lotts, in the township of Flatbush aforesaid, being the Easternmost half of the above described farm, bounded, Southerly by the highway that leads from Flatbush to Jamaica [along the south side of the New Lotts], Easterly by land of Isaac J. Snediker deceased, Northerly by the road or highway that leads from Flatbush to Jamaica, along the north side of the New Lotts, and then southerly and westerly by land set apart for the equal half or share of the said Christopher Lott, deceased in the above described farm, as the same is now marked and marked out, containing about seventy five acres be the same more or less together with all the buildings and improvements thereon; also a tract or parcel of woodland and clearland situate lying and being in the New Lotts aforesaid, bounded , Northerly by the highway, Westerly by woodland of Nicholas Williamsen, Southerly, by the fresh meadows and Easterly, by land of Hendrick Wyckoff called and known by Lot No. 13 containing eighteen acres be the same more or less, Also another lot of woodland situate lying and being in the township of Flatbush aforesaid bounded, Southerly by land of John H. Lott, Easterly by woodland of Johannes J.(?) Lott, Northerly by land of Johannes Vansicklen deceased and Westerly by woodland of Bateman Loyd. Containing five acres be the same more or less; Also a lot or tract of salt meadows situate lying and being in the New Lotts aforesaid between the first and second creeks so called bounded Westerly by meadow of Peter Nefus, Northerly by land of Nicholas Williamsen, Easterly by meadow of Hendrick Wyckoff and the heirs of Daniel Rapalje and Southerly by the creek commonly called Vanderveer's Creek [being Lot No. 5], Also another piece or tract of salt meadow and also lying between the aforesaid first and second creeks, bounded Northerly by land of Nicholas Williamsen, Westerly by meadow of Leffert Lefferts deceased, Easterly by meadow belonging to Flatbush Church and Southerly by the Bay [being the Easterly half of Lot No. 17]; Also a tract or parcel of fresh or bogg meadow situate lying and being in the New Lotts aforesaid, bounded Westerly by fresh meadow of Nicholas Williamsen, Southerly by the Circular or meadow-fence, Easterly by fresh meadow of (blank space) and Northerly by the upland. Also the Easterly, equal half of a lot of salt and fresh meadows [being lot No. 22] situate lying and being in the New Lotts aforesaid, between the second and third creeks so called, which lot is bounded as follows, Easterly by meadow of Coert VanBrunt, Southerly by the bay, Westerly by meadow belonging to the estate of Frederick Simonson deceased and Northerly by land formerly belonging to Nicholas Wyckoff, And the said Hendrick J. Lott and Stephen Lott Executors as aforesaid by virtue of the power and authority given them in and by the said last will and testament do by these presents, grant, release and confirm the same to the said Johannes J. Lott, his heirs and assigns forever, as and for the full share and proportion of the said Johannes j. Lott, of in and to the said premises, so as aforesaid held in common, to have and to hold the same with all the priviliges and appurtenances thereof to him the said Johannes J. Lott, his heirs and assigns forever, in severalty as aforesaid, and to his and their only use and behalf forever; And the said Hendrick J. Lott and Stephen Lott in the capacity aforesaid do by these presents, covenant and grant to and with the said Johannes J. Lott, his heirs and assigns, that he and they shall and may from henceforth forever, peaceably and quietly, have, hold, use, occupy, enjoy and possess the same free and discharged of all right, title interest, claim and demand whatsoever of the said Executors or of any person or persons under them or under the right of the said Christopher Lott deceased. Second; that the said Hendrick J. Lott and Stephen Lott, Executors as aforesaid shall and may from henceforth, in behalf of the estate of Christopher Lott deceased, his heirs and assigns have hold, possess and enjoy in severalty all that tract or parcel of land situate lying and being in the New Lotts in the township of Flatbush aforesaid [being the westernmost half of the avove described farm], bounded Southerly by the highway that leads from Flatbush to Jamaica [along the south side of the New Lotts], Westerly by land of Nicholas Williamsen, Northerly by the road or highway that leads from Flatbush to Jamaica [along the north side of the New Lotts], and then Northerly and Easterly by land set apart for the equal half or share of the aforesaid Johannes J. Lott in the above described farm, as the same is now marked and marked out containing about seventy-five acres be the same more or less, (* E1) also a lot of woodland situate lying and being in the New Lotts aforesaid. Snediker deceased [being lot No. 18] containing twelve acres be the same more or less, Also a lot of woodland situate lying and being in the township of Flatlands [in the neck so called] in Kings County aforesaid, Bounded Southeasterly by woodland of Michael Stryker, Southwesterly by swamp of Derick Remsen, Northwesterly by woodland of Joannes Remsen and Northeasterly by the fresh kill or brook, containing three acres be the same more or less. Also a lot of woodland situate lying and being in the township of Flatbush in Kings County aforesaid, Bounded Northerly by the Flatbush road Westerly by woodland of Michael Stryker and Southerly and Easterly by woodland of William Williamsen, containing three and an half acres be the same more or less, And also another lot of woodland situate lying and being in the township of Flatbush aforesaid Bounded Southerly by land of John Vanderveer Westerly by woodland belonging to the estate of Abraham Ditmas deceased Easterly and again Southerly and then again Easterly by land and woodland of John Vanderveer and Northerly by the Brooklyn line, containing ten acres be the same more or less, (* E2) Also the equal undivided half part of a lot of salt meadows in partnership with Nicholas Williamsen which lot is bounded Westerly by meadow of the said Nicholas Williamsen Northerly by a ditch adjoining the fresh meadow of Nicholas Williamsen and Easterly and Southerly by the second creek, Being lot No. 24, (* T2) Also a tract or parcel of salt and fresh meadow situate lying and being in the New Lotts aforesaid, Between the second and third creek bounded Northerly by the upland Westerly by meadow of Johannes Ditmas Easterly by meadow of Derick Remsen and Southerly by the second creek being the Westerly half of lot No. 2, (* E3) Also a tract or parcel of fresh or bogg meadow situate lying and being in the New Lotts aforesaid Bounded Northerly by the Circular, or meadow fence Westerly by fresh meadow Nicholas Williamsen Easterly by fresh meadow of Johannes Ditmas and Southerly partly by the second creek and partly by a ditch, Also the Westerly equal half of a lot of salt and fresh meadow being lot No. 22 situate lying and being in the New Lotts aforesaid Between the second and third creeks the boundaries of which lot are herein before described, And the said Johannes J. Lott for himself, his heirs executors and administrators doth by these presents grant release and confirm the same to the said Hendrick J. Lott and Stephen Lott in behalf of the heirs of the said Christopher Lott deceased, their heirs and assigns forever as and for the full share part and proportion of the said Christopher Lott deceased of in and to the said premises as aforesaid held in common to have and to hold the same with all the priviliges and appurtenances thereof unto the said Executors in behalf of the estate of Christopher Lott deceased and to his heirs and assigns forever in severalty as aforesaid and to their only use and behalf forever [to the true intent and meaning that the same shall be considered as the real estate of the said Christopher Lott deceased and be subject to the regulations of his last will and testament as effectually as if this partition had been made in his life time] And the said Johannes J. Lott doth by these presents for himself, his executors and administrators covenant and grant to and with the said Hendrick J. Lott and Stephen Lott Executors as aforesaid that they the said Executors and heirs of Christopher Lott deceased shall from henceforth forever, peaceably and quietly have, hold, use, occupy, possess and enjoy the same free and discharged of all right, title, interest, claim and demand whatsoever of him the said Johannes J.
