Deed by John Creasey
& wife to State of WV (1934), Kanawha County, WV
THIS DEED, Made this 5th day of December, 1934, between JOHN CREASEY AND ALICE CREASEY, HIS WIFE parties of the first part, and the State of West Virginia, by the State Road Commission of West Virginia, a Corporation, party of the second part.
WITNESSETH:
That
for and in consideration of the sum of THREE HUNDRED SIXTY-SEVEN &NO/100
dollars ($367.00), cash in hand paid, the receipt of which is hereby
acknowledged, the parties of the first part do grant, sell and convey unto the
said State of West Virginia, party of the second part, the following described
strip or parcel of real estate, to be used for State Road purposes, and situate
in Cabin Creek District, Kanawha County, West Virginia. Said strip or parcel of real estate
hereby conveyed is shown as Project No.3398-A, upon map or blue print filed in
the office of the Clerk of the County Court of Kanawha County, and marked,
identified and described as plans or blue print of said Project No. 3398-A, by
West Virginia State Road Commission, and said strip or parcel of real estate or
right of way hereby conveyed, is conveyed for the purpose of building,
constructing and maintaining a highway over, across and upon the same, together
with the right of the party of the second part, its officers, agents, employees
and assigns to enter upon, construct and maintain a highway over, across and
upon the property of the parties of the first part, as provided by the laws of
the State of West Virginia.
Said
strip or parcel of real estate or right of way is more fully described as
follows, to-wit:
And the
consideration herein named is acknowledged and accepted not only as
consideration for the property hereinafter described, but as full consideration
for all damages to the residue of said property by reason of the construction
and maintenance of the highway on, over and across the same as provided by the
laws of the State of Wlest
Virginia,
and the property conveyed is described as shown upon description hereto
attached and marked as property of the party of the first part hereto together
with project number of same, which is as follows:
Beginning
at a point on the northerly Right of Way Line on the proposed State Road
know[sic] and designated as Project 3398-A on the plans on file in the office
of the Clerk of Kanawha County Court, said point being 8 feet right of Sta.
23+80, 40 feet right of north rail of C. & O. R. R. Tracks, (west bound
main) and upon the property line between the Charleston National Bank property
and J. H. Creasey;
Thence
S. 20° 30¹ W along and binding upon the said property line between the
Charleston National Bank property and J. H. Creasey 17 feet more or less to a
point 7 feet left of Sta. 23+87 said point being in cL [centerline] of present
road;
Thence
westerly along and binding upon the cL [centerline] of the present road
following all the turns, curves, etc thereof 170 feet more or less to a point 9
feet left of Sta. 25+55 said point being upon the property line between J. H.
Creasey and C. & O. R. R.;
Thence,
N. 22° 30¹ E along and binding upon the said property line between J. H.
Creasey and C. & O. R. R. Company 21 feet more or less to a point 8 feet
right of Sta. 25*47;
Thence
turning easterly by a curve to the left with a radius of 4575.75 feet parallel
to and 8 feet left of cL [centerline] of said proposed road 166.7 feet more or
less to a point of beginning;
Containing
in all 0.064 acre, more or less, including that part occupied by present road;
It is
further understood and agreed between the parties hereto that the consideration
hereinabove mentioned covers only such damages to the residue of said property
as caused by said road as now located and constructed and does not cover any
future damage that might result to said residue by virtue of relocation and
reconstruction of said road sometime in the future.
The
parties of the first part WARRANT GENERALLY the title to the property hereby
conveyed.
