Deed by Benjamin & Mabel Creasey, I L & Emma N Creasey, and I L & Tessie Hark to Harry Creasey and Letha Kuhn (1938), Kanawha County, WV

 

 

THIS DEED made this the 7th day of July, 1938, by and between BENJAMIN CREASEY and MABEL CREASEY, his wife, I. L. CREASEY and EMMA N. CREASEY, his wife, and I. L. HARK and TESSIE HARK, his wife, parties of the first part, HARRY CREASEY and LETHA KUHN, widow, parties of the second part, and IDA TRAIL and T. A. TRAIL, her husband, DOLLIE RICHARDS and J. C. RICHARDS, her husband, and NORA M. CREASEY, widow, parties of the third part.

WHEREAS, John H. Creasey departed this life testate leaving a Will bearing date the 19th day of January, 1929, which said Will was duly probated on the 21st day of March, 1938, and is of record in the Office of the Clerk of the County Court of Kanawha County, West Virginia, in Will Book 26 at page 246; and,

WHEREAS, the Will aforesaid provided that all the estate north of the Charleston Interurban Railroad was to go to his sons, Irvin Creasey, which is the said I. L. Creasey, Benjamin Creasey, Bert Creasey and Henry Creasey to be equally divided among them; and,

WHEREAS, the said Henry Creasey has departed this life intestate and left surviving him as his sole and only heirs at law, a son, the said Harry Creasey and a daughter, the said Letha Kuhn, a widow; and,

WHEREAS, the said Bert Creasey departed this life intestate and left surviving him as his sole and only heirs at law, a daughter, Anna A. Thompson; and,

WHEREAS, on the 25th day of May, 1938, the said Anna A. Thompson and Clarence V. Thompson, her husband, by deed of that date, conveyed to the said I. L. Hark all their right, title and interest in and to all of said real estate, which deed is of record in the aforesaid Clerk's Office in Deed Book 460 at page 126; and,

WHEREAS, the parties hereto have agreed upon a division of the said real estate.

NOW, THEREFORE, THIS DEED WITNESSETH:

That for and in consideration of the premises, as well also as One Dollar ($1.00), cash in hand paid, the receipt of which is hereby acknowledged, and the further consideration that the said parties of the second part assume and agree to pay a one-sixth (1/6) of all the debts and claims against the estate of the said John H. Creasey, deceased, as the same are ascertained by the Commissioner of Accounts to whom said estate has been referred, the said parties of the first part do HEREBY GRANT, BARGAIN, SELL AND CONVEY unto the said parties of the second part all of their right, title and interest in and to that certain lot or parcel of land situate in Cabin Creek District, Kanawha County, West Virginia, which said parcel of land is more particularly bounded and described as follows, to-wit :

BEGINNING at a stake in the Northern line of a Twenty Foot Street at the southeastern corner to Lot No. 4; thence leaving said street and with the division line between said Lot No. 4 and Lot No. 5 N. 15-05 E. 365 feet to a stake in the southern line of the Appalachian Electric Power Company property; thence with said line N. 73-00 E. 44.70 feet to a stake at the northwestern corner to Lot No. 6; thence leaving said Electric Company property line and with the division line between said Lots No. 5 and No. 6, S. 15-10 W. 367 feet to a stake in the northern line of a Twenty Foot street; thence leaving said Lot No. 6 and with the northern line of said street S. 74-20 W. 42.66 feet to the place of beginning, and being Lot No. 5 as shown on the map of the division of the estate of John H. Creasey, deceased, which map was made by John D. Moore, C.E., on the 15th day of June, 1938.

For the same consideration there is likewise conveyed to the said parties of the second part the full and free right to use a twenty foot street as shown on said map adjoining the northern line of the right of way of the Charleston Interurban Railway, together with the ten foot alley leading from said twenty foot street across the track of the said Charleston Interurban Railway to the State Highway, which said alley lies along the easterly side of Lot No. 2 as shown on the map of said division, which was conveyed to Dollie Richards.

The said parties of the third part in consideration of One Dollar, cash in hand paid, the receipt of which is hereby acknowledged, do hereby CONVEY unto the said parties of the second part the free right to use said ten foot alley above mentioned.
