Estate Settlement of John H Creasey (1938), Kanawha County, WV

 

 

IN THE MATTER OF:

THE ESTATE OF JOHN H CREASEY, DECEASED

 

COMMISSIONERıS REPORT OF CLAIMS AND FINAL SETTLEMENT

 

 

TO THE HONORABLE COUNTY COURT OF KANAWHA COURT, WEST VIRGINIA:

 

     The undersigned Commissioner of Accounts, to whom the above named estate was referred for settlement on the 21st day March, 1938, respectfully reports to Your Honors that he appointed the 30th day of September, 1938, as the time, and his office, 203 Security Building, Charleston, West Virginia, as the place for receiving proofs of debt, claims and demands against the deceased or his estate, and published the notice thereof once a week for three successive weeks in The Charleston Daily Mail, a newspaper of general circulation published in Kanawha County, West Virginia, beginning with the issue of the 29th day of March, 1938, and ending with the issue of the 12th day of April, 1938, and mailed a copy of said notice to all known heirs, beneficiaries and creditors of the decedentıs estate, addressed according to the list furnished Commissioner.

 

     At the time and place aforesaid, your Commissioner sat for the purpose specified in said notice, and the following claims were presented and allowed:

Ida Trail, claim for amount paid for burial of decedent               $79.00

Thomas A Trail, claim for Administration Expenses                     $42.25

 

ASSETS IN HANDS OF EXECUTOR

Cash from said of household and personal effects appraised at $25.00   $5.00

(The appraisal also disclosed real estate of the value of $2200.00)

 

HOW ASSETS TO BE DISTRIBUTED

The personal property will be applied toward payment of the costs of administration and claims, and the balance thereof will remain a charge against the real estate, unless paid by the heirs.  Decedent by his will bequeathed all personal property to his wife, Alice Creasey.

 

     The undersigned Commissioner of Accounts reports further that on the 21st day of March, 1938, Thomas Trail, Executor of the Estate of John H Creasey, Deceased, exhibited before Commissioner a statement of all money and property which he, the said Executor, had received or become chargeable with, or had disbursed and distributed from the date of his appointment and qualification until the 21st day of March, 1938, together with his vouchers for such disbursements and distributions; that Commissioner embraced the said Executor in the list of fiduciaries whose accounts were then before him for settlement, which list was published for two successive weeks, on the first and second Mondays in the month of March, 1939, in Charleston Daily Mail; and the publication thereof having been completed, Commissioner has made up and state the final settlement of the accounts of the said Executor, and finds that on the 21st day of March, 1939, the said Executor had disbursed and distributed all money and property which came into his hands as such Executor, as is shown below.

 

     Commissioner further reports that the costs of administration and claims have been paid in full by the heirs, and that no claim for reimbursement is made.

 

     Commissioner further reports to the Court that he has examined whether the said Executor has given such bond as the law requires, and ascertained that the said Executor was not required to give bond by decedentıs will.

 

     No further settlement will be required of this Executor, therefore, upon confirmation of this report by the Court, he will be discharged and acquitted from further execution of this trust, and the administration of this estate will be declared closed.

STATE OF WEST VIRGINIA

COUNTY OF KANAWHA

     To-wit:

     I hereby certify that on the date of the completion of the foregoing report I mailed notices to all known parties of interest, advising them of the completion of the report and stating that it would be held in my office for ten days, during which time it would be subject to the inspection and exception of any person interested therein; that the said report was held in my office for ten days after the completion thereof, and that no exceptions were taken thereto.
