The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.rootsweb/~usgenweb/ Submitted by Mary Love Berryman - marylove@tyler.net 16 June 2001 ***************************************************************** DECATUR COUNTY, GEORGIA Deed Book B, pp. 423-424 Recorded November 24th l835 State of Georgia This indenture made this fifth day of November in the year of our lord one thousand eight hundred and thirty three between Daniel PONDER Executor of Joseph MOORE late of Monroe County deceased by his attorney Lemuel NEWMAN of the County and State aforesaid of the one part and Joshua BEALS of Decatur County of the other part witnesseth that whereas by virtue of an order granted by the honorable the Inferior Court of Monroe County when sitting for ordinary purposes on the twentieth of October eighteen hundred &nd thirty-three to the Said Daniel PONDER to sell a tract of land belonging to Said estate lying and being in the fifteenth District of formerly Early now Decatur County and known and distinguished in the plan of Said Dictrict by number ninety-one and after the Same was duly advertised in the Georgia Messenger in conformity to law the same was put up and exposed to publick sale to the highest bidder at the dore of the Court house of Said County of Decatur on the first Tuesday in November eighteen hundred and Thirty Two (?) within the legal hours of Sale by the said Daniel PONDER Executor of aforesaid when the Same was knocked off to the Said Joshua BEALS of the County aforesaid at the price or Sum of Fifty-cents he being the highest Bidder. Now for and in consideration of the Said Sum of Fifty Cents in hand to the said Daniel PONDER Executor as aforesaid by him the Said Joshua BEALS at and before the Sealing and delivery of these presents the receipt whereof is hereby acknowledged he the said Daniel PONDER Executor as aforesaid hath granted bargained and Sold and by these presents doth grant bargain and sell unto the Said Joshua BEALS of the county aforesaid the before named and bargained land with all the Improvements and appertinances thereunto belonging or in any wise appertaining unto him the said Joshua BEALS his heirs and assigns to his and their proper use benefit and ever in fee simple and the Said Daniel FONDER Executor as aforesaid the before named land with all the improvements and appertinances thereunto belonging or in any wise appertaining unto him the Said Joshua BEALS And his heirs and assgns Shall and will warrant and forever defend the legal and equitable title against himself and all and every other person or persons whatsoever as far as in law or equity he may be bound to do as Executor as aforesaid. In witness whereof the Said Daniel PONDER Executor as aforesaid by his attorney Lemuel NEWMAN hath hereunto set his hand and affixed his Seal the day and year afore written.
