RICHARD HYDE WILL - 1762 Will Book 52 page 79 - 15 May 1762 May Court 1762 In the name of God Amen, I Richard Hyde of Northampton County caling to mind the mentality of my body that it is appointed for all men once to die do here make my last will & testament in manner & form following Imprimis - I give & bequeath to my Son Henry Hyde my tract of land in Northampton County lying in Cedar run contining three hundred twenty acres, to him & his heirs forever. Item - I bequeath to my son Lucas Hyde two hundred fifty acres of land lying in Brunswick County in the middle of Fork Creek, adjoining James Williams & David Hyde & Jonas Williams, to beginning where my said brother crops the Cobbin branch & run thence to the upper live westerly to him & his heirs forever. Item - I lend to my wife Mildred Hyde three negroes, to wit, Jacob, Polly, Currender during her widowhood & at her marriage & death I give my negro man Jacob to my son Henry Hyde & my Negroe man named Jolly I give to my son Lucas but in case either of my said sons dies without heirs lawfully begotton that their part & portion shall be equally divided between my other sons, viz, the survivors of wife of said sons of my son Hartwell Hyde. Item - My wife being now with child if it please God she be safely delivered of it I give the first child that my negroe wench Currinder shall bear & live in the home of my wife's widowhood to the child my wife is now bigg with. Item - I also lend to my wife all my stock of cattle sheep & hogs horses except my grey horse called Jumper and during her widowhood also I lend to my wife my household goods during her widowhood except my four feather beds & furniture. Item - I give to my sons, to wit, Henry Hyde, Hartwell Hyde & Lucas Hyde one feather bed & furniture a piece. Item - I also give to my wife Mildred Hyde a feather bed & furniture Item - I give to my Daughter Anne Avent my boy horse called jumper. Item - My will is that at the marriage or death of my said wife; that all the remainder of my sd stock, household goods be sold at public sale and equally divided among my three sons viz Henry Hyde, Lucas Hyde Hartwell Hyde, & the child that my wife is now big with. Item - I give to my daughter, Letitia Hyde one negro girl named to her & her heirs forever. Item - I give to my Daughter Sophia Hyde one negro girl named Gillis to her & her heirs forever. Item - I give to my daughter Cheyney Hyde one negro boy named Moody to her & her heirs forever. But if either of my said daughters dies without heir law fully begotton my desire is that their part shall be divided between the survivors of them. Imprimis - I give to my son Hartwell Hyde my Plantation which I now live and all my other lands which I have not yet disposed of to him & his heirs forever. I also give to my son Hartwell Hyde one negro wench named Currinder after the marriage or death of my wife. Item - I give to my wife that money that is due to me from her Mother's estate. I also leave my crop of tobacco & outstanding debts, to discharge my just debts & providing necessaries for my family. Item - Lastly I appoint my wife Mildred Hyde & Henry Brett executors of this my last will & testament dismantling all former wills by me made. I acknowledge this only to be my last will & testament. In witness whereof I have hereunto set my hand & seal the fifteenth day may A. D. 1762. Signed sealed & delivered in presence of Richard (his mark) Hyde & and David (his mark) Hyde, Samuel MacCrew, Alice Day Northampton County May Court 1763 The preceeding will & testament of Richard Hyde and was exhibited in Court & the oath of David Hyde as the subscribing witness thereto at the same time Mildred Hyde was qualified Executor thereof which in motion was ordered to be certified & recorded.
