Franklin County, Tennessee Chancery Court Minutes 1834-35, pp 301-302 Cynthia Frame - Petition for Dower Cynthia Frame, Petition for Dower} Files 18th Feby 1841 To the Hon the Jundge of the Chgancery Court setting at Winchester Your Petitioner Cynthia Frame widow & relict of John Frame late of Franklin County but respectfully represent unto your honor that her sd Decd husband departed this life Intestate in the county aforesaid on the day of -- 1839 Size & possession of the following tracts of Land Towit. Once trct of 320 acres in Franklin County including the head spring of Old Town Creek & an ancient fortification being the place on which Intestate resided at the time of his death which was conveyed to him by John Overton by Decd bearing date the 28th of March 1817 & which has been duly registered in the Registers office of Franklin County. 2nd One other tract in Sd County on the South side of Elk river, near the mouth of Green Creek containing 20 Acres & which was conveded to Intestate by Joseph Neilton by Decd bearing date the 28th day of March 1834 & also duly registered. 3rd One other tract in the County on the south side Elk river containg 130 acres by Survey bearing date the ___ day of ___ by vertue of open by No 219 dated the 5th day of July 1824. 4th One other tract in said County on further back south side of Elk run containing 125 acres by survey bearing date the 24th day of April 1826 by survey bearing date the 24th day of April 1826 by vertue of an entry No 593 dated the 2nd day of Jany 1826. 5th One other tract in the County in the Waters of Joiners Creek a south branch of Elk river containing 50 acres by survey bearing date the 29th day of Oct 1825 by by vertue of an entry No 217 dated the 5th day July 1824. 6th Lot No 5 in Town place of Winchester conveyed to sd Intestate by John Turner by decd bearing date 4th day of December 1827 and also duly proved & registered. 7th One other tract of 150 acres in Lincoln County on the waters of Short Creek, granted by the State of Tennessee to the sd Intestate by Patent No 11.390 bearing date the 10th day of December 1832. 8th One other tract of 50 acres in Lincoln County on the waters of Short Creek a N. Branch of Elk river granted by the State of Tennessee to the sd Intestate by Patent No 5305 bearing date 24th day of January 1827. One other tract of 20 acres in Lincoln County on the waters of Short Creek a Branch of Elk river & which was granted by the State of Tennessee to the sd intestate by Patent No 20.194 bearing date 16th day of September 1823. 10th One other tract of 20 acres in Lincoln County on the waters of Short Creek granted to the Intestate by Patent No 20.194 bearing date 16th day of September 1828 11th One other tract of 10 acres in Lincoln County on Short Creek granted by the State of Tennessee to the sd Intestate by patent No 20.189 bearing date the 16th day of September 1823. 12th One other tract of 21 acres & 136 poles in Lincoln County on Short Creek conveyed to the Intestate by William Gilmore by Decd bearing date the 25 day of August 1810 & which has been duly registered in the registers office of Lincoln County 13th One other tract of Land in Lincoln County on the waters of Short Creek conveyed to the sd Intestate by Lemuel Hutchings by decd bearing date the 2nd day of September 1813 & which has been duly registered in the registers office of Lincoln County. Your Petitioner further states that she is entitled to dower in the land aforesd. Sd Intestate left the following children towit, Polly Morris to James Morris, Sarah Morris to John Morris, Elizabeth married to Lunceford L Mathews, Phobe married to Henry Hill, William, Martha, then Mary, Benjamin, Wiley, Joseph & Susan the last six being infants under the age of 21 years & the following grandchildren sons and daughters of sd Intestates Decd Son Robert towit Logan, Eliza, Louisa, John & Mary all of which are infants under the age of 21 years for whom James Morris has been apponted Guardian. That Thomas M Pryor has been duly appointed Guardian of Phoebe & Martha & Lunceford L Mathews of William, Mary, Benjamin, Wiley, Joseph & Susan. Your petitioner prays your Honor to order & decist the sheff of Franklin County to assign & allow to her down in sd Lands according to Law & Cynthia Frame She further state that letter of Administration Sd Estate were granted to Lunceford L. Mathews & John Morris by the County Court of Franklin. Cynthia Frame M True Her Sol Received a copy of this petition & we are willing that the Dower of Petition may be assigns. Pryor Guardian for Martha Lunceford L Mathews Guardian for Mary Benj Wiley Joseph & Susan Frame Inter Country Decree This day came Cynthia Frame widown & Relect of John Fram Decd & presented her petition praying to be endowed of the lands of which her sd Decd husband died seized & possessed which are particularly described in her sd Petition & it appearing to the Court that the heirs & administrators have been furnished unto a copy of the petition & that they are willing for her dower to be assigned & allotted to her according to the prayer of her petitioner: On consideration thereof it is ordered by the court that the clerk issue a writ of Dower directed to the shff of this county commanding him to summon five free holders unconnected with the parties either by consanguinity or affinity & entirely disinterested who upon oath to the administration by the Sheriff shall allot & set apart to the sd widow one third part of all the lands tenements & in the sd Petition & described and put her in the possession thereof & the sheriff should make the report he has executed sd writ to the next term. In the cause of Mrs Frame Pet for Dower The Sheriff of the County who was directed by an Interloctory Order of this court at the last Term to summon a Jury of five good & lawful men to assign to the petitioner her dower in the Estate of her husband this day made his report together with the allotment of Dower by the Jury in the said & assigns follows (page missing)
