My Marshall great- great- great grandparents were James MARSHALL & Isabel McPHERSON.

James MARSHALL was born December 30, 1830 in Scotland, and died August 29, 1906 in Brampton, Ontario. He married (1) Isabel McPHERSON Bef. 1860 in Canada. He married (2) Jane SMITH March 09, 1898 in Toronto, daughter of John SMITH and Barbara McTAVISH.

According to the marriage registration for his second marriage, James was s/o John MARSHALL and Agusta SMITH. According to the 1901 census, he came to Canada in 1850. Between 1850 and 1860 his whereabouts are unknown. In 1860 he is living in Esquesing twp., Halton Co with his wife Isabel. Most, if not all, of their children were born there.

In January of 1862 James recieved a land grant of 100 acres from the Canada Company: 100 acres, west 1/2 of lot 30 in the 10th con of Esquesing twp (this is just east of the village of Ballinafad, in the northeast corner of Halton County). Although the land was granted in 1862, it may not have been registered until 3 Dec 1867. On 7 April 1885 James sold this land to John McKECHNIE, although James held the mortgage (document 4368). Apparently this was only piece of land that James MARSHALL sold to John McKECHNIE at this time, and the total price was $5,800. This needs to be looked into (documents 4067 & 4368). On 10 June 1892, the mortgage was paid off (document 6167). John McKECHNIE sold this one piece of land to David MORAN for $3800 on 20 Sept 1910 (9565) who then sold it to James McKechnie in 1911. The next owner was Daniel McKECHNIE (Feb 1916).

Isabel McPHERSON was born in Scotland about 1832. Both James and Isabel are buried in Chinguacousy twp cemetery # 16, Peel Co (Brampton), section1. Isabel died in 1892.

James re-married in 1898 (he was a gentleman, resident of Chinguacousy twp, age 65, widower, gentleman, Presbyterian, and the witnesses at the marriage were Neil SMITH of Brampton & Mary Jane HETHERINGTON of Toronto, marriage reg # ) and in the 1901 census James & Jane were living in Brampton, along with James's daughter Margaret. See SMITH section near bottom of this page.

SMITH family

I have looked into the family of Jane SMITH (2nd wife of James MARSHALL) in case they were related.

Jane was born 18 July 1840, the daughter of John SMITH & Barbara McTAVISH. Her first husband was also named John SMITH!! They were married in Esquesing twp. on 6 Dec 1872 (source: vol 29, page 129). Husband John was s/o Archibald & Janet (maiden name unknown). John was born about 1840 in Canada. The witnesses at the first marriage were Dugald CAMPBELL & Grace SMITH, both of Chinguacousy. In 1872 husband John was a farmer in Esquesing twp., but by 1881 Jane was a widow. This Jane SMITH (married MARSHALL) died in 1918 and is buried in Melville cemetery.

IGI, LDS film M115194, has marriage of John SMITH & Barbara McTAVISH, 05 APR 1831 at Killean And Kilchenzie, Argyll, Scotland

John & Barbara had at least 2 other daughters, Janet & Grace and a son, Duncan

  1. Grace SMITH was born in Canada about 1846, and she married Dugald CAMPBELL on 14 Jan 1875 in Georgetown, marriage reg # 2987-75. The witnesses at the wedding were: Alexander Gardner McTAVISH of Esquesing & Jane YOUNG of Erin. Dugald was born in Scotland about 1843, s/o Dugald & Mary. In 1875 he was a farmer in Caledon twp. By the 1881 census, he was a widower living in Chinguacousy twp with his mother-in-law Barbara SMITH (nee McTAVISH) and his sister-in-law Jane SMITH. Dugald & Grace had 2 children: John S. born 8 Jan 1877 and Mary Euphemia born in July of 1879
  2. The other daughter of John & Barbara was Janet, but all I know about her is that she was born about 1843 in Canada.
  3. Duncan SMITH married Margaret SMITH in Esquesing in Jan of 1870: marriage registration is: Vol 6, pg 92 - Duncan SMITH, 31, farmer, Canada, Caledon, s/o John & Barbara, married Margaret SMITH, 25, Canada, Esquesing, d/o Archibald & Janet, witn: John SMITH of Chinguacousy & Janet SMITH of Caledon, 12 Jan 1870 at Esquesing.

In the 1871 census, John & Barbara are in Chinguacousy twp., (div 1, pg 2,) and living at Lot 33, con 6, on 200 acres. John was age 61, gentleman, born in Scotland. The 3 girls, Jane, Janet & Grace were living at home at the time.

John Sr. died in 1875 and is buried in Melville cemetery, Caledon. His tombstone says that he was a native of Argyleshire Scotland. His wife Barbara, who died in 1896, is buried with him, and she too was a native of Argyleshire Scotland.

In the 1881 census, Barbara is age 77 & living in Chinguacousy with widowed son-in-law Dougald CAMPBELL and daughter Jane. Also with them is a Jemima SMITH age 11 but I do not know how she fits into the family. There is this marriage registration that might shed some light on the situation (or just confuse things!): 9639-89 William McMILLAN, 26, farmer, Erin, same, s/o Duncan McMILLAN & Euphemia McKECHNIE, married Jemima SMITH, 20, Chinguacousy, same, d/o David KIRKWOOD & Jane SMITH, witn: Dougald CAMPBELL of Chinguacousy & Tina CAMPBELL of Erin, 27 Nov 1889 at Chinguacousy

Duncan & Jemima McMILLAN (nee SMITH) were in Chinguacousy twp in the 1901 census (b-6, pg 11) with 6 children and a domestic, Christena McMILLAN age 30. Children:

  1. John G., born 27 Sept 1890
  2. Wilfred L., born 1 Jan 1892
  3. Jennie M., born 30 Sept 1893
  4. William W., born 26 April 1896
  5. Euphemia M., born 5 March 1897
  6. Duncan Jr., born 9 Oct 1899

I also found Archibald & Janet SMITH on the 1871 census (also in case they were related to James MARSHALL!). They were living in Esquesing (div 3, pg 8), at lot 28, con 11 on 200 acres. Archibald was a 59 year old farmer, and he and his wife were both born in Scotland. Janet was the same age as her husband. Archibald & Janet were both still alive at the time of the 1881 census (Archibald as 70 and Janet 68 years old); they were still in Esquesing.

Family of Archibald & Janet (2 to 6 were at home in the 1871 census)

  1. John, born about 1840 (married to Jane SMITH, d/o John & Barbara - see above)
  2. Jane, born about 1849 (still at home 1881, age 26)
  3. Mary, born about 1851 (still at home 1881, age 24)
  4. Barbara, born about 1855 (still at home 1881, age 20)
  5. Christena, born about 1857 (still at home 1881, age 18)
  6. Archibald, born about 1859 (living next door to his parents in 1881, single)
  7. Janet, in the 1881 census, age 22
  8. Margaret - born about 1845, married Duncan SMITH in 1870 (see above as Duncan was s/o John & Barbara)
  9. Agnes - born about 1843, married Robert CARTER in 1873 (where was she in 1871?)

5460-73 Robert CARTER, 39, farmer, England, Garafraxa, s/o James & Grace, married Agnes SMITH, 30, Esquesing, same, d/o Archibald & Janet, witn: John CARTER of Garafraxa & Mary SMITH of Esquesing, 12 March 1873 at Esquesing
