Deed : Susanna Silfles et al, Chas. Silfles & wife et al, James Silfles & wife et al, Tilghman Kuntz & wife et al to Joseph Silfies

This Indenture made the second day of April in the year of our Lord one thousand eighth hundred and fifty six, between Susanna Silfies widow and relict of William Silfies late of Moore township in the County of Northampton and State of Pennsylvania, farmer, deceased, and Charles Silfies, one of the sons of the said deceased and Mary Ann his wife, James Silfies another of the sons of the said deceased and Susanna his wife and Tilghman Kuntz and Eliza his wife late Eliza Silfies a daughter of the said deceased, of the one part, and Joseph Silfies another of the sons of the said deceased of the other part. Whereas the said William Silfies by force and virtue of certain conveyances and assurances in the law duly had and executed became in his lifetime lawfully seized in his demesne of and in a certain messuage or tenement and several tracts or pieces of land situate in Moore township aforesaid and being so thereof seized died intestate leaving a widow of the above said Susanna and issue the above named Charles, James, Eliza intermarried to Tilghmann Kuntz, and Joseph to whom the same, by the laws of Pennsylvania did descend and come and whereas it has been mutually agreed upon by and between the said widow and children or heirs at law to dispense with and avoid the necessary delay and expense incident to and attendant upon the usual Orphans Court proceedings in such cases and to dispose of such real estate by mutual consent, and in testimony of such understanding the said widow and the said children of the intestate have become parties to these presents. Now this Indenture therefore witnesseth that the said Charles Silfies and Mary Ann his wife, James Silfies and Susanna his wife and Tilghman Kuntz and Eliza his wife for and in consideration of the sum of their respective proportions of nineteen hundred and sixty eight dollars and ninety three cents to them in hand paid by the said Joseph Silfies at and before the sealing and delivery hereof the receipt whereof they do hereby acknowledge and thereof acquit and forever discharge the said Joseph Silfies his heirs, executors and administrators by these presents as also for the further consideration of their respective proportions and interests in the sum of thirteen hundred and twelve dollars and sixty two cents intended to remain in the herein conveyed premises as a lien of Dower for the said Susanna Silfies widow as aforesaid, the interest whereof to be paid to her during her natural live, as hereinafter expressed, and the principal to be paid after her decease, have and each and every of them hath remised released and forever quit claim and by these presents do and each and every of them Doth remise, release, and forever quit claim unto the said Joseph Silfies and to his heirs and assigns all the estate and estates, shares purports and dividends, right title, interest, property, claim and demand whatsoever of them the said Charles Silfies and Mary Ann his wife, James Silfies and Susanna his wife, Tilghman Kuntz and Eliza his wife in law or equity or otherwise howsoever, of in to or out of all that messuage or tenement and tract of land (part of the Real Estate of the said intestate) lying and being in Moore township aforesaid, bounded and described as follows, to wit: Beginning at a stone corner in the public road, thence along the said road land of George Craver south eighty four degrees and a half west seventy five perches and three quarters to a stone corner, thence by land of Isaac Sheip, north nineteen degrees and a half west twenty six perches to a stone corner north twenty four degrees and three quarters west forty seven perches and a half to a white ash tree, and south eighty two degrees and three quarters west fifteen perches and four tenths too a stone, thence by land of Joseph Fritz north half a degree west twenty five perches and a quarter to a stone corner, north four degrees and a half west twenty four perches and six tenths to a stone north sixteen degrees and a quarter west fourteen perches and two tenths to a stone and north twenty three degrees and a quarter west thirty three perches and six tenths to a corner in line of Isaac Sheips line thence by the same north sixty eight degrees and a quarter east thirty four perches and two tenths to a stone in Joseph Silfies line of his other land, thence by the same, south thirty six degrees east thirty three perches and three tenths to a stone and north seventy eight degrees and a half east seventy one perches to a stone near chestnut sapling, thence by land of John Frack south six degrees and three quarters east one hundred and fifty three perches and seven tenths to the place of beginning, containing ninety seven acres and thirty seven perches strict measure. Twelve acres and one hundred and thirty three perches of said tract being land which James Sholl and Catherine his wife by Deed Poll under their hands and seals bearing date the first day of April Anno Domini one thousand eight hundred and forty three and recorded in the Office for Recording of Deeds at Easton in Deed Book D Vol. 6 page 534, granted and confirmed unto the said William Silfies and the remainder of the said described tract is part of a larger tract which the said James Sholl and Catherine his wife by their Deed under their hands and seals bearing date the first day of April Anno Domini one thousand eight hundred and forty three, granted and confirmed unto the said William Silfies his heirs and assigns in fee said Deed being recorded in the Office for recording of Deeds at Easton in Deed Book H vol. 6 page 535 etc. Reference being had to the said Deed Poll and Deed will fully appear together with all and singular the buildings, improvements, ways, woods water watercourses rights liberties privileges hereditaments and appurtenances whatsoever thereunto belonging or in any wise appertaining and the reversions and remainders rents, issues, and profits thereof: To have and to hold all and singular the premises hereby remised and released or mentioned or intended so to be with the appurtenances unto the said Joseph Silfies his heirs and assigns to the only proper use benefit and behoof of him the said Joseph Silfies his heirs and assigns forever, under and subject nevertheless to the payment of the further sum of thirteen hundred and twelve dollars and sixty two cents, to the heirs and legal representatives of the said intestate William Silfies at and immediately after the decease of Susanna Silfies widow of the said intestate any thing herein contained to the contrary notwithstanding: and under and subject to the payment of the annual interest of the aforesaid sum amounting to seventy eight dollars and seventy six cents to be paid on every first day of April to the said widow during her natural life time, the same being in lieu of her dower in the above described and conveyed premises and subject to the payment of all arrearage of principal and interest due to the Commonwealth of Pennsylvania for patenting the aforesaid premises or any part thereof so that neither the said Charles Silfies And Mary Ann His Wife, James Silfies And Susanna His Wife, Tilghman Kuntz And Eliza his wife, nor their heirs, nor any other person or persons whosoever, lawfully claiming or to claim, by from or under them, or any of them, shall or may, at any time or times hereafter have claim, challenge or demand any estate, right, title or interest of in to or out of the said mèssuage and ninety seven acres and thirty seven perches, hereditaments and premises hereby remised and released or mentioned, or intended so to be with the appurtenances or any part or parcel thereof but thereof and therefrom shall and will be utterly included and forever debarred, by these presents and furthermore the said Susanna Silfies for herself her heirs executors and administrators and for the consideration of the stipulated dowry herein above contained and expressed to inure to her annually during her life time, doth by these presents, grant and confirm, on her part all and whatsoever is herein contained or expressed, for the purpose and with the intent and meaning of assuring unto the said Joseph Silfies and to his heirs and assigns, a perfect and indisputable title to the said premises. In witness whereof the said Susanna Silfies, Charles Silfies and Mary Ann his wife, James Silfies and Susanna his wife and Tilghman Kuntz and Eliza his wife, have hereunto set their hands and seals the day and year first above written. Received the day of the date of the above written Indenture of and from the above named Joseph Silfies the sum of nineteen hundred and sixty eight dollars and ninety three cents in full for the consideration above mentioned: we say received by us Charles Silfies, James Silfies, Elizabeth Kuntz. Northampton County SS. Be it remembered that on the 14the day of January Anno Dom. 1851 (or 1857) personally appeared before me James Kennedy one of the Judges of the Courts of Common Pleas in and for said County, Elizabeth Kuntz one of the signers to the above written deed who being of full age and by me duly examined separate and apart from her husband and the contents of the above written deed made known unto her declared that she did voluntarily and of her own free will and accord sign seal and as her act and deed deliver the said Indenture, without any compulsion or coercion of her husband. In testimony whereof I have set my hand and seal the day and year aforesaid, James Kennedy (seal) Northampton County SS. Be it remembered that on the second day of April A.D. 1856 personally appeared before me the subscriber a Justice of the Peace in and for said county the above named Susanna Silfies,

Charles Silfies and Mary Ann his wife, James Silfies and Susanna his wife and Tilghman Kuntz acknowledged the above written Indenture to be their act and deed severally and jointly and desired that the same might be recorded as such. They the said Mary Ann, and Susanna, being separate and apart from their husbands, being of full age, and the contents made known unto them severally, both declared that they did voluntarily and of their own free will and accord sign and deliver the same without any compulsion or coercion of their respective husbands.
