Deed Book 4, page 459-60 THIS INDENTURE made this sixth day of June in the year of our Lord one thousand eight hundred and three, between Nathaniel Kerby of Pittsylvania County of the one part, and James Patterson of Franklin County of the other part. Witnesseth that the said Nathaniel Kerby for and in consideration of the sum of three hundred pounds current money of Virginia, to him in hand paid before the sealing & delivery of these Presents, the Receipt whereof is hereby acknowledged, hath granted, bargained and sold, and by these Presents doth grant bargain Sell & Confirm unto the said James Patterson, his heirs and assigns forever, one certain tract or parcel of Land situate, lying and being in the County of Franklin on both sides of Chestnut Creek, containing nine hundred and sixty seven acres, be the same more or [page] 460 less, and bounded as follows, towit Beginning at Stegal's and Rives's Corner Walnut on Pig River, thence up Chestnut Creek bounded by miss Dickenson's line, from thence bounded by the north side of Chestnut mountain, from thence bounded by Benjamin Potter's Land, and from thence by John Woodall's Line to the Beginning: TO HAVE AND TO HOLD the said Land and Premises unto the said James Patterson, his heirs and assigns forever, with all kind of improvements and their appurtenances unto the said James Patterson his heirs and assigns forever; to the only proper use and behoof of him the said James Patterson his heirs and assigns for ever. and lastly the said Nathaniel Kerby doth for himself, his heirs, assigns etc. all singular the Premises herein granted ____ with the appurtenances unto the said James Patterson, his heirs and and assigns forever against him the said Nathaniel Kerby and all and every other person or persons whatsoever shall and will warrant & for ever defend. This Indenture of bargain and Sale between Nathaniel Kerby of the one part & James Patterson of the other part was acknowledged by the said Nathaniel Kerby & ordered to be recorded. Deed Book 8, pages 491-2 KNOW ALL men by these presents that I Jesse Kerby, Attorney for Francis Kerby of the County of Garrard and State of Kentucky, for and in consideration of two hundred and thirty seven Dollars, have remised, released and forever quit claim for him the said Francis Kerby, his heirs, executors, administrators and assigns and by these presents as Attorney aforesaid, do remise, release, ad forever quit claim to Joseph Rives, his heirs, executors, Administrators, and assigns, of the County of Franklin and State of Virginia, all the said Francis Kerby's rights title and etc. Interest, both real and personal in the estate of Elisha Estes deceased, late of the County of Franklin and State of Virginia belonging to him the said Francis Kerby as legatee of the said Elisha Estes dec'd to the said Joseph Rives, his heirs and assigns forever, and I the said Jesse Kerby att'y as aforesaid the Interest in the estate aforesaid to the said Joseph Rives his heirs and assigns against him the said Francis Kerby, his heirs and assigns, shall and will warrant and forever defend. Dickerson for Francis Kerby John Zeigler, George Taylor William Cooper At a Court held for Franklin County September 6th 1819 This Deed of release from Jesse Kerby attorney for Francis Kerby to Joseph Rives, was proved by the oath of William Cooper one of the witnesses hereto. And at a Court held for said County October 4th 1819 the same was further proved by the oath of Robert N. Dickenson and the solemn affirmation of John Zeigler two others of the witnesses hereto and the same was ordered to be recorded. Teste Caleb Tate C. F.C Deed Book 8, pages 531-2 KNOW all men by these preasents that I Jesse Kerby of the County of Warren and State of Kentucky for and in consideration of Fifty pounds, have remised, released and forever quit claim for me my heirs, Executors & Administrators and by these presents, do remise, release and forever quit claim to John Chois his airs and assigns of the County of Franklin and state of Virginia all my right, title and interest both real and personal in the estate of Tully Choice decesed estate in the County of Henry now Franklin of the state of Virginia as also of Cyrus Chois decesed of the County of Henderson, now Union and State of Kentucky belonging to me as lagatee of the said Tully Chois and Cyrus Chois deces'd to the said John Choice, his heirs and assigns forever, and the said Jesse Kerby and his heirs his said interest in the two estates aforesaid to the said John Choice his heirs and assigns against him the said Jesse Kerby his heirs and assigns shall and will warrant and forever defend in witness whereof I have hereunto set my hand and affixed my seal this 11th day of August 1819 In presents of us Jonathan Jamison his Aaron Waller Jesse X Kerby seal Henry Johnston mark [page] 532 State of Kentucky, Warren County ___ I as Clerk of the County Court for said County do certify that the Instrument of writing was this day acknowledged before me in my office by the within named Jesse Kerby to be his act and Deed.
