Joseph Burnham of Arundel, Maine

According to Charles Bradbury's 1837 "History of Kennebunkport", Joseph was the son of Isaac and Anna (Merrill) Burnham.    Bradbury further reported that Joseph "left town 40 years ago".  However, according to the 1838 deposition of his uncle, Seth Burnham, Esq., Joseph Burnham "went to sea as much as forty five years since and has never since been heard of". 

Joseph married Susannah Gardner circa 1788-89.  After Joseph's death, Susannah married Joseph Proctor in 1800.  Widowed a second time, she married Dudley Stone in 1808.  All three marriages can be found in "Vital Records of Biddeford, Maine prior to 1856" by John D. Beatty.

I Ehpraim Thompson of Lyman in the County of York and State of Maine yeoman, do on oath testify and declare, that I was a soldier of Capt Haywoods Company, of Col Smiths Regiment from March 1781 to the close of the war.  I further testify that Joseph Burnham of Arundel enlisted with me at the same time; was in the same company, and continued there until the close of the war when he was honourably discharged,  - said Joseph Burnham died many years ago, leaving Susannah Burnham, his widow, who was afterwards married again.

I Seth Burnham of Kennebunk Port in the County of York and State of Maine Esquire, do on oath testify and declare, that I well knew Joseph Burnham of Arundel, who was in the service of the United States during the revolutionary war -- said Burnham went to sea as much as forty five years since and has never since been heard of -- I further testify that I well knew his wife, Susannah Burnham whom he left as his widow -- She was again, married to one Proctor -- and after his death to Dudley Stone who has been dead ten or eleven years -- and that Susanna Stone now living is the same person who was the widow of said Joseph Burnham.

I Edward E Bourne of Kennebunk, in the County of York Esquire, do on oath testify and declare, that I have for some years known that the widow of Joseph Burnham was still living, and being called upon by her to prepare  her claim and obtain the evidence to establish the service of said Joseph in the Revolutionary war, I am fully satisfied from the deposition of Seth Burnham Esquire one of the most respectable citizens of Kennebunk Port and from the general knowledge of the fact by all those persons to whom I have mentioned her case, that Susanna Stone now living is the same person who was the widow of Joseph Burnham aforesaid.

The cause of the delay in this case is that the applicant had no knowledge of the Resolve allowing
the fifty dollars

I Susanna Stone of Kennebunk Port in the County of York and State of Maine, aged seventy five years, do, upon oath, declare in order to obtain the benefit of a Resolve of the Legislature of Maine, passed March 27 1835,  entitled a Resolve additional to a Resolve Passed March 17 1835  entitled a "Resolve in favor of certain Officers and Soldiers of the Revolutionary War, and the Widows of the deceased Officers and Soldiers, " that I was the widow of Joseph Burnham late of Arundel in said County, deceased, and I have reason to believe and do fully believe that my said husband Joseph Burnham enlisted in the service of the United States in the year 1781 for three years or during the war, in the company of Captain Haywood of Col Smiths Regiment, and that he served  therein till the close of the war when he was honourably discharged.  His written discharge having been in my possession many years after his death -- I have since been twice married, but have now been a widow eleven years.

I do further on oath declare that at the time of my said husband's enlistment, he was an inhabitant of Arundel as aforesaid  and that I was on the 26th day of March 1836, and have been ever since, and am now an inhabitant of the State of Maine, residing in Kennebunk Port, aforesaid, where I have 
resided for twenty nine years past.  that neither I, nor my said husband, nor any one claiming under me or him has ever received a grant of Land, or money in lieu thereof from the Commonwealth of Massachusetts, for his said service, or any service during the Revolutionary War, and that I am justly entitled to the benefit of said Resolve.

Know all Men in these Presents, That I Susanna Stone of Kennebunk Port in the County of York and State of Maine, being the same person by whom the preceding declaration was made, do hereby constitute and appoint Oliver Frost (?) of Banger my true and lawful Attorney for me and in
my name, to receive from the Land Agent of the State of Maine, such certificate as he may issue to me, in virtue of a resolve of the said State, Resolve Additional to a Resolve passed March 17 1835 entitled "Resolve in favor of certain Officers and Soldiers of the Revolutionary War, and the Widows of the deceased Officers and Soldiers," to the benefit of which Resolve I am entitled.  And my said Attorney is hereby authorized and empowered upon the receipt of said certificate, for me in my name, to execute such receipt or acknowledgement therefor, as I might, were I personally present.

Hereby ratifying and confirming whatever my Attorney shall do by virtue hereof, Witness my hand and seal this twenty third day of July - A.D. 1838
