47. Typed note, Jonnie Mae Hackworth, unknown, Katherine Watson Cochrane, Personal collection of Katherine Cochrane, viewed 11 July 1998, disputes date in certified copy.
48. 1941, copied from Marriage Book 1, page 4, Travis Phillips, County Clerk, Washington Co., TX.
Jonnie Mae Hackworth disputed this date because Stephen Austin Hackworth was born before the official marriage date of W. W. Hackworth and Eliza Jane Pennington, and because the name on the certificate was Mary Jane Pennington, not Eliza Jane. According to a letter she later wrote to Phillips, she had asked for the certified copy, and probably told him the name it “should have been” thus introducing the error herself. But this is speculation. She did ask him to “clear it up” but there is no record of a change being made in her papers. She speculated that the late marriage was because they did not want to be married by a Spanish (Catholic) priest as Mexican law required before the Texas Revolution, but the Revolution was mostly over before Pennington and Hackworth arrived in Texas. Eliza Jane Pennington reported that she married William Wilburn Hackworth on 6 Aug 1839 in her application for a Confederate widow’s pension. -- KWC 7/11/1998

Description of Database: When planning to marry, the prospective groom took out a bond from the clerk of the court in the county where the bride had her usual residence as surety that there was no legal obstacle to the proposed marriage. On file in the North Carolina State Archives are 170,000 marriage bonds, covering the years 1741-1868. These records were abstracted by the Works Progress Administration. Most of the bonds contain the following information: groom's name, bride's name, date of bond, bondsmen, witnesses.
