ROBERT TAIT ERVIN
Robert Tait Ervin was born May 27, 1863, on his father's plantation in Wilcox County, Alabama and died October 24, 1949, in Mobile. His great-grandparents were Colonel John Ervin, of Marion County, South Carolina, who commanded the Britton's Neck Regiment of Marion's Brigade in the Revolutionary War, and Jane Witherspoon. His grandfather, Samuel Ervin, was born, July 6, 1776, in South Carolina and died, January 26, 1823. In 1810 Samuel migrated to a part of the Mississippi Territory which became Baldwin, County. There he established a large plantation and served in the Territorial Legislature for three terms, as well as serving in the Mississippi Territory Militia during the War of 1812. In 1820, he sold his land in Baldwin County, and moved to his new plantation at Coal Bluff, Wilcox County, where he married Mary Ann (Eades) (Gullett), the elder daughter of Captain John Eades. She was born March 17, 1800 and died August 26, 1831. Robert Hugh Ervin was the only issue of this union. He was born September 11, 1822 and died January 11,1875. At Robert Tait Ervin's birth, his father, Robert Hugh Ervin, was serving in the Confederate Cavalry during the Civil War. Robert Hugh Ervin was a physician and surgeon, as well as a plantation owner. He was elected to the State Legislature in 1853 and to the State Senate in 1863, 1865 and 1872. During the latter term he served as President Pro Tem until his death. After the Civil War he conducted a cotton brokerage business in Mobile as well as operating his plantation in Wilcox County. The mother of the future judge, Sarah Asbury (Tait) Ervin, was born in Wilcox County on September 1, 1826 and died March 13, 1905. Her grandfather, Charles Tait, was the first Federal District Judge in Alabama.
Robert Tait Ervin attended local district schools, and Marion Institute. In 1882 he moved to Mobile, and at nineteen, commenced reading law in the law office of his brother in law, Judge Huriosco Austill. He was admitted the Mobile bar in 1883, and entered the legal profession as a member of the law firm of Austill, Mahon and Ervin. For two years, he attended the University of Alabama, receiving his Bachelor of Laws degree in 1887. Judge Ervin later associated with H.L. Faith in a law firm. From 1900 to 1917, he associated with Joseph N. McAleer, in a law firm, under the name of Ervin and McAleer. Following the action of Congress in 1898, establishing offices of referees of bankruptcy, he was named by Judge Harry T. Toulmin as Referee of Bankruptcy for the Southern District of Alabama. He served in that office until 1917, when President Wilson appointed him to the position of U.S. District Judge, at the death of Judge Toulmin. He served in that capacity until his retirement in 1935, after which time he was frequently called back to temporary active status on various Federal benches.
On June 8, 1897, Judge Ervin married Frances Patterson Pybas of Jackson, Tennessee. She was the daughter of James Clark Pybas and Marina Adeline Clark, and was born April 15, 1871 and died November 15, 1962.
Their three children were:
1. Frances Patterson was born June 10, 1898, and died October 16, 1995. On April 18, 1931, she married Ledcreich Stuart Vance, who was born January 7, 1899 and died October 6, 1962. Their children were Frances, born June 27, 1932, and died November 7, 1971, and Samuel Ledcreigh, born March 18, 1936.
2. Robert Tait Jr. was born March 25, 1902, and died January 27, 1981. On November 6, 1930 he married Elizabeth Florence Starkey, who was born April 30, 1898, and died April 6, 1991. Their children were Elizabeth Norreys, born October 21, 1931, and Robert Tait III, born January 8, 1934.
3. Elinor McCorry was born April 19, 1906, and died February 21, 1998. On April 18, 1929 she married Claude Curtis Bullock, who was born July 7, 1904 and died August 24, 1973. Their children were Claude Curtis Jr., born August 29, 1930, and Robert Ervin, born March 24, 1934.
For over two decades Judge Ervin served in the Alabama State Militia and Alabama National Guard. In 1884, he enlisted as a private in the Mobile Rifle Company and advanced in the ranks of that organization through the rank of Lieutenant. In 1890, he transferred as a first lieutenant, to Company E, First Regiment of the Gulf City Guards. He was a first lieutenant and captain in the Mobile Rifles from 1892 to 1895. He was a major in the First Regiment, Alabama State Troops from 1895 through end of the Spanish American War.
Judge Ervin was a member and a deacon in the 1st Baptist Church of Mobile. He was known for his love of hunting and fishing. He was a renowned foxhunter and prior to World War II, was a common sight in Mobile County, riding his horse Major, with his pack of foxhounds trailing behind. He was a charter member of Bull Pen Hunting Club and Choctaw Bluff Hunting Club.
