In the Name of God Amen

I, Martin Helman, of the town of New Lisbon and the County of Columbiana, and the state of Ohio, Considering the uncertainty of the Mortal life, and being yet in sound and disposing mind, memory and understanding, blessed be God for the same, but calling unto mind the mortality of my body and knowing it to be appointed for all men once to die.---Do this twenty seventh day of February, in the year of our Lord one thousand eight hundred and thirty nine, Make and ordain, this my last Will and Testament in the following manner.

First I recommend my immortal spirit into the hands of my great and merciful creator trusting in his mercy for pardon and remission of all my sins and a happy admission in the regions of bliss and immortality and as for my body, I recommend to the earth to be decently buried in a Christian like manner, at the discretion of my executors, and <illegible> my worldly affairs, which it has pleased God to bless me with in this life, I give, bequeath and dispose of in the following manner.

First I will and direct that all my just debts and Funeral expenses be paid off as soon as conveniently may be after my decease, by my executors who shall be named hereafter and, whereas, John Watson, married to my daughter Magdalena, and William Hosstetter, married to my daughter Lydia Teresia hath each of them already received of me, to the best of my calculation, in household furniture and sundry other things, to the amount of four hundred dollars, in the beginning of their keeping house, it is my will that my son Charles F. Helman shall have out of my property, to the amount of the same sum, of four hundred dollars, including what he already hath in furniture to which he hath <illegible> against himself, and it is my will, that Magdalena, daughter of Frederick Shultz, now married to Ferdiment(?) F. Beck shall be paid to her by my executor, as soon as can be one hundred dollars or in case of her death to her children only, and it is further my that all my real & personal property except what is already disposed of as above, shall be appraised by three judicious and disinterested men, that is, the property in New Garden, now in the possession of John Watson, and the place now in the possession of William Hosstetter, and the house and lots whereon Charles F. Helman now resides, likewise the out lot with the improvements thereon and the lot on the corner of Market and Washington Streets with the improvements, and the piece of land containing about 30 acres with the oilmill and all the improvements thereon, all the above property shall be equally divided between my three children, that is one third part to my son Charles F. Helman and his heirs and assigns forever, the second third part shall be given to John Watson and his wife Magdalena and to their heirs and assigns forever and the third or last third part shall be given to my son in law William Hosstetter and to his wife Lydia Teresia and to their heirs and assigns forever. It is my will that the house wherein I now reside, together with the lot, and the lot back of my stable which extends to Washington Street, shall fall to the share of my son Charles F. Helman, but, in case my son Charles should not wish to take the two lots with all the buildings thereon, the new or west part may be struck off from the old, but in that case the front of the new house shall extend four inches in the west wall of the old house, and the ground of both the lots shall be so divided that the front of the east part whereon the old house stands shall have as much front on Washington as on Walnut street and in case it be so divided, an alley of fifteen feet wide shall be made across the lot back of my stables.

I have already given to my son Charles, Drugg & Medicine & Co. to the amount of twenty three hundred dollars, which was the amount of my share at the time we dissolved partnership, which shall be included in his share. It is my will that my property in New Garden, that is five lots with the buildings thereon, and a five acre lot near town, shall be included in John Watson's share, and the tract of land, now in the possession of William Hosstetter, containing about one hundred and seventy acres, shall fall to the share of the said William Hosstetter, but if the said shares cannot be equally divided, an equivalent shall be made up out of the larger share or shares, or out of the other property, such as the lot with the stone thereon, and the property on the corner of Market and Washington Street, or the land with the oilmill thereon, the shares shall be made be made as equal as possible can be, but in case the property cannot be divided to the satisfaction of my heirs, my executor shall have full power to sell or dispose and part thereof (with the exception of what I have particularly assigned to Charles F. Helman, John Watson and William Hosstetter) to the best advantage, and convey the same by deed as were I myself present, it is further my will that the agreement I made with Frederick Shultz, shall be faithfully adhered to which is recorded in the recorders office and lastly, I nominate and appoint, my son Charles F. Helman, my son in law William Hosstetter and my trusty friend John T. Bowman Esq. my executors of this my last Will and Testament, putting all my confidence in them, and hereby dissolving and making null and void all other and former wills and ratifying and confirming this and no other to be my last Will and Testament.
