IN THE NAME OF GOD,

IN THE NAME OF GOD, AMEN. I, Abel D. Helman, of the city of Ashland, Jackson County, State of Oregon, at the age of eighty one years, and being of sound and disposing mind and memory and not acting under duress, menace, fraud, or undue influence of any person whatever, do make, publish and declare this my last Will and Testament, in manner following, that is to say:-

First, I direct that my body be decently buried with proper regard to my station and condition in life, and the circumstances of my estate, and that my grave be marked by a suitable headstone or monument.

Secondly, I direct that my executor, hereinafter named, as soon as he shall have sufficient funds in his hands, pay my funeral expenses, and the expenses of my last sickness, all just debts and the cost of the aforesaid headstone or monument.

Thirdly, I give and bequeath to my wife, Susan A. Helman, the sum of One Thousand Dollars, and all household goods,
To my daughter, Almeda L. Shephard, the sum of Five Dollars
To my daughter, Mary E. Niles, the sum of Five Dollars
To my daughter, Martha J. Carter, the sum of Five Dollars
To my son, John K. Helman, the sum of Five Dollars
To my son, A. Lincoln Helman, the sum of Five Dollars
To my son, Benjamin F. B. Helman, the sum of Five Dollars
To my son, U. S. Grant Helman, the sum of Five Dollars
To my son, Otis O. Helman, the sum of Five Dollars
To my step-daughter, Minnie Rockfeller Lane, the sum of Five Dollars, which said several legacies or sums of money I direct and order to be paid to the said respective legatees out of the proceeds of the sales of the personal property owned by me at the time of my death, and also the proceeds of any notes, accounts and other evidences of debts due and owing to me at the time of my death, and also moneys in bank or banks, after first paying and fully satisfying out of said proceeds all my just debts and expenses of administration and state taxes, and the payment of all sums as hereinafter specified, should the balance of said proceeds suffice for that purpose, and if not, then I direct and order that the said legacies or sums of money to be paid to the said respective legatees pro rata, in like proportion, but should the proceeds of all personal property left by me at the time of my decease exceed the amounts designated to be paid to said legatees then I direct and order that said surplus, if any, be paid to my wife Susan A. Helman.

Fourthly. Also I further give and devise unto my said wife the use and occupation of my dwelling house where I now reside, and situate in the City of Ashland, Jackson County, Oregon, with all the land owned by me at the time of my death to be enjoyed by her during her natural life, and at the death of my said wife, all the real estate hereby devised and bequeathed to her aforesaid, I give and devise to my hereafter named children, namely, Almeda L. Shepard, Mary E. Niles, Martha J. Carter, John K. Helman, A. Lincoln Helman, Benjamin F. B. Helman, U. S. Grant Helman, Otis O. Helman and Minnie Rockfeller Lane, to be divided share and share alike, provided any one or ones of the above named children die before the time of my decease, or before the time of such division or distribution, leaving issue, then the child or children of each of my deceased children is to be entitled to such share or shares under the provisions of this Will as their prospective ancestors would have been entitled to receive if they were living, it being my intention not to include in such division of said real estate any share or shares to the representative or representatives of any deceased child or children of mine who has no living issue at the time of said division or distribution.

Lastly, I hereby nominate and appoint my wife, Susan A. Helman, of Ashland, Oregon, the executrix of this my last Will and Testament, and hereby revoke all former will by me made, and it is my request that she be required not to give any bond.
